SECTION II<br />
SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
general conduct of operations is maintained in a safe and efficient manner, and that disruption<br />
and inconvenience to existing streets and property is minimized.<br />
The subcontractor shall work whenever conditions permit, regardless of anticipated or orderly<br />
procedure, schedule, the operations of other subcontractors, the Owner’s operations, or<br />
because of conditions encountered, and to proceed without delay and to maintain early<br />
completion.<br />
The existing <strong>Henry</strong> <strong>Ford</strong> <strong>Hospital</strong> facility is highly sensitive to noise, dust, or vibration. The<br />
Owner reserves the right to halt construction activity when patient care activities in the<br />
hospital are impacted by these factors.<br />
H. DEVIATIONS<br />
The Scope of Work shall include any or all deviations in the Contract Documents required to<br />
meet job conditions and complete the work under the intent of the specific Contract<br />
requirements. The subcontractor shall bring these deviations, if any, to the attention of <strong>Turner</strong><br />
<strong>Construction</strong> at bid time or as soon as they become necessary before commencement of<br />
work.<br />
I. EXTRA WORK<br />
1. It should be understood that award of a Contract for a portion of the work shall in no<br />
way obligate <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> to extend the Agreement to cover<br />
additional work throughout the total project.<br />
2. All quotations for extra work/scope revisions must be submitted within ten (10)<br />
calendar days of issuance and must have a detailed breakdown in the format as<br />
outlined below for each line item in a Bulletin on a standardized form which will be<br />
provided to the successful bidder. Pricing for SIS (Superintendent Instructions to<br />
Subcontractor) work must be submitted in twenty-four (24) hours using the wage<br />
rates established in the Subcontract Agreement.<br />

<strong>Turner</strong> <strong>Construction</strong> will secure the general building permit. The Subcontractor shall secure<br />
all other necessary permits, etc. covering his operations, including permits from the public<br />
authorities having jurisdiction over the streets, roads, sidewalks, utilities and all other public<br />
properties in or near which the work is located and the improvements therein. The<br />

SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
Subcontractor shall ascertain the amount of any charges, which he or she may have to pay,<br />
including fees or inspection charges required by such authorities and include them in the bid.<br />
K. EXPEDITING<br />
The Subcontractor shall be responsible for the cost of expediting all equipment and delivery of<br />
his materials on a timely basis. Should it become necessary, in order to maintain job<br />
progress, for <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> to supplement the Subcontractor's expediting<br />
effort, then all costs incurred by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> shall be backcharged to the<br />
Subcontractor by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>. Prior written notice of such Backcharge to<br />
the Subcontractor by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> will be required for reimbursement.<br />
L. MATERIAL SPECIFICATIONS<br />
All manufacturer’s material which is called for in the Design Specifications and Design<br />
Drawings shall be installed in strict accordance with the manufacturer’s published<br />
recommendation for that material.<br />
M. CORRECTIVE ACTION<br />
The Subcontractor shall, upon receipt of notice in writing of any non-compliance work or<br />
material, take corrective action within twenty-four (24) hours or <strong>Turner</strong> will perform corrective<br />
action and forward all associated costs to the Subcontractor.<br />
N. CONSTRUCTION RESPONSIBILITY<br />
The Subcontractor shall be responsible for his work and every part thereof, and for all<br />
materials, tools, appliances and property of every description used in connection therewith.<br />
O. PROCEDURE OF THE WORK<br />
1. The nature of the project is such that close coordination will be required by the<br />
Subcontractor with <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>, the Owner and others having<br />
interest in the project to assure that work on the site, access to and from the site, and<br />
the general conduct of operations is maintained in safe and efficient manner, and that<br />
disruption and inconvenience to existing streets and property is minimized.<br />
2. The Subcontractor shall conduct operations in a manner which will control construction<br />
debris and toxic fumes from material and other equipment from impacting hospital<br />
operations.<br />
3. The Subcontractor shall, at all times, be responsible for the care and custody of the site<br />
and shall take all measures to ensure that responsibility.<br />
4. The Subcontractor shall provide a list of supervisory or management personnel and<br />
home telephone numbers who can be contacted after hours in the event of an<br />
emergency.<br />

SECTION II<br />
SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
P. PROGRESS SCHEDULE AND TIME OF COMPLETION<br />
1. It is understood that the work is to be carried to completion with utmost speed<br />
consistent with good workmanship and to meet the construction schedule including<br />
project staging requirements.<br />
2. The Subcontractor shall begin work under the Contract without delay upon receipt of<br />
the fully executed Letter of Intent or Notice to Proceed and shall substantially complete<br />
the project ready for unobstructed occupancy and use of the Owner for the purposes<br />
intended within the completion time stated in the contact.<br />
3. The Subcontractor shall prepare and submit a detailed progress schedule and<br />
schedule of values within 10 (10) calendar days of the Notice to Proceed, in as much<br />
detail as is satisfactory to <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> for approval.<br />
4. The Subcontractor shall execute all portions of the work in accordance with the<br />
approved schedule.<br />
5. In the event the Subcontractor by his own actions fails to meet his interim milestones of<br />
his contractual schedule, he or she will be required at his own expense to take the<br />
necessary action (additional manpower, overtime, shift time, etc.) to meet his schedule<br />
commitments.<br />
Q. LAWS, ORDINANCES & REGULATIONS<br />
The Subcontractor shall, in the performance of the Contract, comply with and give all<br />
stipulations and representatives required by all applicable Federal, State and Local Laws,<br />
Ordinances and Regulations and shall require such compliance, stipulations and<br />
representations by all other persons with whom he or she shall enter into any Contract<br />
pertaining to the work hereunder. Any deviations from the Contract Drawings and/or<br />
Specifications and any additional work necessary to meet code requirements shall be made<br />
by the Subcontractor with no additional cost to the Owner. The Subcontractor shall be liable<br />
for, and indemnify and hold harmless, the Owner and <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> from any<br />
and all liability or damage arising by reason of the breach of the provisions herein set forth.<br />
R. MBE/WBE<br />
The Owner and <strong>Turner</strong> <strong>Construction</strong> have assigned a goal of 15% City of Detroit MBE<br />
participation and an additional 15% MBE/WBE Southeastern Michigan participation. The<br />
successful contractor will be required to demonstrate proof of achievement of these goals.<br />
Copies of MBE/WBE purchase orders must be submitted to <strong>Turner</strong> <strong>Construction</strong> for record.<br />
S. SUBCONTRACTOR RESPONSIBLE FOR COORDINATION & PROMPTNESS OF WORK<br />
<strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> will notify the Subcontractor when to begin, to cease, or<br />
resume work on individual operations. <strong>Turner</strong> <strong>Construction</strong> is not responsible to give early<br />
notice of the rejections of faulty work and will not in any way superintend so as to relieve the<br />
Subcontractor of responsibility or of any consequence of neglect of carelessness by him or his<br />
Subcontractors. All materials and labor shall be furnished at such time as shall be for the best<br />
interest of all Subcontractors concerned, to the end that all work shall be properly coordinated<br />
and completed in accordance with applicable schedules.<br />

SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
Before beginning any construction work, carefully survey the existing work and examine the<br />
accompanying Drawings and/or Specifications to determine the extent of the work. Take all<br />
necessary precautions to ensure against damage to the property not included in the work<br />
area. The land areas outside the limits of the work area under the Contract shall be preserved<br />
in their present conditions. Damage to such property and land shall be repaired or replaced<br />
at no additional cost to <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>.<br />
U. SECURITY<br />
Subcontractors are advised that they will be required to provide all necessary security, etc. for<br />
their materials, machinery, equipment, tools, temporary offices, etc. No security will be<br />
provided by the Owner or <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>. <strong>Turner</strong> and/or the Owner may at its<br />
option and for its own use provide any surveillance and security he/she deems necessary<br />
within the construction site.<br />
V. SAFETY<br />
1. Safety is a vital concern within the construction workplace and as such a “Safety<br />
Commitment” must be included. This “Safety Commitment” must be submitted on the<br />
Bidder’s letterhead and signed by a Principal of the firm. The “Safety Commitment”<br />
should be current and should address the Bidder’s position and positive endorsement<br />
of safety procedures that are required of the Bidder’s workforce at the project jobsite.<br />
This “Safety Commitment” will be posted at the project jobsite.<br />
2. Includes, at a minimum, a quarterly safety tour at the jobsite by a Principal of the<br />
Bidder’s firm with <strong>Turner</strong> <strong>Construction</strong>’s Safety Coordinator. <strong>Turner</strong>’s Safety<br />
Coordination will provide a safety report card of the Bidder’s workforce in advance of<br />
the tour. The purpose of the tour is to commend the Bidder’s workforce on the positive<br />
aspects of the report card and reinforce the need for improvement for the areas that<br />
require safety improvement.<br />
3. All subcontractors shall comply with <strong>Turner</strong> <strong>Construction</strong>’s Return to Work program as<br />
specified in the Site Specific Safety Program and the OCIP manual.<br />
4. All subcontracts with Contract values over $5,000,000.00 will be required to provide a<br />
fulltime safety professional for the duration of their work. This individual shall be<br />
approved by <strong>Turner</strong> <strong>Construction</strong>. High risk subcontractors may be required to provide<br />
a fulltime safety professional for their Scope of Work at the discretion of the Project<br />
Executive.<br />
5. All personnel visiting or performing work within the construction limit shall participate in<br />
the <strong>Turner</strong> Safety Orientation. All personnel performing work shall comply with the<br />
<strong>Turner</strong> <strong>Construction</strong> Substance Abuse program prior to Safety Orientation.<br />
6. All personnel must sign and acknowledge that they have received and participated in<br />
the <strong>Turner</strong> <strong>Construction</strong> Safety Orientation.<br />
W. SUBSTANCE ABUSE TESTING<br />
All personnel performing work within the construction limits shall participate in the <strong>Turner</strong><br />
<strong>Construction</strong> Substance Abuse Program. The substance abuse testing includes a five (5)<br />

pointing substance abuse test. The testing shall be performed with the results received<br />
before personnel commence to work on site. The test kits will cost Forty-Five Dollars<br />
($45.00) and will be charged back to the subcontractor. All cost for subcontractors’<br />
employees substance abuse testing shall be the responsibility of the subcontractors.<br />
X. IDENTIFICATION BADGES<br />
All personnel performing work on this project shall be issued a <strong>Henry</strong> <strong>Ford</strong> Health System<br />
identification badge. The identification badging shall be issued by <strong>Henry</strong> <strong>Ford</strong> Health System<br />
once the employee has participated in the project safety orientation and substance abuse<br />
testing approved. Identification badges must be displayed by the employee at all times within<br />
the <strong>Henry</strong> <strong>Ford</strong> Health System facility. All cost for identification badges including lost,<br />
stolen, or damaged badges shall be the responsibility of the subcontractor. The cost<br />
for each badge will be Five Dollars ($5.00).<br />
Y. TRAFFIC CONTROL<br />
1. The Subcontractor shall coordinate and schedule his work to conform to the <strong>West</strong><br />
<strong>Bloomfield</strong> Township or County Department of Transportation and the Owner's<br />
requirements for traffic control. The Subcontractor shall furnish, install and maintain all<br />
signage, barricading, flagmen, etc., necessary for the maintenance and safety of traffic<br />
and the general public.<br />
2. Roads, walks, driveways, alleys emergency exits and entrances to buildings shall not<br />
be blocked. Approved protection and temporary crossings shall be provided for<br />
pedestrians if necessary.<br />
Z. CONSTRUCTION TRAFFIC<br />
Access to the site shall be restricted to the routes indicated on the site logistics plan or as<br />
otherwise directed by <strong>Turner</strong>.<br />
All construction traffic, including employee traffic, trucking, and delivery of materials and<br />
equipment shall be controlled by <strong>Turner</strong> or the owner's security forces, and shall enter the<br />
site only by routes prescribed on the site logistics plan. ACCESS TO THE SITE BY OTHER<br />
ROUTES IS PROHIBITED.<br />
For traffic on areas other than the site or hospital property, the subcontractor shall coordinate<br />
such use with property owners, <strong>West</strong> <strong>Bloomfield</strong> Township or other agency(s) having<br />
jurisdiction.<br />
AA.<br />
BARRIERS AND BARRICADES (Applicable to work in or near the existing building)<br />
The subcontractor shall continuously maintain adequate protection of all work from damage<br />
and shall protect the new and existing <strong>Henry</strong> <strong>Ford</strong> facility building and property from injury or<br />
loss. In addition, the contractor shall minimize the visible impact of construction activity and<br />
take steps to afford the smooth flow of pedestrian and vehicular traffic around and through<br />
the construction zone. The contractor shall provide all barriers and barricades at places such<br />
as pits, floor openings, building perimeter, stairways, construction activities in corridors, and<br />
other areas requiring the same and shall maintain such barriers and barricades until the<br />
permanent work is in place. <strong>Turner</strong> will monitor the installation and removal of barriers and<br />
barricades. <strong>Construction</strong> and warning signs shall be placed so they are visible before or as<br />
the construction activities are encountered.<br />

The subcontractor shall provide blocker boy barricades (available through McMaster-Carr<br />
Supply Co., Chicago or equal) around any openings and around contractor's ladders in the<br />
existing building’s corridors.<br />
The subcontractor shall erect and properly maintain dust-tight temporary partitions around the<br />
proposed construction area. The temporary partitions shall be of fire-rated drywall from floor<br />
to ceiling, taped, and painted, with vinyl/rubber base at the bottom. A 24” by 18" sign<br />
furnished by the <strong>Turner</strong> <strong>Construction</strong> shall be installed by <strong>Turner</strong> <strong>Construction</strong> on the<br />
temporary wall with the following wording:<br />

The subcontractor shall post danger warning signs against the hazards created by such<br />
features of construction such as protruding nails, hoists, hobs, elevator hatchways,<br />
scaffolding, window or door openings, stairways, falling materials and other such features.<br />
The area shall be barricaded with yellow barricade banner tape. Attach the barrier tape to<br />
traffic cones or delineators with barrier tape clips.<br />
All DANGER and WARNING signs installed by subcontractor shall include the <strong>Turner</strong><br />
<strong>Construction</strong> name, contact name, and telephone number.<br />
For temporary construction work, the subcontractor shall remove the temporary barricades<br />
(blocker boy) at the end of the day's work. <strong>Turner</strong> and the Owner shall have the right to<br />
establish a safe construction area with the full participation of the contractor(s).<br />
The construction work shall be enacted in a manner that will cause as little inconvenience as<br />
possible to the owner in the owner's use of the property and existing facilities and structures.<br />
When any door, doorway entrance, corridor, exit, etc. is closed or blocked by subcontractor's<br />
construction activity, the subcontractor shall furnish and install barricades/barriers as<br />
described above to safely and securely prohibit pedestrian traffic. Custom directional<br />
signage (symbols and words) as approved by <strong>Turner</strong> and the Owner shall be conspicuously<br />
posted as well.<br />
BB.<br />
TEMPORARY SIGNS<br />
Except as provided herein, no signs, billboards, posters or any type of advertising matter will<br />
be permitting on, about or adjacent to the premises, or on any structure on the premises,<br />
except by written permission from the Owner. Strictly no “graffiti” or any other marking on the<br />
new construction or existing construction will be allowed.<br />
CC.<br />
BUILDING EQUIPMENT AND SYSTEMS SHUTDOWN<br />
All shutdowns/outages of building systems and equipment shall be coordinated through<br />
<strong>Turner</strong> <strong>Construction</strong> with the Owner’s Facilities Department. A minimum of ten (10) weeks<br />
advance notice in writing (not counting weekends or holidays) is required. See<br />

shutdown notification process and required form included in the Bidders Information<br />
Package. Failure to notify does not constitute a claim for further delays.<br />
DD.<br />
INFECTION CONTROL<br />
All subcontractors, suppliers, etc. must strictly adhere to, and comply with the Infection<br />
Control Policy issued by <strong>Turner</strong> <strong>Construction</strong> and <strong>Henry</strong> <strong>Ford</strong> Health System Infection Control<br />
Committee, for the prevention of infections during construction, renovation, alterations, and<br />
maintenance work. Refer to the policy included in the Bidders Information Package.<br />
EE.<br />
ENVIRONMENTAL<br />
The subcontractor’s Scope of Work is to conform in accordance with the State,<br />
County, and <strong>West</strong> <strong>Bloomfield</strong> Township woodlands, wetlands, and environmental<br />
standards. This subcontractor will restore, replace, or repair any portion of the job<br />
fences, signage, gates, erosion controls, woodland/wetland protection systems, or<br />
existing site conditions damaged or related as a result of their work on a daily basis.<br />
All construction impacts related to the woodland and wetland areas is prohibited<br />
except for trade contractors who are performing contract work specific to the<br />
woodlands and wetlands areas.<br />
FF.<br />
SNOW REMOVAL<br />
The Subcontractor will be responsible for the removal of all snow as related to his work.<br />
Removal of snow for access to the site will be provided by the <strong>Turner</strong> <strong>Construction</strong>.<br />
GG. STREET CLEANING<br />
The Subcontractor will be responsible for street cleaning due to their associated truck<br />
deliveries leaving any soil, grease, debris, or contaminants behind on the hospital facility’s<br />
ring road, parking lots, and Maple Road. The Subcontractor is to immediately clean up the<br />
materials from road surfaces. Failure to confirm will result in <strong>Turner</strong> <strong>Construction</strong> performing<br />
the clean up services and will charge back all costs to the responsible subcontractor.<br />
2. REQUIRED MEETINGS<br />
The Subcontractor will be required to attend weekly coordination meetings, safety orientation<br />
meetings, monthly safety meetings, preconstruction meetings and any other jobsite specific<br />
meetings necessary for successful completion of the project.<br />
3. RECORD DRAWINGS<br />
Subcontractors are advised that they will be required to submit As-Built Drawings as required by the<br />
Contract Documents. The cost of these As-Builts shall be included in the Subcontractor's price.<br />
<strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>'s Project Superintendent will inspect these drawings to determine<br />
timely and accurate revisions are being made prior to the monthly billing application being<br />
processed. Please note that updated electronic CAD files are required to be submitted in<br />
accordance with the project Specifications.<br />

SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
4. SHOP DRAWINGS AND SUBMITTALS<br />
A. Where required under any particular section, product information, samples and/or shop<br />
drawings shall be promptly furnished to the Architect for design approval. Utilize the<br />
Contractor Submittal Form in Specification Section 01301.<br />
B. Subcontractor shall furnish a shop drawing schedule within fourteen (14) calendar days<br />
after award of the Contract. If any of the required submittals cannot be obtained within this<br />
time period, the Contractor shall notify <strong>Turner</strong> <strong>Construction</strong> immediately upon receiving notice<br />
of that fact.<br />
See the Submittal schedule below for the number of submittals required. For additional<br />
information, refer to the Specification Section 01300 and applicable sections for each specific<br />
work.<br />
C. The Subcontractor shall check and approve the shop drawings before submission to <strong>Turner</strong><br />
and they shall bear his/her stamp so indicating. The Contractor’s shop drawing stamp shall<br />
state that He or She has verified, or will verify, that He or She has checked and coordinated<br />
the shop drawing information submitted with the requirements of the Contract Documents.<br />
D. The review of any shop drawing by the Architect will not relieve the Subcontractor from liability<br />
for errors therein. The intent is to assist the Subcontractor in complying with the Drawings<br />
and specification, but not in any respect assume any responsibility for his noncompliance<br />
therewith.<br />
E. The Subcontractor shall be responsible for the reproduction and number of shop drawings<br />
required for distribution to his/her subcontractor(s) and for the distribution thereof.<br />
5. PARKING AND TEMPORARY ROADS<br />
<strong>Turner</strong> <strong>Construction</strong> will be responsible for automobile parking for construction personnel unless<br />
noted otherwise. <strong>Turner</strong> <strong>Construction</strong> will identify specific parking locations for construction<br />
personnel and reserves the right to change locations on the facility grounds during the duration of<br />
the project.<br />

The storage of materials and equipment at the site shall be permitted only to the extent it is<br />
approved in advance by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>. Coordination with <strong>Turner</strong>’s Superintendent<br />

SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
7. MOVING OF MATERIALS<br />
If it becomes necessary at any time during the progress of the work under the Contract to move<br />
materials or equipment which has been temporarily placed, the Subcontractor responsible for said<br />
materials or equipment shall, when directed by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>, move them or cause<br />
them to be moved at no additional cost to the project.<br />
8. CLEAN-UP<br />
Subcontractors are advised that their work areas, material storage areas, and temporary offices<br />
must be maintained daily in a safe and clean condition to the satisfaction of <strong>Turner</strong> <strong>Construction</strong><br />
<strong>Company</strong> at all times. <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> will at no time allow storage of debris or<br />
equipment outside the assigned work area of the contractor. If these work areas are not maintained<br />
properly, <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> will correct the situation at the Contractor's expense.<br />
Each Subcontractor is responsible for removal of their own debris to a dumpster provided by the<br />
Contractor unless otherwise noted in the Purchasing Requisition. This includes all packaging, crates,<br />
scrape material, and construction debris, demolished material, etc.<br />
A. Each subcontractor shall conduct operations in such a manner, which will control blowing<br />
dust. The amount of dust resulting from the contractor's operations shall be controlled to<br />
prevent the spread of dust to adjacent public and private properties and to avoid creation of a<br />
nuisance in the surrounding area. Temporary methods consisting of sprinkling or similar<br />
methods will be permitted to control dust. Use of water will not be permitted when it will result<br />
in, or create, hazardous or objectionable conditions such as ice, flooding and pollution. Dust<br />
control shall be performed as the work proceeds and whenever a dust or nuisance or hazard<br />
occurs.<br />
B. Each subcontractor and subcontractor at all times shall keep the premises free from<br />
accumulation of waste materials or rubbish caused by his operations, keep the premises<br />
clean and free from fire hazards, and maintain his work and materials stockpiles neat and<br />
orderly throughout the construction period to permit safe and convenient access and<br />
movement of workmen and materials throughout the building and site and to prevent the<br />
spread of debris. Dust or other contaminants into the air or surrounding areas at all times.<br />
C. <strong>Construction</strong> debris and rubbish as generated by the subcontractor's activity shall be<br />
removed by the contractor from the point of origin daily and not allowed to accumulate. It<br />
shall be deposited in a trash container provided by <strong>Turner</strong> (except where noted otherwise) on<br />
the site until hauled away. Scrap materials for reuse in temporary work shall be segregated<br />
and properly stored, protected and covered as for new materials. The result of the above<br />
shall be the maintenance of a clean project, in keeping with the proximity of a hospital facility<br />
and with a minimum of fire hazards. <strong>Turner</strong> and the Owner shall have the right to establish a<br />
clean-up routine with the full participation of the contractor(s).<br />
D. <strong>Construction</strong> debris removed from the upper levels of the site shall be deposited directly into<br />
a dumpster via an enclosed chute constructed and provided by the subcontractor. This<br />
subcontractor shall comply with the proper removal, segregating, and disposal of all excess<br />
materials (i.e., lumber, resteel, construction debris/trash, etc.) and concrete spoils. This<br />
project will be a LEED silver certified project and subcontractors are responsible to abide by<br />
all the LEED construction waste management procedures.<br />

SUPPLEMENTAL CONDITIONS OF THE CONTRACT<br />
E. If the subcontractor fails to keep the premises clean and orderly, to the satisfaction of <strong>Turner</strong>,<br />
<strong>Turner</strong> may, after 24 hours written notice to the contractor, cause the premises to be cleaned<br />
and organized in accordance with the owner's right to carry out the work, and the contractor<br />
will be charged for the cost of the clean-up.<br />
F. All subcontractors shall cooperate with each other and shall use reasonable diligence and<br />
shall make every effort, in connection with their work, to avoid excessive dirt, rubbish and<br />
general refuse and to minimize the extent of cleaning and removal thereof required<br />
hereunder of the contractor.<br />
G. Each subcontractor shall remove from the premises and site all tools, scaffolding, surplus<br />
materials and all temporary work and structures upon completion of the work and shall leave<br />
the work and the premises clean and acceptable to <strong>Turner</strong> and the Owner.<br />
To the greatest extents possible, all carts, buggies or containers containing debris shall be<br />
covered when leaving the construction site or the building.<br />
9. INSPECTIONS AND TESTS<br />
A. The Architect/Engineer shall at all times have access to the work wherever it is in preparation or<br />
in progress and the Subcontractor shall provide proper facilities for such access and for<br />
observation.<br />
B. Failure of the Architect/Engineer, during the progress of the work, to discover or reject materials<br />
or work not in accordance with the Contract Specifications and Drawings shall not be deemed an<br />
acceptance thereof or a waiver of defects therein. Likewise, no acceptance or waiver shall be<br />
inferred or implied due to payments made to Subcontractor or by partial or entire occupancy of<br />
the work, or installation of materials, which are not strictly in accordance with the Contract<br />
Specifications and Drawings.<br />
C. If any inspections or tests reveal that the workmanship or materials used by the Subcontractor<br />
are not in conformity with the Drawings, Specifications, and/or approved shop drawings, the<br />
Subcontractor shall pay for all re-tests and shall remove all work and materials so failing to<br />
conform and replace with work and materials, which are in full conformity.<br />
10. TEMPORARY FACILITIES<br />
A. OFFICES<br />
Each Subcontractor shall provide his/her own space for his/her use, complete with power,<br />
heat, light, telephone & data lines, fire extinguishers, etc. as required. All expenses in<br />
connection with this office, metering, fees, etc. shall be paid by the using Subcontractor,<br />
unless indicated otherwise in these documents.<br />
A complete set of Drawings/Specifications, As-Built documents with up to date revisions, and<br />
all permits and shop drawings shall be maintained in each trade contractor and/or<br />
subcontractor’s temporary office.<br />
No shanties or temporary job offices will be allowed in or outside the area without prior<br />
approval of <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>'s Job Superintendent. All shanties installed by the<br />
Subcontractor, or his/her Subcontractor(s), ten feet (10') or less from a building shall be<br />
constructed of fireproof lumber, steel, masonry or other approved incombustible materials,<br />

including wire glass. If valuable material or extraordinary fire hazards are present, shanties<br />
installed more than ten feet (10') from buildings, shall also be fireproof.<br />
Shanties or temporary job offices shall be maintained by the using Subcontractor and<br />
removed by the using contractor, subject to <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>’s approval.<br />
Each Subcontractor will be responsible to leave the trailer storage and material storage in the<br />
original condition. Any damage will be the subcontractor’s responsibility<br />
B. TOILETS<br />
Temporary toilets are to be furnished and maintained by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>.<br />
C. TELEPHONE AND FAX MACHINE<br />
1. The Subcontractor shall provide telephones, as required, in their temporary offices for<br />
their own use during the progress of the work. Telephones shall remain until<br />
completion of the work under this Contract.<br />
2. Any costs associated with the installation, usage charges and removal shall be paid by<br />
the subcontractor.<br />
D. POWER<br />
1. The Subcontractor will be responsible to make arrangements for power needed to their<br />
temporary offices.<br />
2. Any costs associated with the installation, usage charges and removal shall be paid by<br />
the Subcontractor.<br />
3. Subcontractors and their subcontractors requiring 120 VAC localizing lighting and<br />
single phase power shall furnish their own extension cords and lamps.<br />
4. Subcontractors and their subcontractors shall be allowed to use the service provided<br />
for general temporary lighting and fractional horsepower hand tools at no cost to them.<br />
5. Subcontractors and their subcontractors shall compensate the electrical subcontractor<br />
for wiring of construction equipment requiring circuits larger than 120 VAC, 20 amps<br />
single phase. Such arrangements shall be coordinated in advance with the electrical<br />
subcontractor.<br />
6. Subcontractors and their subcontractors requiring lighting or other electrical service<br />
outside of the building shall pay for the installation and removal of service and<br />
maintenance charges (i.e. jobsite trailer).<br />
7. Subcontractors and their subcontractors requiring service for construction equipment<br />
and testing in access of the capacity of the temporary construction service shall make<br />
separate arrangements at their own expense.<br />
E. WATER<br />
The Subcontractor will furnish all temporary water unless otherwise noted, inclusive of any job<br />
office trailers.<br />

F. EATING AREAS<br />
The Subcontractor shall, subject to the approval of <strong>Turner</strong> <strong>Construction</strong>, designate areas for<br />
eating, provide adequate receptacles, and maintain the area in a sanitary condition free of<br />
rodents and pests. Remnants of food shall not be allowed to spread beyond the trash<br />
receptacles in the designated eating areas. The trash receptacles for the designated eating<br />
areas shall be emptied at least once each workday.<br />
11. PAYMENT PROCESS:<br />
A. BILLING BREAKDOWN<br />
The Subcontractor shall provide <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>, within fifteen (15) days after<br />
release, a complete detailed Schedule of Values in such a fashion as required by <strong>Turner</strong><br />
<strong>Construction</strong> <strong>Company</strong> for the cost of material, labor and equipment of each level or section<br />
of the project. At a minimum, the Schedule of Values should contain the following line items:<br />
Mobilization, Demobilization, Safety and Clean Up, Engineering and Submittals, LEED<br />
Participation, EEO/MBE Participation, and Closeout and Punchlist. Also, include breakdown<br />
for items such as General Conditions, Engineering, Submittals, Warranties, Guarantees, As-<br />
Builts, Closeout Documents, safety, and cleanup.<br />
B. BILLING PROCEDURE<br />
1. Bidders are advised that billings for this project will be on a monthly basis (from the 16 th<br />
day of the previous month to the 15th day of the current month). The subcontractor<br />
shall submit a pencil copy of its Application for Payment to the Project Superintendent<br />
by the 1st of the month for review and comment, and submit a hard copy by the 5th of<br />
the month (including projections through the last day of the month). The Subcontractor<br />
can expect payment only after <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> receives payment from<br />
the Owner (<strong>Turner</strong> anticipates a 60 day payment cycle). A retainage of 10% will be<br />
held until substantial completion, then 5% retainage will be held until all punchlist and<br />
closeout is complete.<br />
2. The form of Application for Payment shall be AIA Document G-702, Application and<br />
Certification for Payment. An up to date Status of <strong>Construction</strong>, and material delivery<br />
schedule must accompany the progress payment application. It will also be necessary<br />
to submit a Sworn Statement and Unconditional Partial Waiver of Lien with each<br />
application.<br />
3. In the event that changes are required during the progress of the work, changes will be<br />
based on the mutually agreed to price between <strong>Turner</strong> and the Subcontractor.<br />
4. For subcontract work, Subcontractor’s markup for handling, overhead, profit and<br />
bonding on Subcontractor’s sell price, shall not exceed 5%.<br />
5. For work by his or her own organization, Subcontractor’s markup for job and general<br />
overhead, profit and bonding shall not exceed 10% of the net labor and material<br />
costs.<br />
6. Before final payment is made, the Subcontractor shall submit As-Built Plans,<br />
Operating and Maintenance Manuals, Guarantees, and Final Lien Waivers for the<br />
total amount of the Contract.<br />

C. MONTHLY BILLING<br />
This subcontractor must submit an application on AIA form for all work performed each and<br />
every month to our Superintendent. Any work performed and not billed for any given month of<br />
the payment cycle will result in <strong>Turner</strong> <strong>Construction</strong> determining the amount of work<br />
performed. Five percent (5%) of that monthly billable amount will be permanently deducted<br />
from the subcontractor’s contract amount for his failure to submit a monthly application for<br />
payment.<br />
D. PAYMENT FOR STORED MATERIAL<br />
<strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> will consider payment for purchased materials that are stored<br />
off site provided the following stipulations are met:<br />
1. Subcontractor shall provide a detailed listing of the materials along with proof of<br />
purchase and payment.<br />
2. Subcontractor shall provide proof that materials are stored in acceptable locations<br />
that will prevent any deterioration from weather, storage configuration, sun, or any<br />
other elements that might affect the quality of the products.<br />
3. Subcontractor shall provide to <strong>Turner</strong> <strong>Construction</strong> a certificate of insurance covering<br />
the full value of the material against damage, theft, or other hazards.<br />
4. Payment shall not constitute acceptance or ownership of the materials by <strong>Turner</strong><br />
<strong>Construction</strong> or the Owner.<br />
5. The storage location shall be open to inspection to <strong>Turner</strong> <strong>Construction</strong>.<br />
6. <strong>Turner</strong> <strong>Construction</strong> and <strong>Henry</strong> <strong>Ford</strong> Health System will not pay for off-site storage of<br />
any raw materials or unassembled materials.<br />
12. DAILY CONSTRUCTION REPORTS<br />
A. The Subcontractor will be required to provide complete, detailed and accurate written<br />
construction reports daily, stating the manpower, trades, weather, description of work, etc., as<br />
required by <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong>'s Project Superintendent. Failure to provide Daily<br />
<strong>Construction</strong> Reports as requested will result in delays of Progress Payment approval.<br />
B. The Subcontractor must notify <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> of any unusual circumstance<br />
upon discovery, before commencing work. If unusual conditions, etc., which cause additional<br />
expense to the Subcontractor are not reported to and authorized by <strong>Turner</strong> <strong>Construction</strong><br />
<strong>Company</strong>, no extra compensation will be approved.<br />
13. LAYOUT<br />
This Subcontractor is to include all necessary control lines in order to layout their portion of the<br />
work. <strong>Turner</strong> will provide the property line and main building benchmark only.<br />

14. ACCEPTANCE OF PRIOR WORK BY OTHERS<br />
The Subcontractor is required to review work completed by others that is contiguous or related to<br />
his/her work and notify <strong>Turner</strong> <strong>Construction</strong> <strong>Company</strong> in writing of any unacceptable work. Failure<br />
to do so and start of Contract work constitutes acceptance of the work by others.<br />
15. PROTECTION OF COMPLETED WORK<br />
The Subcontractor is required at the completion of his work to provide protection for his work<br />
against damage or theft, to the largest extent possible. Failure to do so will result in the<br />
Subcontractor having to replace or repair the damaged work at no additional cost to the project.<br />
16. WORK AREA<br />
A. Work, which will interfere with the existing businesses/buildings, including interruptions to any<br />
utilities, mechanical, and electrical services, road and traffic blocking, and noisy operations (such<br />
as jack hammering) shall be scheduled in advance.<br />
B. The construction trades will not be permitted to use toilet rooms or any other facilities in any<br />
adjacent existing buildings during the course of construction. The only time the Subcontractor<br />
will be allowed near adjacent buildings is for preliminary inspections, construction layout, or to<br />
actually perform the Scope of Work which the Owner contracted for.<br />
C. In accordance with State, Federal, and Local Rules and Regulations, there will be no smoking<br />
allowed inside the new and existing facility in accordance with Local and State Regulations.<br />
17. WARRANTIES AND GUARANTEES<br />
A. WARRANTY<br />
1. The subcontractor, and their subcontractors, as to their portion of the work under the<br />
general Contract, warrants to the Owner and/or his assignees that all work performed<br />
and materials furnished shall be in complete accordance with the Plans and<br />
Specifications.<br />
2. This Warranty is in addition to, and not in place of, any and all other warranties and<br />
guarantees provided for hereunder.<br />
B. GUARANTEES<br />
1. The Subcontractor shall guarantee all work executed under this Contract, both as to<br />
material and workmanship, for a period of one (1) Year after the date of the Certificate<br />
of Substantial Completion, unless otherwise specifically provided for in the Contract<br />
Plans and Specifications, or as provided by law. He or she shall replace with new<br />
materials, including the installation thereof, any or all, defective material, or faulty<br />
workmanship so found defective or faulty during such time. Any replacing or repairing<br />
shall be done promptly and at no additional cost to the Owner and at such time as will<br />
occasion the least inconvenience to Owner.<br />
2. The guarantee period herein stated shall in no way limit or modify longer guarantee<br />
periods whether such guarantee periods are imposed or implied by law or normally<br />
given by manufactures on their products, equipment, or as specified and any such<br />

guarantee imposed or implied by law or such manufacturer's guarantee shall be in<br />
addition to Subcontractor's guarantee.<br />
3. In the event the Owner shall occupy and use a portion of the building prior to the<br />
issuance of the Certificate of Substantial Completion, as noted above, the guarantee<br />
period as to occupied portions only shall begin on the date all work is completed and<br />
equipment is operating in the occupied portion.<br />
