I don’t get to the Town<br />
of <strong>Gypsum</strong> as much as I like,<br />
except to relax on the lawn<br />
at an occasional <strong>Gypsum</strong><br />
Daze concert, or to attend an<br />
occasional town council<br />
meeting at one of the bestrun<br />
governments around.<br />
But, I was passing<br />
through town last week and<br />
noticed a gas sign on the<br />
Conoco station that read<br />
$2.45 per gallon. Usually, I<br />
make it a habit, when in the<br />
west end of the county, to<br />
get my fill-ups at Corky’s<br />

only the cheapest gas station<br />

I always like to ask the<br />
boys, “Can ya get any service<br />
in this joint?”<br />
“No,” Mike always<br />
answers.<br />
“Fill it with the cheap<br />
stuff,” I reply, and then he<br />
proceeds to fill the tank with<br />
unleaded gas.<br />
But, I digress.<br />

<strong>Gypsum</strong>, I wondered?<br />
That is lower than<br />
Kansas City and Denver<br />
prices. I looked down at the<br />
gas gauge in my car and it<br />
read “empty,” so I pulled in<br />
and filled up, feeling very<br />
good about only paying<br />
$2.45 per gallon.<br />
And, then I noticed it. A<br />
new Kum N Go gas station<br />
magically appeared across<br />
the street in that forever<br />
vacant lot in front of the<br />
Columbine Market.<br />
Now, I understood.<br />
Competition has arrived in<br />
<strong>Gypsum</strong>!<br />
The next day, I had to be<br />
back in <strong>Gypsum</strong> again and<br />
noticed that $2.45 per gallon<br />
was gone, and was replaced<br />
by $2.58 per gallon. Geez,<br />
that didn’t last long. I didn’t<br />
really need gas, but I decided<br />
to buy some at the new<br />
Kum N Go, just to check out<br />
the inside of the store, which<br />
looked pretty nice.<br />
Unfortunately, it took<br />
forever to get the credit card<br />
to work in the new pumps,<br />
because the store was in the<br />
process of lowering the<br />
price by a penny, so it<br />
could be a cent lower<br />
than the Conoco across<br />
the street.<br />
While waiting for<br />
the computers to come<br />
back up, I decided to<br />
shoot some pictures<br />
and talk to people at<br />
both gas stations.<br />
Clearly, I was in<br />
the middle of a goodole-fashioned<br />
gas war.<br />
I liked that, having<br />
grown immune to paying<br />
some of the highest<br />
gas prices in the country<br />
in Vail for the last<br />
35 years.<br />
This was an event<br />
of epic proportion. A<br />
real gas war in Eagle<br />
County. I have never<br />
seen that before.<br />
So, when the Kum N Go<br />
dropped it’s price to $2.57<br />
right in front of me, I felt<br />
badly because I had just<br />
paid $2.58. Then, I drove<br />
across the street and took<br />
pictures of a girl at the<br />
Conoco, dropping her station’s<br />
price to $2.56 minutes<br />
later.<br />
Na - na na, na - na - na!<br />

Just like two little kids<br />
trying to best each other. It<br />
felt “really good” taking<br />
advantage of this.<br />
But, I’ll still buy from<br />
Corky’s in Eagle. They have<br />
consistently had the lowest<br />
prices in the county for<br />
years. Besides, I wouldn’t be<br />
happy if I couldn’t ask,<br />
“Can ya get any service in<br />
this joint?”<br />

Vail Council wants to add debt, without voter approval<br />

If you ran a business in<br />
Eagle County, would you<br />
borrow $12 million in this<br />
economic climate, and pay<br />
it back, along with $7 million<br />
more in interest? This<br />
publisher wouldn’t, and<br />
neither would Vail<br />
Councilman Kevin Foley.<br />
Should government do<br />
it without voter approval,<br />
as required by the state constitution’s<br />
Taxpayer Bill of<br />
Rights (TABOR), which<br />
was initiated by voters<br />
state-wide and passed in<br />
1992?<br />
It appears that most of<br />
the rest of the Vail Council<br />
thinks so, as no one else<br />
objected to that idea at a<br />
1pm meeting of the council<br />
on Tuesday, August 17th.<br />
This Vail meeting was<br />
held 30 minutes prior to<br />
Council’s usually wellnoticed<br />
work session, while<br />
acting as another legal entity<br />
known as the Vail Re-<br />
Investment Authority, with<br />
only three-to-four days<br />
notice of the meeting, and<br />
conveniently minutes<br />
before the Channel 5 Public<br />
Access camera would<br />
arrive to shoot the regular<br />
work session meeting, to<br />
prevent voters from being<br />
informed.<br />
Vail’s experienced bond<br />
counsel, Dee Wisor, cited a<br />
2001 Colorado Appellate<br />
Court decision, offering his<br />
opinion that their decision<br />
eliminates the need for<br />
voter approval for borrowing<br />
money in this instance,<br />
thereby overturning<br />
TABOR.. This case was<br />
never brought before the<br />
Colorado Supreme Court,<br />
but most Colorado courts<br />
have been known for overturning<br />
voters’ rights.<br />
And, the courts wonder<br />
why the “Clear the Bench”<br />
campaign wants more<br />
judges removed for usurping<br />
voters’ rights in the<br />
November election!<br />
If the loan idea passes at<br />
the Tuesday, September<br />
21st meeting of the<br />
Authority, it would indebt<br />
Vail taxpayers for the next<br />
20 years.<br />
The Authority doesn’t<br />
even know what it wants to<br />

spend the money on.<br />
Did I mention that Vail<br />
has approximately $50 million<br />
in reserves that it could<br />
use instead of borrowing<br />
money? Did I mention that<br />
Vail will have $3 million<br />
more in cash available at<br />
the end of the year that it<br />
could apply to this, plus it<br />
could tap $10 million from<br />
the voter-approved tax for<br />
a never-to-be-built conference<br />
center, that voters<br />
could simply approve for<br />
this new purpose, thereby<br />
saving the need to borrow<br />
$12 million?<br />
But, to do that, the<br />
council would have to ask<br />
for voter approval. They<br />
obviously don’t trust voters<br />
to do that?<br />
The fact is, the Vail<br />
Town Council doesn’t trust<br />
the voters to approve<br />
indebting themselves for 20<br />
years, in what could be a<br />
loan up to $26 million, plus<br />
$14 million or more in<br />
interest!<br />
They are right. The voters<br />
are smart enough not to<br />
approve that when Vail has<br />
the cash to do it and the<br />
”I will take you to a fun place to ride!”<br />

In 2003 and 2004, the<br />
publisher was privileged to<br />
have spent two to three<br />
afternoons a week having<br />
“cocktails with the boys” at<br />
the Edwards Brewery.<br />
The boys usually consisted<br />
of my friends, Gerald<br />
Gallegos, Richard DeClark,<br />
Mike Walters, myself, and<br />
others who periodically<br />
dropped by.<br />
The publisher has<br />
known Gerald since 1975,<br />
when Gerald was a bouncer<br />
at Vail’s number one bar, the<br />
Nu Gnu. Gerald was built<br />
like the stones he carried<br />
back in those days. He was<br />
one tough dude, not someone<br />
you wanted to mess<br />
with, if you know what I<br />
mean, and I think you do.<br />

But, he had a soft side to<br />
him. You didn’t have to be<br />
afraid of Gerald. That soft<br />
side stayed with him<br />
throughout his life.<br />
As friend Richard<br />
DeClark said about Gerald’s<br />
passing, “He wrote the book<br />
on how to give back,” referring<br />
to how Gerald had<br />
helped build a stone business<br />
into a mega corporation<br />
and then gave back to<br />
the community.<br />
“Nobody has done<br />
more than that guy!”<br />
DeClark continued. “He<br />
gave back more than he<br />
took!”<br />
Mike Walters told the<br />
publisher the day after<br />
Gallegos passed, “It’s not as<br />
much fun today as it was<br />
before Gerald died.”<br />
After Gerald died, an<br />
acquaintance said to me that<br />
Gerald wasn’t as perfect as<br />
some thought.<br />
I responded that of all<br />
the wealthy people I’ve<br />
known, Gerald gave more<br />
back than anyone, period,<br />
bar none! It wasn’t even<br />

I wanted to touch base<br />
with you and let you know<br />
where we are at in your<br />
request for more details on<br />
the county’s notification<br />
policies when we deny<br />
services. As we discussed,<br />
the county does verify the<br />
legal eligibility of all those<br />
applying for assistance.<br />
Those that are not eligible<br />
are denied.<br />
We do not, however,<br />
notify law enforcement of<br />
such denials.<br />
I have done some brief<br />
research and have found<br />
that our practices seem to<br />
be consistent with other<br />

counties in the state. The<br />
reason for this is that county<br />
health and human service<br />
departments act as an<br />
arm of the state in providing<br />
these assistance programs.<br />
C.R.S. §26-1-114<br />
states that it is the state<br />
department of human services<br />
who will establish rules<br />
and safeguards restricting<br />
the use or disclosure of<br />
information concerning<br />
applicants.<br />
I have reviewed some<br />
of the rules and regulations<br />
from the state on the confidentiality<br />
of applicants and<br />
am attaching those. We are<br />
required to verify alien registration<br />
numbers of recipients<br />
and if the State<br />
Department tells us that the<br />
name and number do not<br />
correspond, we are directed<br />
to terminate assistance. We<br />
are not authorized by the<br />
state to take any additional<br />
action.<br />
There are several<br />
statutes that I located dealing<br />
with confidentiality of<br />
dependency and neglect<br />
cases (19-1-301 et al), child<br />
support enforcement cases<br />
(26-13-102.7), and the above<br />
health and human services<br />
cases (26-1-114). The general<br />
theme indicates limited<br />
disclosure and only when<br />
specifically authorized by<br />
the state. For instance, the<br />
directive from the state in<br />
reporting illegal aliens as it<br />
applies to food stamp<br />
authorizes counties to<br />
make such notification to<br />
law enforcement, but only<br />
when we are aware of firm<br />
evidence (known to have a<br />
final order of deportation<br />
outstanding) and not on<br />
mere suspicion.<br />
Our concern is that our<br />
employees could face<br />
penalties, and we could<br />
face a loss of subsidies for<br />
failing to follow state directives<br />
in this regard.<br />
Kathy Lyons is out this<br />
week at training, but I will<br />
ask that she verify my<br />
information is correct with<br />
the state when she gets<br />
back. If so, it appears the<br />
issue is at a state level, as<br />
we cannot do more absent<br />
different direction from<br />
them.<br />

Minturn town attorney won’t read removal petition<br />

Other towns are different<br />
This situation where<br />
the town attorney serves<br />
dual roles in Minturn, is different<br />
from some other<br />
towns in Eagle County, that<br />
opt to have a separate prosecutor<br />
and a separate adviser<br />
to their council.<br />
Christensen, the<br />
town’s attorney since 1984,<br />
was not available to respond<br />
to a last-minute telephone<br />
call from Business Briefs on<br />
deadline day before the July<br />
29th issue, but later told<br />
Business Briefs that, “I<br />
haven’t read the petition<br />
because it could unnecessarily<br />
bias me against citizens<br />
that signed it.”<br />
By not reading the<br />
petition, Christensen will<br />
less likely know which citizens<br />
want him gone, should<br />
he have to prosecute any<br />
later in the Minturn<br />
Municipal Court.<br />
Christensen showed<br />
Business Briefs a sealed<br />
envelope that he stated was<br />
a copy of the petition.<br />
“As a prosecutor, I<br />
have to be neutral,” he stated.<br />
“We’re all human.”<br />
Naturally, any citizen<br />
who is prosecuted by<br />
the town attorney, could<br />
also possibly hold a bias<br />
against him, as well.<br />
Refuses to fight Freedom<br />
of Information requests<br />
Christensen also<br />
told Business Briefs that he<br />
had advised the town not to<br />
fight Freedom of<br />
Information requests.<br />
In fact, the town<br />
printed agendas with total<br />
transparency under state<br />
statute, which read “to discuss<br />
personnel matters concerning<br />
the Town Attorney.”<br />
According to the<br />
Town’s website, “the town<br />
attorney is appointed by the<br />
Minturn Town Council and<br />
provides legal advice and<br />

counsel to the Town Council<br />
and town officials in matters<br />
relating to their official<br />
duties. The town attorney is<br />
also the legal representative<br />
of the Town in county, state<br />
and federal court and<br />
directs outside counsel who<br />
represent the Town in that<br />
capacity. The town attorney<br />
attends all council meetings<br />
and drafts ordinances and<br />
resolutions for council<br />
approval. The town attorney<br />
reviews and consults on<br />
contracts regarding town<br />
services and provides legal<br />
opinions and staff consultation<br />
on such issues as land<br />
use and development, property<br />
acquisition, personnel,<br />
finance, liquor licensing and<br />
such other matters as the<br />
town council or town manager<br />
may direct. The town<br />
attorney prosecutes violations<br />
of the municipal code<br />
before the Town of Minturn<br />
Municipal Court.”<br />
According to the<br />
agenda of the August 4, 2010<br />
meeting of council, an<br />
Executive Session was<br />
called to disuss Christensen,<br />
and again at the August 18,<br />
2010 meeting, as well.<br />
Council will address it at<br />
September 1st meeting<br />
At the August 18th<br />
meeting, Mayor Gordon<br />
“Hawkeye” Flaherty indicated<br />
that the subject of the<br />
status of the Town Attorney<br />
would be discussed in the<br />
open portion of the<br />
Wednesday, September 1st<br />
meeting of council and that<br />
the council would “take<br />
action regarding the petition.”<br />
The Mayor also said<br />
that the council was “taking<br />
it (the petition) very seriously,”<br />
and that the “public can<br />
speak” at the meeting.<br />
This differs from<br />
Town Administrator Jim<br />
White’s previous statement<br />
to Business Briefs, when he<br />
indicated that because it<br />
was a personnel issue, it<br />
would not be discussed<br />
before the public.<br />
Clearly, a public<br />
hearing would be far more<br />
transparent, but not necessarily<br />
legally required.<br />

in addition to him writing<br />
large checks to local charities,<br />
over and over and over<br />

One waitress, who was<br />
happily married, said to me,<br />
“I count on Gerald to help<br />
me feed my family. There is<br />
no one like Gerald!”<br />
Whenever we’d have<br />
cocktails, Gerald always<br />
wanted to pick up the tab.<br />
The publisher likes free<br />
drinks, just like everyone<br />
else. But, after a couple of<br />
times of this, I told Gerald<br />
that I can afford to buy my<br />
own drinks, and that occasionally<br />
he needed to let me<br />
pick up the tab and “get<br />
over it!”<br />
Occasionally, I’d have to<br />
threaten to take him outside<br />

cooperate. I did threaten<br />
him, but if you don’t know<br />
me, then you don’t know<br />
that I couldn’t begin to hurt<br />
Gerald in a fair fight.<br />
I know the waiters and<br />
waitresses would cringe if<br />
they thought old cheapface<br />
here was going to pick up<br />
the tab, instead of Gerald,<br />
because they know I’m only<br />
good for a 15-20% tip.<br />
But, I am certain that<br />
Gerald always slipped them<br />
a hundred on top of my tip.<br />
I saw Gerald a few<br />
weeks ago at the Dance Gala<br />
benefit. I spoke with him for<br />
about five minutes and then<br />
returned to my table. I said<br />
to a friend, “I don’t think<br />
Gerald has much longer to<br />
be with us.”<br />
Rest in peace, Gerald.<br />
