5.B.1. a. (1) Violations committed by <strong>Coast</strong> <strong>Guard</strong> units. Submit the<br />

original copy of CG2861A to the violating unit, a copy<br />

to the violating unit's Area and District Commander,<br />

a copy to the reporting unit's District Commander and<br />

retain a copy for file.<br />

(2) Violations committed by other military services,<br />

federal government agencies or foreign administrations.<br />

Submit the original to the Commandant (G-TIM), a copy<br />

to the reporting unit's Area and District Commander<br />

and retain a copy for file.<br />

(3) Violations committed by <strong>US</strong> non-federal government<br />

stations. It is the Commandant's policy that District<br />

Commanders make local working agreements with FCC<br />

Regional Directors to resolve marine radio problems and<br />

abuses at the local level whenever possible. (See<br />

"Agreement Between Federal Communication Commission<br />

and United States <strong>Coast</strong> <strong>Guard</strong> Relating to Marine Radio<br />

Problems", May 1983, contained in Enclosure 5-1).<br />

Violation reports should be submitted in accordance<br />

with local arrangements between the cognizant <strong>Coast</strong><br />

<strong>Guard</strong> District Commander and FCC Regional Director as<br />

appropriate. Copies of violations issued under these<br />

arrangements shall be forwarded to the Commandant<br />

(G-TTM) for information. In the absence of local<br />

arrangements, radio violation reports involving<br />

non-federal government stations shall be submitted to<br />

the Commandant (G-TTM) for referral to the FCC for<br />

action.<br />

(4) Violation reports shall be submitted for all cases<br />

of false activations of EPIRB's, as a hoax, through<br />

gross negligence, carelessness or improper storage and<br />

handling in cases where the person or vessel committing<br />

the violation can be identified.<br />
