STATEMENT OF FACTS
1) Jungo Land & Investments, Inc. ("Jungo") requested a five (5) year extension of the
Conditional Use Permit (CUP), # UH-07-05, which was issued to Jungo Land & Investments,
Inc. ("Jungo") by the Regional Planning Commission (RPC) on or about April 12, 2007. On
February 11, 2010 the RPC granted Jungo a five (5) year extension of the CUP.
2) Jungo argued that good cause exists for granting the extension due in substantial part
because of citizen opposition to the landfill, lawsuits, political pressure from elected officials,
and a slow regulatory permitting process. Jungo argued (unfortunately successfully) that it has
been "prevented from timely obtaining the permits it needs to satisfu the condition of the CUP
and to commence operation of the Jungo Landfill." Prevented! (Page 4 of January 19th, 2010
letter of Frankovich, attached hereto and marked "Exhibit A").
3) Appellants and other citizens requested that the RPC either deny the request of
Jungo, or grant the extension on condition that Jungo perform an environmental report or
"environmental impact statement" or the like. The RPC granted the extension without any
conditions. The RPC also granted the extension as Jungo stonewalled inquiry by a member of
the RPC about the water rights to be acquired by Jungo for the project.
4) Among other open and unanswered questions by the RPC, Jim French, a former
employee with the State of Nevada, reminded the RPC that no agency of State or local
govemment has yet to analyze the impact the landfrll would have on wildlife in the area of the
landfill.
5) Ron Johnny, a member of the Summit Lake Paiute Indian Tribe, who is the Director
of the Environmental Protection Department of the Summit Lake Paiute Tribe, argued that the
landfrll would prevent and/or substantially interfere with Northern Paiute's ability to use the

land for the purpose of hunting, gathering, or conducting spiritual ceremonies at the site as
guaranteed pursuant to treaty with the United States government and numerous federal laws and
legal case decisions. (See, a letter dated February 10, 2010, from the Summit Lake Paiute Tribe,
attached hereto and marked "Exhibit B").
6) After hearing the aforesaid public comments, and review of the request for extension
the aforesaid RPC voted on and approved the by a 5-2 vote. A copy of the action is attached
hereto as exhibit "C". Members of the RPC seemed to conclude that lawsuits, per se, involving
Jungo constituted "good cause". Further, members of the RPC also concluded that as part of the
decision before the board the RPC was without power and/or ability (pursuant to an unidentified
law or rule) to impose conditions and/or further requirements upon the extension of the CUP.
7) That the appellants are citizens and residents of Humboldt County, State of Nevada,
and use and have used the land abutting the land subject to the CUP herein, and appeared at the
aforesaid hearing and objected to the unconditioned extension request. The planned landfill on
Jungo will adversely affect the air, water, and peace and contentment of the appellants as they
use said abutting land, and are aggrieved and interested persons by the issuance of the CUP, and
by the vote, decision and findings of the RPC on February 11th, 2010. The appellants are
interested persons in the instant matter, and are proper parties to appeal the February 1lth, 2010
vote, decision, and finding of the RPC.
POINTS AND AUTHORITIES
8) The policy of the State of Nevada is found in NRS 444.440 and it is as follows:
It is hereby declared to be the policy of this State to regulate the collection and
disposal of solid waste in a manner that will:
1. Protect public health and welfare.
2. Prevent water or air pollution.
3. Prevent the spread ofdisease and the creation ofnuisances.

28
4. Conserve natural resources.
5. Enhance the beauty and quality of the environment.
The RPC violated the above referenced statute and policy of the State of Nevada by a
through its vote, decision and findings on February 1 lft, 2010 by failing to deny the extension
the CUP, or in the alternative, by failing to grant Appellants and other citizens request that Jung
conduct, perform, and/or submit to an environmental review andlor environmental impact
or the like.
9) The RPC abused its discretion and acted arbitrarily and capriciously in extending the
CUP, and were clearly erroneous in its finding that good cause existed for the extension. Said
RPC granted the extension while completely failing to impose any conditions on the extension to
protect the health, safety and welfare of the citizens of Humboldt County, Pershing County and
other citizens of the State and/or visitors to the public land abutting the landfill site, and this was
an abuse ofdiscretion.
10) It was not proper and violative of public policy of the State of Nevada when the
RPC agreed with Jungo that good cause existed, to any extent, based on the existence of a
pending meritorious lawsuit involving Jungo. It also was clearly eroneous by implicitly finding
that Jungo was "prevented" from timely obtaining the permits it needs from the State, and
otherwise "prevented" by lawful forces from commencing operations. Jungo just did not commi
sufficient resources or effort to the project. How the failures of Jungo becomes "good cause" in
the minds of the members of the RPC who voted to grant a five year extension without any new
conditions is absurd. and an abuse of discretion.
11) It was not proper and violative of public policy of the State of Nevada when the
RPC agreed with Jungo that good cause existed, to any extent, based on protected political
actions and expression by appellants and other citizens and elected officials.

12) It was not proper and violative of public policy of the State of Nevada when the
RPC agreed with Jungo that good cause existed, to any extent, based on the failure of Jungo to
designate and spend sufficient money or assets to timely and effective proceed through the State
of Nevada regulatory process.
13) The RPC abused its discretion when it effectively made the citizens of Humboldt
County the guarantors of its CUP by prejudicing and damaging the appellants and citizens for
having exercised their fundamental rights as United States citizens and their First Amendment
rights. Indeed, at least one member of the RPC essentially stated that of course lawsuits
constitute good cause for an extension. The blanket failure of the RPC during its deliberation
and vote to be able to discriminate and/or discern a difference between meritorious lawsuits and
frivolous lawsuits in its deliberation is breathtaking!
14) The RPC engaged in egregious procedure by accepting as true all or most of the
representations of Jungo in its request for the extension, without question and/or without proper
investigation to confirm the truth or propriety of said representations, and by failing to impose
reasonable conditions to protect the health, safety and welfare of the appellants and the other
citizens who use the abutting land of the landfill site. Essentially, the RPC made said vote,
decision, and findings without meaningful and reasonably complete information.
WHEREFORE it is respectfully submitted by the undersigned that good cause exists for
the Humboldt County Commission to review and reverse the above referenced decision, vote and
finding of the RPC of February 11'h, 2010.

Re: Jungo Land and Investments, Inc., Conditional Use Permit UH-07{5
Dear Members of the Humboldt County Planning Commission:
The Summit Lake Paiute Council (Counci$, governing body of the federally recognized Summit Lake
Paiute Tribe of Nevada (see Vol. 73, No. 66 Federal Register 18553, 18556 (Friday, April 4, 2OO8)),
hereby advises that the Council opposes not only the request to extend Conditional Use Permit UH-07-
05 {CUP) for any period of time but had it been consulted since the proposed project is within its
traditional use territory it would have opposed the initial issuance of the CUP.
The Council opposes the extension of the CUP because such a use would render the land unusable for
any Northern Paiute, not just Summit Lake tribal members, that wanted to hunt, gather or conduct
spiritual ceremonies there.
Th€ Constitution of the Summit Lake Paiute Tribe (Tribe), approved by the federal government on
January 8, 1965. authorizes the Council to veto any encumbrance of tribal landt interests in lands or
other tribal assets, and to take such actions as are necessary to carry into effect any of the Council's
powers (see Article ll, Summit lake Paiute Tribe Articles of Associatioq Section 1(e), (k))-
Under numeror.rs federal laws, because the traditional use territory of Tribe is subject to a final order of
the f ndian Claims Commission, and the only cause of action in Northem Paiute Notion et ol. v. lJnited States
of America, T Ind. Cl. Comm. 322,387-82,427a-b,615, 618a-b, et al. {1959), was the taking of the Tribe's
land in violation of the U.S. Constitution, tribal members retain the right, at all usual and accustomed
places, whether now called public or private land, to hung fish, gather traditional foods and medicine
and resources, and practice spiritual ceremonies. See e.g., stdte v. Tinno, 497 P.2d 1386 (tdaho, 1972)
(conviction of tribal member who speared salmon not in compliance with state law reversed).
Numerous unreported decisions of the local state District Court have upheld the right of Northern
Paiute tribe members to hunt, etc., within their traditional use territory areas when prosecuted by a
Nevada Department of Wildlife citation.
Thus it is not only the Summit Lake Reservation that constitutes Indian Country.
Moreover state law declares that it lacks jurisdiction in Indian Country absent the consent of the
governing body of the Tribe. See N.R.S. 41.430(4). The Summit Lake Paiute Council has never consented
to Nevadaorone of its politicalsubdivisions {i.e., HumboldtCounty) exercising jurisdiction in its lndian
Country. Since Nevada retroceeded all of its limited civil and complete criminal (optional Public Law
280) jurisdiction in lndian Country, no Tribe's governing body in Humboldt C-ounty has consented to
state jurisdiction in accordance with N.R.S. 41.430.
I appreciate being afforded the opportunity to communicate.
