Advertorial for
Attorney Erik Johnson
The effects of the recent
economic downturn are continuing
to devastate individuals
and families. Many people
are suffering from job
losses, business failures or
unplanned medical costs.
Hardworking and honest
citizens are unable to find a
bank willing to lend money
or modify a loan.
Mounting financial pressure
causes extreme anxiety
and ruins relationships.
Money problems often
lead to divorce.
Get a fresh start
Filing for bankruptcy can
be life-changing. It is an
opportunity to “hit the reset
button” and rebuild your
credit anew.
Once a bankruptcy is
filed, all collection efforts
by creditors stop.
All eligible debts are forgiven.
You have a chance to
breathe and regroup.
Should you
consider filing?
Many people facing
tough financial times are
unsure about whether they
should file bankruptcy.
A few reasons to consider
filing for a “Chapter 7”
bankruptcy include:
• emotional freedom from
the stress of trying to make
ends meet
• regaining the ability to
focus on earning a living,
free of harassment by creditors
• a chance to learn how to
correctly manage money so
mistakes aren’t repeated
• an opportunity to clean up
one’s credit report and
rebuild a reputation with
lenders.
Bankruptcy Myths vs. Facts
Many myths prevent
people from filing for bankruptcy
and making a sensible
financial decision. Some of
the common ones are:
Myth: Filing bankruptcy
reflects personal failure
Fact: Most people who file
didn’t do anything risky or
reckless that led to their
financial crisis. People file
because life has dealt them a
blow - like divorce, a job loss,
identity theft or a serious illness
which wreaked havoc
on their finances. Most people
file after months or years
of struggling to pay their
bills and falling further
behind.
Myth: I will lose my home or
car.
Fact: In most cases you will
not lose your home or car.
Exemptions in the law are
available that allow you to
keep certain assets after
bankruptcy.
Myth: I will lose my retirement
savings.
Fact: Retirement funds in
pension plans and IRAs are
protected. You are unlikely to
lose your retirement savings.
Myth: I will never be able to
rebuild my credit.
Fact: You can rebuild your
credit after filing for bankruptcy.
As long as your bills
are paid on time, your credit
score will rise, and you will
consequently be able to qualify
and obtain new credit.
Gradually, your credit will be
re-established.
Myth: Creditors can still
harass and sue me if I file for
bankruptcy.
Fact: Creditors are prohibited
from collection activities
such as filing lawsuits, making
phone calls, or sending
letters, if you file for bankruptcy.
Myth: Bankruptcy is wrong.
Fact: Bankruptcy laws reflect
the well-established principle
that society is better off if
individuals have the opportunity
to obtain relief from
their debts and start again.
Filing for bankruptcy is
purely a business decision
and not a moral one. It is
often the only recourse for an
individual who is a victim of
predatory lending, demeaning
collection practices, or
unanticipated illness or
injury.
How can I help?
Most of the people I see
are good, honest folks who
have come upon hard times
and have no other options.
They have exhausted
their alternatives.
For individuals awash in
overwhelming debt with little
or no prospect of paying it
back, filing for bankruptcy
can offer a fresh start and a
new chapter.
Bankruptcy is not always
the answer, but for some it
may be the only answer.
If you think bankruptcy
may be an appropriate next
step for you, I can help you
decide. My role is to guide
you through the legal
process in an efficient, ethical
and cost-effective manner.
