STATEMENT OF FACTS<br />
1) Jungo Land & Investments, Inc. ("Jungo") requested a five (5) year extension <strong>of</strong> the<br />
Conditional Use Permit (CUP), # UH-07-05, which was issued to Jungo Land & Investments,<br />
Inc. ("Jungo") by the Regional Planning Commission (<strong>RPC</strong>) on or about April 12, 2007. On<br />
February 11, 2010 the <strong>RPC</strong> granted Jungo a five (5) year extension <strong>of</strong> the CUP.<br />
2) Jungo argued that good cause exists for granting the extension due in substantial part<br />
because <strong>of</strong> citizen opposition to the landfill, lawsuits, political pressure from elected <strong>of</strong>ficials,<br />
and a slow regulatory permitting process. Jungo argued (unfortunately successfully) that it has<br />
been "prevented from timely obtaining the permits it needs to satisfu the condition <strong>of</strong> the CUP<br />
and to commence operation <strong>of</strong> the Jungo Landfill." Prevented! (Page 4 <strong>of</strong> January 19th, 2010<br />
letter <strong>of</strong> Frankovich, attached hereto and marked "Exhibit A").<br />
3) Appellants and other citizens requested that the <strong>RPC</strong> either deny the request <strong>of</strong><br />
Jungo, or grant the extension on condition that Jungo perform an environmental report or<br />
"environmental impact statement" or the like. The <strong>RPC</strong> granted the extension without any<br />
conditions. The <strong>RPC</strong> also granted the extension as Jungo stonewalled inquiry by a member <strong>of</strong><br />
the <strong>RPC</strong> about the water rights to be acquired by Jungo for the project.<br />
4) Among other open and unanswered questions by the <strong>RPC</strong>, Jim French, a former<br />
employee with the State <strong>of</strong> Nevada, reminded the <strong>RPC</strong> that no agency <strong>of</strong> State or local<br />
govemment has yet to analyze the impact the landfrll would have on wildlife in the area <strong>of</strong> the<br />
landfill.<br />
5) Ron Johnny, a member <strong>of</strong> the Summit Lake Paiute Indian Tribe, who is the Director<br />
<strong>of</strong> the Environmental Protection Department <strong>of</strong> the Summit Lake Paiute Tribe, argued that the<br />
landfrll would prevent and/or substantially interfere with Northern Paiute's ability to use the

land for the purpose <strong>of</strong> hunting, gathering, or conducting spiritual ceremonies at the site as<br />
guaranteed pursuant to treaty with the United States government and numerous federal laws and<br />
legal case decisions. (See, a letter dated February 10, 2010, from the Summit Lake Paiute Tribe,<br />
attached hereto and marked "Exhibit B").<br />
6) After hearing the aforesaid public comments, and review <strong>of</strong> the request for extension<br />
the aforesaid <strong>RPC</strong> voted on and approved the by a 5-2 vote. A copy <strong>of</strong> the action is attached<br />
hereto as exhibit "C". Members <strong>of</strong> the <strong>RPC</strong> seemed to conclude that lawsuits, per se, involving<br />
Jungo constituted "good cause". Further, members <strong>of</strong> the <strong>RPC</strong> also concluded that as part <strong>of</strong> the<br />
decision before the board the <strong>RPC</strong> was without power and/or ability (pursuant to an unidentified<br />
law or rule) to impose conditions and/or further requirements upon the extension <strong>of</strong> the CUP.<br />
7) That the appellants are citizens and residents <strong>of</strong> <strong>Humboldt</strong> <strong>County</strong>, State <strong>of</strong> Nevada,<br />
and use and have used the land abutting the land subject to the CUP herein, and appeared at the<br />
aforesaid hearing and objected to the unconditioned extension request. The planned landfill on<br />
Jungo will adversely affect the air, water, and peace and contentment <strong>of</strong> the appellants as they<br />
use said abutting land, and are aggrieved and interested persons by the issuance <strong>of</strong> the CUP, and<br />
by the vote, decision and findings <strong>of</strong> the <strong>RPC</strong> on February 11th, 2010. The appellants are<br />
interested persons in the instant matter, and are proper parties to appeal the February 1lth, 2010<br />
vote, decision, and finding <strong>of</strong> the <strong>RPC</strong>.<br />
POINTS AND AUTHORITIES<br />
8) The policy <strong>of</strong> the State <strong>of</strong> Nevada is found in NRS 444.440 and it is as follows:<br />
It is hereby declared to be the policy <strong>of</strong> this State to regulate the collection and<br />
disposal <strong>of</strong> solid waste in a manner that will:<br />
1. Protect public health and welfare.<br />
2. Prevent water or air pollution.<br />
3. Prevent the spread <strong>of</strong>disease and the creation <strong>of</strong>nuisances.

The <strong>RPC</strong> violated the above referenced statute and policy <strong>of</strong> the State <strong>of</strong> Nevada by a<br />
through its vote, decision and findings on February 1 lft, 2010 by failing to deny the extension<br />
the CUP, or in the alternative, by failing to grant Appellants and other citizens request that Jung<br />
conduct, perform, and/or submit to an environmental review andlor environmental impact<br />
or the like.<br />
9) The <strong>RPC</strong> abused its discretion and acted arbitrarily and capriciously in extending the<br />
CUP, and were clearly erroneous in its finding that good cause existed for the extension. Said<br />
<strong>RPC</strong> granted the extension while completely failing to impose any conditions on the extension to<br />
protect the health, safety and welfare <strong>of</strong> the citizens <strong>of</strong> <strong>Humboldt</strong> <strong>County</strong>, Pershing <strong>County</strong> and<br />
other citizens <strong>of</strong> the State and/or visitors to the public land abutting the landfill site, and this was<br />
an abuse <strong>of</strong>discretion.<br />
10) It was not proper and violative <strong>of</strong> public policy <strong>of</strong> the State <strong>of</strong> Nevada when the<br />
<strong>RPC</strong> agreed with Jungo that good cause existed, to any extent, based on the existence <strong>of</strong> a<br />
pending meritorious lawsuit involving Jungo. It also was clearly eroneous by implicitly finding<br />
that Jungo was "prevented" from timely obtaining the permits it needs from the State, and<br />
otherwise "prevented" by lawful forces from commencing operations. Jungo just did not commi<br />
sufficient resources or effort to the project. How the failures <strong>of</strong> Jungo becomes "good cause" in<br />
the minds <strong>of</strong> the members <strong>of</strong> the <strong>RPC</strong> who voted to grant a five year extension without any new<br />
conditions is absurd. and an abuse <strong>of</strong> discretion.<br />
11) It was not proper and violative <strong>of</strong> public policy <strong>of</strong> the State <strong>of</strong> Nevada when the<br />
<strong>RPC</strong> agreed with Jungo that good cause existed, to any extent, based on protected political<br />
actions and expression by appellants and other citizens and elected <strong>of</strong>ficials.

12) It was not proper and violative <strong>of</strong> public policy <strong>of</strong> the State <strong>of</strong> Nevada when the<br />
<strong>RPC</strong> agreed with Jungo that good cause existed, to any extent, based on the failure <strong>of</strong> Jungo to<br />
designate and spend sufficient money or assets to timely and effective proceed through the State<br />
<strong>of</strong> Nevada regulatory process.<br />
13) The <strong>RPC</strong> abused its discretion when it effectively made the citizens <strong>of</strong> <strong>Humboldt</strong><br />
<strong>County</strong> the guarantors <strong>of</strong> its CUP by prejudicing and damaging the appellants and citizens for<br />
having exercised their fundamental rights as United States citizens and their First Amendment<br />
rights. Indeed, at least one member <strong>of</strong> the <strong>RPC</strong> essentially stated that <strong>of</strong> course lawsuits<br />
constitute good cause for an extension. The blanket failure <strong>of</strong> the <strong>RPC</strong> during its deliberation<br />
and vote to be able to discriminate and/or discern a difference between meritorious lawsuits and<br />
frivolous lawsuits in its deliberation is breathtaking!<br />
14) The <strong>RPC</strong> engaged in egregious procedure by accepting as true all or most <strong>of</strong> the<br />
representations <strong>of</strong> Jungo in its request for the extension, without question and/or without proper<br />
investigation to confirm the truth or propriety <strong>of</strong> said representations, and by failing to impose<br />
reasonable conditions to protect the health, safety and welfare <strong>of</strong> the appellants and the other<br />
citizens who use the abutting land <strong>of</strong> the landfill site. Essentially, the <strong>RPC</strong> made said vote,<br />
decision, and findings without meaningful and reasonably complete information.<br />
WHEREFORE it is respectfully submitted by the undersigned that good cause exists for<br />
the <strong>Humboldt</strong> <strong>County</strong> Commission to review and reverse the above referenced decision, vote and<br />
finding <strong>of</strong> the <strong>RPC</strong> <strong>of</strong> February 11'h, 2010.

Dear Members <strong>of</strong> the <strong>Humboldt</strong> <strong>County</strong> Planning Commission:<br />
The Summit Lake Paiute Council (Counci$, governing body <strong>of</strong> the federally recognized Summit Lake<br />
Paiute Tribe <strong>of</strong> Nevada (see Vol. 73, No. 66 Federal Register 18553, 18556 (Friday, April 4, 2OO8)),<br />
hereby advises that the Council opposes not only the request to extend Conditional Use Permit UH-07-<br />
05 {CUP) for any period <strong>of</strong> time but had it been consulted since the proposed project is within its<br />
traditional use territory it would have opposed the initial issuance <strong>of</strong> the CUP.<br />
The Council opposes the extension <strong>of</strong> the CUP because such a use would render the land unusable for<br />
any Northern Paiute, not just Summit Lake tribal members, that wanted to hunt, gather or conduct<br />
spiritual ceremonies there.<br />
Th€ Constitution <strong>of</strong> the Summit Lake Paiute Tribe (Tribe), approved by the federal government on<br />
January 8, 1965. authorizes the Council to veto any encumbrance <strong>of</strong> tribal landt interests in lands or<br />
other tribal assets, and to take such actions as are necessary to carry into effect any <strong>of</strong> the Council's<br />
powers (see Article ll, Summit lake Paiute Tribe Articles <strong>of</strong> Associatioq Section 1(e), (k))-<br />
Under numeror.rs federal laws, because the traditional use territory <strong>of</strong> Tribe is subject to a final order <strong>of</strong><br />
the f ndian Claims Commission, and the only cause <strong>of</strong> action in Northem Paiute Notion et ol. v. lJnited States<br />
<strong>of</strong> America, T Ind. Cl. Comm. 322,387-82,427a-b,615, 618a-b, et al. {1959), was the taking <strong>of</strong> the Tribe's<br />
land in violation <strong>of</strong> the U.S. Constitution, tribal members retain the right, at all usual and accustomed<br />
places, whether now called public or private land, to hung fish, gather traditional foods and medicine<br />
and resources, and practice spiritual ceremonies. See e.g., stdte v. Tinno, 497 P.2d 1386 (tdaho, 1972)<br />
(conviction <strong>of</strong> tribal member who speared salmon not in compliance with state law reversed).<br />
Numerous unreported decisions <strong>of</strong> the local state District Court have upheld the right <strong>of</strong> Northern<br />
Paiute tribe members to hunt, etc., within their traditional use territory areas when prosecuted by a<br />
Nevada Department <strong>of</strong> Wildlife citation.<br />
Thus it is not only the Summit Lake Reservation that constitutes Indian Country.<br />

Moreover state law declares that it lacks jurisdiction in Indian Country absent the consent <strong>of</strong> the<br />
governing body <strong>of</strong> the Tribe. See N.R.S. 41.430(4). The Summit Lake Paiute Council has never consented<br />
to Nevadaorone <strong>of</strong> its politicalsubdivisions {i.e., <strong>Humboldt</strong><strong>County</strong>) exercising jurisdiction in its lndian<br />
Country. Since Nevada retroceeded all <strong>of</strong> its limited civil and complete criminal (optional Public Law<br />
280) jurisdiction in lndian Country, no Tribe's governing body in <strong>Humboldt</strong> C-ounty has consented to<br />
state jurisdiction in accordance with N.R.S. 41.430.<br />

This Conditional Use Permit application was approved by the Regional Planning Commission April<br />
12,2007. Per <strong>Humboldt</strong> <strong>County</strong> Code 517.58.090, exrension reguests are alle'vlsd for good cause.<br />
The Regional Plannin g Department is recommneding that the Regional Planning Commisison find<br />
that Jungo Land has shown good cause due to facts contained in Table l, on pages 1-3, <strong>of</strong> the letter<br />
daied January L9,2010 (|IDEP Air Quality Permittrng Process; Waste l,{anagement Permitting<br />
Process; and Stormwater Permitring Process). fn adfitionr good casue is shown due to the facts<br />
contained on page 2o paragraph 3 <strong>of</strong> tle January 19, 2010 letter regarding permitting activities with<br />
the Union Pacific Railroad. Staff recommends approval <strong>of</strong> this request for a five-year extension.<br />
