JumpStart provides day one powertrain coverage for 3 months/3000 miles. What makes JumpStart unique is it’s designed<br />

as a Vehicle Service Contract, not a limited warranty, taking the legal liability away from the dealer! And best of all, the seller<br />

receives 100% of all unused insurance reserves, making this one of the most financially viable programs available!<br />

JumpStart has optional coverage for seals and gaskets and an increased limit of liability. Deductibles are offered at an affordable<br />

$250 (standard) and $100 (optional). The program is available on vehicles 20 model years or newer <strong>with</strong> odometer mileage at<br />

the time of sale less than 200,000.<br />

CruiseControl program is the answer! Matrix Method’s CruiseControl product is an affordable, yet strong entry-level Vehicle<br />

Service Contract. The program features exceptional powertrain coverage at a great value.<br />

CruiseControl covers the vehicle’s powertrain and has optional coverage for the air conditioning, electrical, first day coverage,<br />

and seals and gaskets. Deductibles are offered at $250 (standard) and $100 (optional), as well as a $250 disappearing<br />

(optional). The program is available on vehicles 20 model years old and newer <strong>with</strong> less than 200,000 miles at the time of<br />

sale. A range of terms are available starting <strong>with</strong> 12 months/25,000 miles and going up to 60 months/100,000 miles from<br />

multiple coverage levels determined by the vehicle’s mileage at the time of the breakdown. Coverages vary from lower vehicle<br />

mileage exclusionary manufacturer-level coverage to engine only coverage. Regardless of the vehicle’s mileage, GoMonthly<br />

coverages will never expire as long your customer owns the vehicle and continues making the monthly payments. GoMonthly<br />

breakdown or the gradual reduction in performance due to normal wear and tear, when the wear exceeds the manufacture’s specifications.<br />

connecting rods and rod bearings; camshaft and camshaft bearings; eccentric shaft; oil pump; push rods; rocker arms; rocker arm<br />

Vehicle Eligibility:<br />

To be eligible for coverage the vehicle must be listed as an eligible vehicle in the Vehicle Eligibility Guide. All trucks or vans are limited to a<br />

gross carrying weight of one ton (15,000 lbs GVW).<br />

Plan Qualification:<br />

January 1st shall be the model year change for determining eligibility. The vehicle must be 20 model years or newer and have less than<br />

200,000 miles on the odometer at the time of sale.<br />

Plan Term:<br />

Coverage starts on the contract effective date and expires at the earliest of: 3 months from the contract effective date or when the vehicle<br />

accumulates a total of 3,000 miles starting from the odometer reading on contract’s effective date.<br />

MANDATORY SURCHARGE:<br />

a. European Vehicles<br />

snow plowing or used for hire to the public or used to transport people for hire; municipal or professional emergency or police services;<br />

to tow a trailer whose weight exceeds the manufacturer’s recommendations, rental, limousine, shuttle, towing/wrecker service, lifting or<br />

hoisting, dumping (dump beds), cherry pickers<br />

b. Vehicles altered or modified in a fashion not recommended by the manufacturer, including installation of high performance equipment,<br />

lift or lowering kits, incorrect tires/wheels or removal of any emission devices<br />

c. Vehicles that are Kits Cars; High Performance, Exotic or Special Purpose, Engines Over 8 Cylinders, Alternative Fuel (Natural Gas, LP<br />

Gas, Propane), Modified Diesel<br />

d. Vehicles <strong>with</strong> odometers that are broken and/or the correct mileage cannot be determined and verified by the program administrator<br />

e. Vehicles that are “Grey” market, have been declared a total loss, salvaged, Lemon Law returns, or where the title has been branded<br />

f. Vehicles listed as “ineligible vehicles” in the Vehicle Eligibility Guide<br />

g. All electric vehicles<br />

Vehicle Eligibility<br />

All eligible vehicles must be 20 model years old or newer and have less than 200,000 miles <br />

on the odometer at the time of purchase.<br />

Note: January 1st of each year constitutes the model year change.<br />

* Vehicles used at any time for: commercial use for business enterprise, trade, profession or <br />

occupation; competitive driving; taxi or livery; snow plowing or used for hire to the public or <br />

used to transport people for hire; municipal or professional emergency or police services; to <br />

tow a trailer whose weight exceeds the manufacturer's recommendations rental, limousine, <br />

shuttle, towing/wrecker service; lifting or hoisting; dumping (dump beds); or cherry pickers.<br />

1. DEFINITIONS<br />

TERMS AND CONDITIONS<br />

Throughout this Vehicle Service Contract certain words and phrases are used that have special meanings. These terms appear in boldface type. Their meanings<br />

are listed below:<br />

Administrator: Refers to Dimension Service Corporation, 5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943.<br />

Breakdown: Refers to the inability or failure of any Covered Part to perform the function for which it was intended by the manufacturer through the normal use of<br />

Your Vehicle.<br />

Contract, Service Contract, Vehicle Service Contract: Refers to this Vehicle Service Contract which You have purchased from the Seller to protect Your<br />

Vehicle.<br />

Contract Purchase Date: Means the initial date of Contract purchase by You.<br />

Covered Component: Means any part or component listed as covered in Section 6. WHAT IS COVERED.<br />

Declaration Page: Means the document that is attached to and forms part of this Vehicle Service Contract. It lists information regarding You, Your Vehicle,<br />

coverage selected and other vital information.<br />

Deductible: Means the amount You must pay, as shown on the Declaration Page, per repair visit in the event of a Breakdown.<br />

Repair Facility: refers to the Repair Facility that is, has or will be performing repairs to Your Vehicle. Such facility must be licensed and/or approved by the state<br />

to perform automotive repairs. Such facility must work <strong>with</strong>in labor rates and times as approved by the Administrator. Such facility must have a tax identification<br />

number, where required, and be capable of performing the needed repairs to Your Vehicle.<br />

Seller: refers to the entity from whom You purchased this Contract.<br />

Vehicle, Your Vehicle: refers to the Vehicle covered by this Contract as described on the Declaration Page of this Contract.<br />

We, Us, Our, Provider: refers to Autoguard Advantage Corporation (5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943), the entity that is obligated<br />

to perform under this Contract.<br />

You, Your, His/Her, Contract Holder: refers to the person named on this Contract as the purchaser of this Contract.<br />

2. CONTRACT TERM<br />

This Contract shall be in effect as of the date the Contract was purchased from the Seller, provided this Contract is accepted by Us, and will expire upon reaching<br />

the Contract Expiration Date or Contract Expiration Mileage, shown on the Declaration Page, as of 12:01 a.m. Eastern Standard Time, whichever occurs first.<br />

We reserve the right to refuse, cancel, terminate or void any Contract which does not meet Our underwriting guidelines (except in Arizona), is submitted <strong>with</strong><br />

insufficient payment or if You make a material misrepresentation in obtaining this Contract or in the submission of a claim.<br />

3. LIMITS OF LIABILITY<br />

The benefit of all claims paid or payable while this Contract is in force shall not exceed $2,500.<br />

4. OTHER SERVICE CONTRACTS, WARRANTIES OR INSURANCE POLICIES<br />

The term of this Contract may include a portion of the term of the manufacturer’s warranty issued to the original purchaser of the Vehicle. Coverage under this<br />

Contract is secondary to, and does not replace, the manufacturer’s warranty, but may provide certain additional benefits during the term of the manufacturer’s<br />

warranty. If more than one service contract, warranty or insurance policy can be applied to a Breakdown, coverage under this Contract shall be in excess over all<br />

other coverage, whether valid or collectible, except for benefits that may be applicable under Section 7. ADDITIONAL BENEFITS of this Contract.<br />

5. OUR OBLIGATIONS<br />

If You experience a Breakdown during the term of this Contract <strong>with</strong>in the United States or Canada, the We will pay the Repair Facility or reimburse You for the<br />

repair or replacement of the Covered Part(s) as described in this Contract, provided You have met Your obligations as stated in this Contract (see Section 10.<br />

WHAT TO DO IN THE EVENT OF A BREAKDOWN and Section 11. CONTRACT HOLDER’S OBLIGATIONS) and if the repair is not excluded under Section 9.<br />

WHAT IS NOT COVERED of this Contract. Replacement parts will be of like kind and quality and may include the use of new, remanufactured, rebuilt or<br />

serviceable used parts at the sole discretion of the Administrator. Labor time for any repair shall be based on the then-current All-Data labor guide and labor rates<br />

shall be <strong>with</strong>in accepted industry standards at the sole discretion of the Administrator. Additionally, the Administrator reserves the right to determine acceptable<br />

parts costs, in its sole discretion.<br />

6. WHAT IS COVERED<br />

This Contract will provide coverage for the parts or components listed below, less any Deductible shown on the Declaration Page, provided all parts and<br />

components are functioning at the time of Vehicle purchase.<br />

Engine: All internally lubricated parts of the engine, including but not limited to: pistons; piston rings; wrist pins; crankshaft and main bearings; connecting rods and<br />

rod bearings; camshaft and camshaft bearings; eccentric shaft; oil pump; push rods; rocker arms; rocker arm shafts; replaceable guides and seats; timing chain;<br />

timing gears; hydraulic lifters; intake and exhaust valves; and valve springs. Also engine torque strut; harmonic balancer; head gasket; timing belt; timing cover;<br />

intake and exhaust manifolds; valve covers; flexplate or flywheel (only if not damaged by a manual clutch disc or other clutch component); oil pan; dipstick and tube;<br />

engine block; engine mounts and cushions; pulleys; cylinder heads; water pump.<br />

Turbo/Supercharger: Turbo or supercharger housing and all internally lubricated parts (only if damaged by the failure of a part covered under this Named<br />

Component Coverage). Note: Only original OEM equipment qualifies for coverage.<br />

Transmission: All internally lubricated parts of manual or automatic transmissions, including but not limited to: gears; input and output shafts; bearings; oil pump;<br />

planetaries; pressure regulator valve; stator and stator shaft; sprags; separator plate; governor assembly; overdrive carrier; reaction carrier; center support; valve<br />

Drive Axle: Drive shaft; axle shaft(s); axle bearings; universal joints; constant velocity joints; ring and pinion gears; pinion bearings; supports; retainers; carrier<br />

assembly; side carrier bearings; thrust washers. Note: Drive axle housing is covered only if damaged by the covered failure of any of the above listed parts.<br />

4WD/AWD: Front drive shaft; axles; locking hubs; locking rings; differential; universal joints; constant velocity joints; main shaft; drive chain; gears; bearings; thrust<br />

washer and shims. Note: Transfer case housing is also covered only if damaged by the covered failure of any of the above listed parts.<br />

Seals and Gaskets: Provides coverage for leaking seals and gaskets for any covered part listed in Section 6. What Is Covered provided the Vehicle has less<br />

than 150,000 miles at the time of purchase. Note: A seal or gasket must show an active leak or drip for coverage to apply; minor seepage is considered normal and<br />

will not be considered a Breakdown.<br />

7. ADDITIONAL BENEFITS<br />

Additional benefits are included <strong>with</strong> all plans. No deductible applies to additional benefits.<br />

Rental Reimbursement: In the event of a Breakdown covered by this Contract, We will pay or reimburse You for receipted expenses to rent a replacement<br />

vehicle (from a licensed rental agency) while Your Vehicle is at a Repair Facility. Coverage will be provided to You up to a maximum of forty dollars ($40) for<br />

every eight (8) hours or portion thereof of approved labor time to complete the covered repair <strong>with</strong> a five (5) day maximum, not to exceed two hundred dollars<br />

($200). You must submit receipts to the Administrator for reimbursement. This coverage does not apply to service or parts delays or other time delays beyond Our<br />

control or that of the Repair Facility.<br />

Towing Reimbursement: In the event Your Vehicle becomes disabled due to a Breakdown which renders Your Vehicle inoperable, We will arrange to have the<br />

Vehicle transported, once per claim, to the Seller or the nearest Repair Facility <strong>with</strong>in fifty (50) miles. You are responsible for any charges that exceed the stated<br />

coverage limit.<br />

8. FUTURE CONTRACT GUARANTEE<br />

The Contract that You have purchased contains a Future Contract Guarantee. You will be contacted, at the phone number indicated in Our records, sixty (60)<br />

days prior to the expiration of this Contract by Our service center <strong>with</strong> an offer to enroll in a Matrix GoMonthly Vehicle Protection Plan (if Your Vehicle meets the<br />

eligibility guidelines). The specific terms and conditions of the Matrix GoMonthly plan will be provided upon Your enrollment. If You do not wish to be contacted<br />

please notify Us.<br />

Matrix Method’s CruiseControl product is a strong entry-level Vehicle Service Contract that offers flexible and affordable component<br />

coverage and options. CruiseControl covers the vehicle’s powertrain and has optional coverage for the air conditioning, electrical, first<br />

day coverage and seals and gaskets. Deductibles are offered at an affordable $250 (standard) and $100 (optional), as well as a $250<br />

disappearing (optional). The program is available on vehicles 20 years old and newer <strong>with</strong> less than 200,000 miles at the time of sale.<br />

A range of terms is available starting <strong>with</strong> 12 months/25,000 miles and going up to 60 months/100,000 miles from the date of sale. In<br />

addition, an option on the 36 months/100,000 mile term allows the contract holder to extend the term 12 months (maximum of two<br />

extensions) for a nominal charge.<br />

When your customer’s budget is limited, or the lending source will not approve a higher priced vehicle service contract, CruiseControl fits<br />

the bill. Your customers will feel more comfortable knowing that the major parts and components of their vehicle are covered and that they<br />

will be protected from the high cost of an unexpected repair at a price they can afford.<br />

A Future Guarantee is another dealership benefit to the CruiseControl program. This means being automatically enrolled in Matrix Warranty<br />

Solutions’ no cost follow-up program for warranty holders. Our professionally trained specialists will contact your customers 60 days prior to<br />

To be eligible for coverage the vehicle must be listed as an eligible vehicle in the Vehicle Eligibility Guide. All trucks or vans are limited to a<br />

to tow a trailer whose weight exceeds the manufacturer’s recommendations, rental, limousine, shuttle, towing/wrecker service, lifting or<br />

hoisting, dumping (dump beds), cherry pickers<br />

b. Vehicles altered or modified in a fashion not recommended by the manufacturer, including installation of high performance equipment, lift<br />

1. DEFINITIONS<br />

TERMS AND CONDITIONS<br />

Throughout this Vehicle Service Contract certain words and phrases are used that have special meanings. These terms appear in boldface type. Their meanings<br />

are listed below:<br />

Actual Cash Value (ACV): shall be the “average trade-in” value for the Vehicle, adjusted for mileage as shown in the then-current N.A.D.A. Official Used Car<br />

Guide.<br />

Administrator: refers to Dimension Service Corporation, 5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943.<br />

Aggregate Limit of Liability: means the total amount of benefits allowed during the term of this Service Contract.<br />

Breakdown: refers to the inability or failure of any Covered Part to perform the function for which it was intended by the manufacturer through the normal use of<br />

Your Vehicle.<br />

Contract, Service Contract, Vehicle Service Contract: refers to this Vehicle Service Contract which You have purchased from the Seller to protect Your<br />

Vehicle.<br />

Contract Purchase Date: means the initial date of Contract purchase by You. A thirty (30) day AND one thousand (1,000) mile waiting period begins on this<br />

date, during which no claims may be filed. No waiting period will apply if optional the First Day Coverage surcharge has been selected and paid for and the<br />

appropriate box is marked on the Declaration Page.<br />

Covered Component: any part or component listed as covered in Section 6. WHAT IS COVERED.<br />

Declaration Page: means the document that is attached to and forms part of this Vehicle Service Contract. It lists information regarding You, Your Vehicle,<br />

coverage selected and other vital information.<br />

Deductible: means the amount You must pay, as shown on the Declaration Page, per repair visit in the event of a Breakdown. If You have selected the<br />

Disappearing Deductible option, as shown on the Declaration Page, the Deductible will be waived provided You have repairs made at the Seller’s Repair<br />

Facility.<br />

Repair Facility: refers to the Repair Facility that is, has or will be performing repairs to Your Vehicle. Such facility must be licensed and/or approved by the state<br />

to perform automotive repairs. Such facility must work <strong>with</strong>in labor rates and times as approved by the Administrator. Such facility must have a tax identification<br />

number, where required, and be capable of performing the needed repairs to Your Vehicle.<br />

Seller: refers to the entity from whom You purchased this Contract.<br />

Vehicle, Your Vehicle: refers to the Vehicle covered by this Contract as described on the Declaration Page of this Contract.<br />

We, Us, Our, Provider: refers to Autoguard Advantage Corporation (5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943), the entity that is obligated<br />

to perform under this Contract.<br />

You, Your, His/Her, Contract Holder: refers to the person named on this Contract as the purchaser of this Contract.<br />

2. CONTRACT TERM<br />

This Contract shall be in effect as of the date the Contract was purchased from the Seller, provided this Contract is accepted by Us, and will expire upon reaching<br />

the Contract Expiration Date, shown on the Declaration Page, as of 12:01 a.m. Eastern Standard Time.<br />

THIS CONTRACT CONTAINS A MANDATORY WAITING PERIOD OF THIRTY (30) DAYS AND ONE THOUSAND (1,000) MILES<br />

FROM THE CONTRACT PURCHASE DATE. AN ADDITIONAL THIRTY (30) DAYS WILL BE ADDED TO YOUR VEHICLE PLAN’S<br />

EXPIRATION. THEREFORE THE WAITING PERIOD WILL NOT REDUCE THE ACTUAL TIME DURING WHICH YOU HAVE<br />

COVERAGE. CLAIMS INCURRED DURING THE WAITING PERIOD WILL NOT BE COVERED.<br />

We reserve the right to refuse, cancel, terminate or void any Contract which does not meet Our underwriting guidelines (except in Arizona), is submitted <strong>with</strong><br />

insufficient payment or if You make a material misrepresentation in obtaining this Contract or in the submission of a claim.<br />

3. LIMITS OF LIABILITY<br />

Our maximum limit of liability per loss shall be the lesser of the actual cost of the repair (the maximum per covered repair group is outlined below), or the Actual<br />

Cash Value of the Vehicle at the time of repair.<br />

One thousand-two hundred dollars ($1,200) for Air Conditioning claims (where applicable surcharge has been selected and paid).<br />

4. OTHER SERVICE CONTRACTS, WARRANTIES OR INSURANCE POLICIES<br />

The term of this Contract may include a portion of the term of the manufacturer’s warranty issued to the original purchaser of the Vehicle. Coverage under this<br />

Contract is secondary to, and does not replace, the manufacturer’s warranty, but may provide certain additional benefits during the term of the manufacturer’s<br />

warranty. If more than one service contract, warranty or insurance policy can be applied to a Breakdown, coverage under this Contract shall be in excess over all<br />

other coverage, whether valid or collectible, except for benefits that may be applicable under Section 7. ADDITIONAL BENEFITS of this Contract.<br />

5. OUR OBLIGATIONS<br />

If You experience a Breakdown during the term of this Contract <strong>with</strong>in the United States or Canada, the We will pay the Repair Facility or reimburse You for the<br />

repair or replacement of the Covered Part(s) as described in this Contract, provided You have met Your obligations as stated in this Contract (see Section 12.<br />

WHAT TO DO IN THE EVENT OF A BREAKDOWN and Section 13. CONTRACT HOLDER’S OBLIGATIONS) and if the repair is not excluded under Section 11.<br />

WHAT IS NOT COVERED of this Contract. Replacement parts will be of like kind and quality and may include the use of new, remanufactured, rebuilt or<br />

serviceable used parts at the sole discretion of the Administrator. Labor time for any repair shall be based on the then-current All-Data labor guide and labor rates<br />

shall be <strong>with</strong>in accepted industry standards at the sole discretion of the Administrator. Additionally, the Administrator reserves the right to determine acceptable<br />

parts costs, in its sole discretion.<br />

6. WHAT IS COVERED<br />

This Contract will provide coverage for the parts or components listed below, less any Deductible shown on the Declaration Page, provided all parts and<br />

components are functioning at the time of Vehicle purchase.<br />

Engine: all internally lubricated parts of the engine, including but not limited to pistons; piston rings; wrist pins; crankshaft and main bearings; connecting rods and<br />

rod bearings; camshaft and camshaft bearings; eccentric shaft; oil pump; push rods; rocker arms; rocker arm shafts; replaceable guides and seats; timing chain;<br />

timing gears; hydraulic lifters; intake and exhaust valves; and valve springs. Also engine torque strut; harmonic balancer; head gasket; timing belt; timing cover;<br />

intake and exhaust manifolds; valve covers; flexplate or flywheel (only if not damaged by a manual clutch disc or other clutch component); oil pan; dipstick and tube;<br />

engine block; engine mounts and cushions; pulleys; cylinder heads; water pump.<br />

Turbo/Supercharger: turbo or supercharger housing and all internally lubricated parts (only if damaged by the failure of a part covered under this coverage). Note:<br />

Only original OEM equipment qualifies for coverage.<br />

Transmission: all internally lubricated parts of manual or automatic transmissions, including but not limited to: gears; input and output shafts; bearings; oil pump;<br />

planetaries; pressure regulator valve; stator and stator shaft; sprags; separator plate; governor assembly; overdrive carrier; reaction carrier; center support; valve<br />

body; torque converter; parking lock actuator; dipstick and tube; vacuum modulator; internal linkage; transmission control unit. Note: Transmission case, dipstick<br />

and filler tube, torque converter housing and overdrive housing are also covered only if damaged by the covered failure of any of the above listed parts.<br />

Drive Axle: drive shaft; axle shaft(s); axle bearings; universal joints; constant velocity joints; ring and pinion gears; pinion bearings; supports; retainers; carrier<br />

assembly; side carrier bearings; thrust washers. Note: Drive axle housing is covered only if damaged by the covered failure of any of the above listed parts.<br />

4WD/AWD: front drive shaft; axles; locking hubs; locking rings; differential; universal joints; constant velocity joints; main shaft; drive chain; gears; bearings; thrust<br />

washer and shims. Note: Transfer case housing is also covered only if damaged by the covered failure of any of the above listed parts.<br />

7. ADDITIONAL BENEFITS<br />

Additional benefits are included <strong>with</strong> all plans. No deductible applies to additional benefits.<br />

Rental Reimbursement: In the event of a Breakdown covered by this Contract, We will pay or reimburse You for receipted expenses to rent a replacement<br />

vehicle (from a licensed rental agency) while Your Vehicle is at a Repair Facility. Coverage will be provided to You up to a maximum of forty dollars ($40) for<br />

every eight (8) hours or portion thereof of approved labor time to complete the covered repair <strong>with</strong> a five (5) day maximum, not to exceed two hundred dollars<br />

($200). You must submit receipts to the Administrator for reimbursement. This coverage does not apply to service or parts delays or other time delays beyond Our<br />

control or that of the Repair Facility.<br />

Towing Benefit: In the event Your Vehicle becomes disabled due to a Breakdown which renders Your Vehicle inoperable, We will arrange to have the Vehicle<br />

transported, once per claim, to the Seller or the nearest Repair Facility <strong>with</strong>in fifty (50) miles. You are responsible for any charges that exceed the stated coverage<br />

limit.<br />

8. OPTIONAL SURCHARGES<br />

The following coverage applies if any of the optional surcharges have been selected and paid for and the appropriate box is marked on the Declaration Page.<br />

Air Conditioning (Factory Installed Only): compressor; compressor clutch and pulley; condenser; evaporator; accumulator; coil; expansion valve; blower motor;<br />

serpentine belt tensioner; power module; idler pulley and bearing; ducts and outlet hoses; orifice tube; high/low cutoff switches; pressure cycling switch;<br />

receiver/dryer. Note: If the covered costs to repair an R-12 system exceed the cost to convert to an R-143a system, the system will be converted to use R-143a<br />

refrigerant. Note: Refrigerant is also covered if required in connection <strong>with</strong> a covered Breakdown.<br />

Electrical: starter motor; alternator; voltage regulator; main battery; ignition module; ignition coil; distributor; starter solenoid; front and rear wiper motors; wiper<br />

module; washer pump and switch; power window motors; power seat motors; power door lock actuator; power antenna motor; power mirror motor; power trunk<br />

motor; rear spoiler motor; steering column motor; stepper motor, relays and pump; cruise control transducer; pole pieces; condenser fan motor; DK motor; headlight<br />

motor; idle air control motor; idle speed control motor; aspirator fan motor; phase control motor.<br />

First Day Coverage: If You have elected to purchase this optional coverage, this Vehicle Service Contract will not be subject to a thirty (30) day and one<br />

thousand (1,000) mile waiting period. Coverage begins on the date You purchased Your Vehicle as shown on the Declaration Page.<br />

Seals & Gaskets: provides coverage for leaking seals and gaskets for any covered part listed in Section 6. What Is Covered provided the Vehicle has less than<br />

150,000 miles at the time of purchase and will continue until the Vehicle reaches 250,000 miles or the expiration date shown on the Declaration Page (whichever<br />

occurs first). Note: A seal or gasket must show an active leak or drip for coverage to apply; minor seepage is considered normal and will not be considered a<br />

breakdown.<br />

9. MANDATORY SURCHARGES<br />

To be eligible for coverage the vehicle must be listed as an eligible vehicle in the Vehicle Eligibility Guide. All trucks or vans are limited to a<br />

gross carrying weight of one ton (15,000 lbs GVW).<br />

Plan Qualification:<br />

January 1st shall be the model year change for determining eligibility. The vehicle must be 15 model years or newer and have less than<br />

Vehicle Eligibility & Underwriting Guidelines<br />

Vehicle Eligibility<br />

All eligible vehicles must be 15 model years old or newer and have less than 200,000 miles <br />

on the odometer at the time of purchase.<br />

Note: January 1st of each year constitutes the model year change.<br />

* Vehicles used at any time for: commercial use for business enterprise, trade, profession or <br />

occupation; competitive driving; taxi or livery; snow plowing or used for hire to the public or <br />

used to transport people for hire; municipal or professional emergency or police services; to <br />

tow a trailer whose weight exceeds the manufacturer's recommendations rental, limousine, <br />

shuttle, towing/wrecker service; lifting or hoisting; dumping (dump beds); or cherry pickers.<br />

Ineligible Vehicles<br />

* Vehicles altered or modified in a fashion not recommended by the manufacturer, including <br />

installation of high performance equipment, lift or lowering kits, incorrect tires/wheels or <br />

removal of any emission devices.<br />

* Vehicles that are Kit Cars; High Performance; Exotic or Special Purpose; Engines Over 8 <br />

Cylinders; Alternative Fuel (Natural Gas, LP Gas or Propane) or All Electric; or Modified <br />

Diesel.<br />

* Vehicles <strong>with</strong> odometers that are broken and/or the correct mileage cannot be determined <br />

and verified by the program administrator.<br />

Business Use<br />

Covered Vehicles: Vehicles used for repair work, service work, route work and delivery work <br />

(ex: floral delivery, cable TV repair, plumber, vending machine attendant, catering company, <br />

medical supply delivery, home repairs, realtor, etc.) Vehicles used for farm use or field work <br />

are eligible provided their primary use is for transportation purposes and not used at any <br />

time for excessive hauling and/or off-­‐road pasture or field work. Coverage is limited to single <br />

use drivers.<br />

Excluded Vehicles: Vehicles used for commercial towing, dump or refuse collection, hauling, <br />

taxi, livery, shuttle, rental, equipped <strong>with</strong> a snow plow, construction, racing or competitive <br />

driving, or emergency services are not eligible for coverage. Vehicles having multiple drivers <br />

are not eligible for coverage.<br />

Note: Surcharge is required in order to make the vehicle eligible for any coverage. The surcharge provides <br />

basic eligibility only, and does not add any additional coverage.<br />

Ohio 43017 (888) 705-8943) fails to pay or provide service on a claim <strong>with</strong>in sixty (60) days after proof of loss has been filed, the Contract Holder is entitled to make a claim against the<br />

insurance company. The name and address of the Insurance Company is ANV Syndicates Limited, Lloyd’s Underwriting Syndicate Number 5820, 47 Mark Lane, London EC3R 7QQ, United<br />

Kingdom, (888) 705-8941.<br />

The undersigned verify that the information contained herein is true and correct to the best of their knowledge. The undersigned Contract Holder has examined and driven the Vehicle and is<br />

not aware of any mechanical or electrical defect or problem <strong>with</strong> the Vehicle. The Contract Holder verifies that He/She has read, understands, and will abide by the terms and conditions of<br />

this Contract. No verbal or written representations have been made which may alter the terms and conditions of this Contract. We reserve the right to refuse, cancel, terminate or void any<br />

Contract that does not meet Our underwriting guidelines (except in Arizona). This Contract becomes valid only upon acceptance by the Administrator. Purchase of this Contract is not<br />

necessary to obtain financing for the Vehicle. This is not an insurance policy.<br />

1. DEFINITIONS<br />

TERMS AND CONDITIONS<br />

Throughout this Vehicle Service Contract certain words and phrases are used that have special meanings. These terms appear in boldface type. Their meanings<br />

are listed below:<br />

Actual Cash Value (ACV): shall be the “average trade-in” value for the Vehicle, adjusted for mileage as shown in the then-current N.A.D.A. Official Used Car<br />

Guide.<br />

Administrator: refers to Dimension Service Corporation, 5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943.<br />

Aggregate Limit of Liability: means the total amount of benefits allowed during the term of this Service Contract.<br />

Breakdown: refers to the inability or failure of any Covered Part to perform the function for which it was intended by the manufacturer through the normal use of<br />

Your Vehicle.<br />

Contract, Service Contract, Vehicle Service Contract: refers to this Vehicle Service Contract which You have purchased from the Seller to protect Your<br />

Vehicle.<br />

Contract Purchase Date: means the initial date of Contract purchase by You. A thirty (30) day AND one thousand (1,000) mile waiting period begins on this<br />

date, during which no claims may be filed. No waiting period will apply if optional the First Day Coverage surcharge has been selected and paid for and the<br />

appropriate box is marked on the Declaration Page.<br />

Covered Component: any part or component listed as covered in Section 6. WHAT IS COVERED.<br />

Declaration Page: means the document that is attached to and forms part of this Vehicle Service Contract. It lists information regarding You, Your Vehicle,<br />

coverage selected and other vital information.<br />

Deductible: means the amount You must pay, as shown on the Declaration Page, per repair visit in the event of a Breakdown.<br />

Exclusionary Coverage: refers to the coverage afforded by this Contract from purchase until Your Vehicle reaches seventy-five thousand (75,000) odometer<br />

miles. This coverage includes all parts and/or components of Your Vehicle unless specifically listed under Section 10. WHAT IS NOT COVERED.<br />

Lifetime Engine Coverage: refers to the coverage afforded by this Contract after Your Vehicle has exceeded 200,000 miles up until all coverage expires as<br />

prescribed under Section 2. CONTRACT TERM. Only the parts and/or components specifically listed are covered.<br />

Named Component Coverage: refers to the coverage afforded by this Contract after Your Vehicle has between seventy-five thousand (75,000) and two hundred<br />

thousand (200,000) odometer miles or up until all coverage expires as prescribed under Section 2. CONTRACT TERM. Only the parts and/or components<br />

specifically listed are covered.<br />

Repair Facility: refers to the Repair Facility that is, has or will be performing repairs to Your Vehicle. Such facility must be licensed and/or approved by the state<br />

to perform automotive repairs. Such facility must work <strong>with</strong>in labor rates and times as approved by the Administrator. Such facility must have a tax identification<br />

number, where required, and be capable of performing the needed repairs to Your Vehicle.<br />

Seller: refers to the entity from whom You purchased this Contract.<br />

Vehicle, Your Vehicle: refers to the Vehicle covered by this Contract as described on the Declaration Page of this Contract.<br />

We, Us, Our, Provider: refers to Autoguard Advantage Corporation (5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943), the entity that is obligated<br />

to perform under this Contract.<br />

You, Your, His/Her, Contract Holder: refers to the person named on this Contract as the purchaser of this Contract.<br />

2. CONTRACT TERM<br />

This Contract shall be in effect as of the date the Contract was purchased from the Seller, provided this Contract is accepted by Us, and will expire upon reaching<br />

the Contract Expiration Date, shown on the Declaration Page, as of 12:01 a.m. Eastern Standard Time.<br />

THIS CONTRACT CONTAINS A MANDATORY WAITING PERIOD OF THIRTY (30) DAYS AND ONE THOUSAND (1,000) MILES<br />

FROM THE CONTRACT PURCHASE DATE. AN ADDITIONAL THIRTY (30) DAYS WILL BE ADDED TO YOUR VEHICLE PLAN’S<br />

EXPIRATION. THEREFORE THE WAITING PERIOD WILL NOT REDUCE THE ACTUAL TIME DURING WHICH YOU HAVE<br />

COVERAGE. CLAIMS INCURRED DURING THE WAITING PERIOD WILL NOT BE COVERED.<br />

We reserve the right to refuse, cancel, terminate or void any Contract which does not meet Our underwriting guidelines (except in Arizona), is submitted <strong>with</strong><br />

insufficient payment or if You make a material misrepresentation in obtaining this Contract or in the submission of a claim.<br />

3. LIMITS OF LIABILITY<br />

For this Contract, the maximum Aggregate Limit of Liability is the lesser of Actual Cash Value at the time of Breakdown or $12,500.<br />

Once the Aggregate Limit of Liability has been reached, this Contract and its cancellation rights terminate, and no further claims can be made against Us. We<br />

shall not be responsible for lost time, wages, lost use or any other consequential or incidental damages. These limitations and exclusions of liability apply only to the<br />

extent allowed by law.<br />

4. OTHER SERVICE CONTRACTS, WARRANTIES OR INSURANCE POLICIES<br />

The term of this Contract may include a portion of the term of the manufacturer’s warranty issued to the original purchaser of the Vehicle. Coverage under this<br />

Contract is secondary to, and does not replace, the manufacturer’s warranty, but may provide certain additional benefits during the term of the manufacturer’s<br />

warranty. If more than one service contract, warranty or insurance policy can be applied to a Breakdown, coverage under this Contract shall be in excess over all<br />

other coverage, whether valid or collectible, except for benefits that may be applicable under Section 7. ADDITIONAL BENEFITS of this Contract.<br />

5. OUR OBLIGATIONS<br />

If You experience a Breakdown during the term of this Contract <strong>with</strong>in the United States or Canada, the We will pay the Repair Facility or reimburse You for the<br />

epair or replacement of the Covered Part(s) as described in this Contract, provided You have met Your obligations as stated in this Contract (see Section 12.<br />

WHAT TO DO IN THE EVENT OF A BREAKDOWN and Section 13. CONTRACT HOLDER’S OBLIGATIONS) and if the repair is not excluded under Section 11.<br />

WHAT IS NOT COVERED of this Contract. Replacement parts will be of like kind and quality and may include the use of new, remanufactured, rebuilt or<br />

serviceable used parts at the sole discretion of the Administrator. Labor time for any repair shall be based on the then-current All-Data labor guide and labor rates<br />

shall be <strong>with</strong>in accepted industry standards at the sole discretion of the Administrator. Additionally, the Administrator reserves the right to determine acceptable<br />

parts costs, in its sole discretion.<br />

6. WHAT IS COVERED<br />

If Your Vehicle has fewer than seventy-five thousand (75,000) odometer miles at the time of Breakdown, We will pay the Repair Facility or reimburse You for a<br />

Breakdown of any of Your Vehicle’s mechanical and electrical components, less any applicable deductible, except those items listed in Section 10. WHAT IS<br />

NOT COVERED.<br />

ONCE YOUR VEHICLE HAS REACHED SEVENTY-FIVE THOUSAND (75,000) ODOMETER MILES, EXCLUSIONARY COVERAGE<br />

EXPIRES AND ONLY THE FOLLOWING NAMED COMPONENT COVERAGE BECOMES EFFECTIVE:<br />

If Your Vehicle has fewer than 200,000 odometer miles at the time of Breakdown, the following items are covered by this Service Contract. All coverage stated in<br />

this Named Component Coverage ceases once Your Vehicle has reached 200,000 odometer miles.<br />

Engine: all internally lubricated parts of the engine, including but not limited to pistons; piston rings; wrist pins; crankshaft and main bearings; connecting rods and<br />

rod bearings; camshaft and camshaft bearings; eccentric shaft; oil pump; push rods; rocker arms; rocker arm shafts; replaceable guides and seats; timing chain;<br />

timing gears; hydraulic lifters; intake and exhaust valves; and valve springs. Also engine torque strut; harmonic balancer; head gasket; timing belt; timing cover;<br />

intake and exhaust manifolds; valve covers; flexplate or flywheel (only if not damaged by a manual clutch disc or other clutch component); oil pan; dipstick and tube;<br />

engine block; engine mounts and cushions; pulleys; cylinder heads; water pump.<br />

Turbo/Supercharger: turbo or supercharger housing and all internally lubricated parts (only if damaged by the failure of a part covered under this Named<br />

Component Coverage). Note: Only original OEM equipment qualifies for coverage.<br />

Transmission: all internally lubricated parts of manual or automatic transmissions, including but not limited to: gears; input and output shafts; bearings; oil pump;<br />

planetaries; pressure regulator valve; stator and stator shaft; sprags; separator plate; governor assembly; overdrive carrier; reaction carrier; center support; valve<br />

body; torque converter; parking lock actuator; dipstick and tube; vacuum modulator; internal linkage; transmission control unit. Note: Transmission case, dipstick<br />

and filler tube, torque converter housing and overdrive housing are also covered only if damaged by the covered failure of any of the above listed parts.<br />

Drive Axle: drive shaft; axle shaft(s); axle bearings; universal joints; constant velocity joints; ring and pinion gears; pinion bearings; supports; retainers; carrier<br />

assembly; side carrier bearings; thrust washers. Note: Drive axle housing is covered only if damaged by the covered failure of any of the above listed parts.<br />

4WD/AWD: front drive shaft; axles; locking hubs; locking rings; differential; universal joints; constant velocity joints; main shaft; drive chain; gears; bearings; thrust<br />

washer and shims. Note: Transfer case housing is also covered only if damaged by the covered failure of any of the above listed parts.<br />

Basic Air Conditioning: all internally lubricated parts contained <strong>with</strong>in the compressor; condenser; evaporator; orifice tube. Seals and Gaskets along <strong>with</strong> R134 are<br />

only covered when required in connection <strong>with</strong> the replacement of a Covered Component.<br />

Basic Cooling: water pump.<br />

Basic Electrical: alternator and starter.<br />

ADDITIONAL NAMED COMPONENT COVERAGE BELOW IS IN EFFECT UNTIL YOUR VEHICLE HAS REACHED 125,000 MILES.<br />

ONCE YOUR VEHICLE HAS REACHED 125,000 MILES, ADDITIONAL NAMED COMPONENT COVERAGE BELOW EXPIRES AND<br />

ONLY THE ABOVE POWERTRAIN NAMED COMPONENT COVERAGE REMAINS IN EFFECT.<br />

If Your Vehicle has fewer than 125,000 odometer miles at the time of Breakdown, the following items are covered by this Service Contract. All coverage stated in<br />

this Named Component Coverage ceases once Your Vehicle has reached 125,000 odometer miles.<br />

Suspension: control arms; control arm shafts; bearings and bushings; radius arm; radius arm bushing; stabilizer bar; stabilizer link; stabilizer bushing; spindle;<br />

wheel bearings; torsion bars; upper and lower ball joints; steering knuckles; kingpin and bushings; coil and leaf springs.<br />

Steering: steering gear box or rack and all internally lubricated parts; power steering pump; steering column shaft; steering column shaft couplings; cooler and<br />

cooler lines; power cylinder; pitman arm; idler arm; tie rod and ends; link and control valve.<br />

Cooling: radiator; engine cooling fan motor; fan and fan clutch.<br />

Air Conditioning (Factory-Installed Front Only): AC compressor, compressor clutch and pulley; condenser; evaporator; accumulator; coil; expansion valve;<br />

blower motor; serpentine belt tensioner; power module; idler pulley and bearing; ducts and outlet hoses; orifice tube; high/low cutoff switches; pressure cycling<br />

switch; receiver/dryer. Note: If covered costs to repair an R-12 system exceed the cost to convert to an R-134a system, the system will be converted to use R-134a<br />

refrigerant. Note: Refrigerant is also covered only if the loss was due to the failure of a part covered under this Named Component Coverage. We will pay up to<br />

fifteen dollars ($15) per pound for refrigerant.<br />

Fuel System: fuel pump; fuel tank; fuel sending unit; diesel injection pump; fuel injectors; metal fuel lines; fuel pressure regulator; fuel gauge; air control valve;<br />

engine control module (ECM); fuel injection sensors.<br />

Brakes: master cylinder; power brake cylinder; vacuum assist booster; vacuum brake booster pump; compensating valve; disc brake calipers; wheel cylinders;<br />

hydraulic lines; hydraulic line fittings; backing plates; springs; clips and retainers; self adjusters; linkage and cables; rear actuators; and the following anti-lock<br />

braking system (ABS) components: master cylinder; electronic wheel sensors; pump and pressure control module; electronic control module.<br />

Electrical: starter motor; alternator; voltage regulator; main battery; ignition module; ignition coil; distributor; starter solenoid; front and rear wiper motors; wiper<br />

module; washer pump and switch; power window motors; power seat motors, power door lock actuator; power antenna motor; power mirror motor; power trunk<br />

motor; rear spoiler motor; steering column motor; stepper motor; delays and pumps; cruise control transducer; pole pieces; condenser fan motor; DK motor;<br />

headlight motor; idle air control motor; idle speed control motor; aspirator fan motor; phase control motor.<br />

High Tech: level control compressor; sensors and limiter valve; pneumatic suspension pump; sensors and valves; ignition module; spark control detonation sensors<br />

and controller; moisture control unit and sensors; anti-detonation sensors; combination entry system; cam sensor; crank angle sensor; fuel injector control unit<br />

(including sensors and O2 sensors); all additional electrical motors, electrical controllers, and switches not enumerated under Electrical coverage above. Note: Only<br />

original OEM equipment qualifies for coverage.<br />

Manufacturer-Installed GPS: navigation display unit; navigation control module; navigation system wiring harness. Note: Antennae, cables, and wiring are<br />

excluded from coverage.<br />

Seals & Gaskets: seals and gaskets are covered. Note: A seal or gasket must show an active leak or drip for coverage to apply; minor seepage is considered<br />

normal and will not be considered a Breakdown.<br />

Wear & Tear: if Your Vehicle has fewer than 125,000 odometer miles at the time of Breakdown, We will also include coverage for a part or component which is<br />

outside allowable tolerances as prescribed by the manufacturer of that part or component, even if a Breakdown has not occurred (otherwise known as wear and<br />

tear).<br />

ONCE YOUR VEHICLE HAS REACHED 200,000 MILES, THE FOLLOWING COVERAGE WILL BE IN EFFECT UNTIL THE CONTRACT<br />

EXPIRATION DATE SHOWN ON THE DECLARATION PAGE IS REACHED.<br />

If Your Vehicle has reached 200,000 or more odometer miles at the time of Breakdown, the following items are covered by this Service Contract. All coverage<br />

stated in this Lifetime Engine Coverage ceases once the expiration date shown on the Declaration Page is reached.<br />

Lifetime Engine Coverage: all internally lubricated parts of the engine, including but not limited to pistons; piston rings; wrist pins; crankshaft and main bearings;<br />

connecting rods and rod bearings; camshaft and camshaft bearings; eccentric shaft; oil pump; push rods; rocker arms; rocker arm shafts; replaceable guides and<br />

seats; timing chain; timing gears; hydraulic lifters; intake and exhaust valves; and valve springs. Also engine torque strut; harmonic balancer; head gasket; timing<br />

belt; timing cover; intake and exhaust manifolds; valve covers; flexplate or flywheel (only if not damaged by a manual clutch disc or other clutch component); oil pan;<br />

7. ADDITIONAL BENEFITS<br />

Additional benefits are included <strong>with</strong> all plans. No deductible applies to additional benefits.<br />

Rental Reimbursement: In the event of a Breakdown covered by this Contract, We will pay or reimburse You for receipted expenses to rent a replacement<br />

vehicle (from a licensed rental agency) while Your Vehicle is at a Repair Facility. Coverage will be provided to You up to a maximum of forty dollars ($40) for<br />

every eight (8) hours or portion thereof of approved labor time to complete the covered repair <strong>with</strong> a five (5) day maximum, not to exceed two hundred dollars<br />

($200). You must submit receipts to the Administrator for reimbursement. This coverage does not apply to service or parts delays or other time delays beyond Our<br />

control or that of the Repair Facility.<br />

Trip Interruption (Available Only Where Allowed By Law): If You experience a Breakdown which occurs more than one hundred (100) miles from Your home<br />

and results in a Repair Facility keeping Your Vehicle overnight, We will reimburse You for receipted motel and meal expenses not to exceed seventy-five dollars<br />

($75) per day for up to three (3) days and a maximum benefit per occurrence of two hundred twenty-five dollars ($225).<br />

8. OPTIONAL SURCHARGES<br />

The following coverage applies if the optional surcharge has been selected and paid for and the appropriate box is marked on the Declaration Page.<br />

First Day Coverage: If You have elected to purchase this optional coverage, this Vehicle Service Contract will not be subject to a thirty (30) day and one<br />

thousand (1,000) mile waiting period. Coverage begins on the date You purchased Your Vehicle as shown on the Declaration Page.<br />

9. MANDATORY SURCHARGES<br />

Business Use Vehicle: a surcharge is required if Your Vehicle is used for repair work, service work, route work and delivery work (ex: floral delivery, cable TV<br />

repair, plumber, vending machine attendant, catering company, medical supply delivery, home repairs, realtor, etc.) Vehicles used for farm use or oil field work are<br />

eligible provided their primary use is for transportation purposes and not used at any time for excessive hauling and/or off-road pasture or field work. Coverage is<br />

limited to single use drivers.<br />

Selection and purchase of the surcharge is required in order to make the Vehicle eligible for any coverage. The surcharge provides basic eligibility only, and does<br />

not add any additional coverage to this Contract.<br />

10. FUTURE CONTRACT GUARANTEE<br />

The Contract that You have purchased contains a Future Contract Guarantee. You will be contacted, at the phone number indicated in Our records, sixty (60)<br />

days prior to the expiration of this Contract by Our service center <strong>with</strong> an offer to enroll in a Matrix GoMonthly Vehicle Protection Plan (if Your Vehicle meets the<br />

24-Hour Roadside Assistance<br />

When arranging for Roadside Assistance, please reference Your Producer Code and Contract Number (located on the front of this form). You<br />

will not be required to pay any additional fee or sum in addition to the contract fee when Your service is for a tow of up to twenty five (25)<br />

miles or other covered service listed below. You are entitled to one (1) free service <strong>with</strong>in a seventy two (72) hour period. Covered services<br />

not obtained through Us are limited to a maximum reimbursement amount of fifty dollars ($50).<br />

Towing - Up to twenty five (25) miles at no out of pocket expense to You. Additional mileage is available and will be negotiated prior to<br />

Covers the cost of repairs to the front windshield ONLY of minor chips and cracks caused by propelled rocks or other propelled road debris.<br />

There is no coverage for stress cracks, cracks over six (6) inches in length, or any damage wherein it is determined by the repair technician<br />

that the damage cannot be repaired. Weather related damage is NOT covered. You may call 1-888-684-9327, Monday through Friday from<br />

9 a.m. to 5 p.m. eastern time, prior to repair, and We will dispatch repair service. You will be required to pay a deductible of fifty dollars<br />

Tire and Wheel (Rim) Road Hazard Protection<br />

This Agreement provides for the repair or replacement of the Vehicle's tires and wheels, which during the term of this Agreement become<br />

Unserviceable due to a Road Hazard. Unserviceable means that the tire(s) has been punctured or otherwise damaged to the extent that it is<br />

unsafe, or that the wheel will no longer hold a seal <strong>with</strong> its tire. Tire and/or wheel damage that is cosmetic in nature and that does not render<br />

the tire and/or wheel Unserviceable is specifically excluded. A Road Hazard is a condition on a public roadway, which should not exist<br />

there, such as potholes, nails, glass, or other road debris.<br />

Flat Tires: You will be reimbursed up to thirty dollars ($30) for the reasonable costs You incur to repair a flat tire caused by a Road<br />

Hazard while operating the Vehicle on public streets and in a legal manner.<br />

Tire Replacement: You will be reimbursed up to two hundred fifty dollars ($250) for the reasonable costs You incur to replace a tire, only<br />

if a tire covered by this Agreement becomes unrepairable due to damage caused by a Road Hazard. Replacement will be made <strong>with</strong> a tire<br />

of like kind and quality to the original tire. You will be required to pay a deductible of fifty dollars ($50) at the time service is<br />

rendered.<br />

Wheels (Rims): You will be reimbursed up to four hundred dollars ($400) for the repair or replacement of wheels rendered Unserviceable<br />

due to a Road Hazard covered under this Agreement. We reserve the right to have damaged wheels repaired at Our cost by a service<br />

provider of Our choosing. We further reserve the right to replace the damaged wheel at Our cost <strong>with</strong> a remanufactured wheel of like kind<br />

and quality to the wheel that was damaged by the covered Road Hazard. We will cover wheel replacement only in the event that the<br />

damaged wheel cannot be repaired. You will be required to pay a deductible of fifty dollars ($50) at the time service is rendered.<br />

Mounting and Balancing: You will be reimbursed for the reasonable costs that You incur for mounting, balancing, valve stems, and tire<br />

disposal for any tire replaced under this Agreement. However, charges for pressure sensing devices and unspecified charges for shop<br />

supplies are excluded.<br />

Taxes: You will be reimbursed for the cost of local and state taxes, as directed by state agencies for any tire or wheel replaced under this<br />

Agreement.<br />

Limit of Coverage: The maximum aggregate provided for either tire or wheel replacement on this Agreement will be the amount per each<br />

item as stated below times the number of tires on the Vehicle (i.e. Automobile: $250 per tire x 4 tires = $1,000).<br />

Agreement Holder Responsibility: You must maintain proper air pressure in all covered tires. Tires should be checked monthly for proper<br />

pressure, signs of dry rot, improper wear, and tread depth less than 3/32". Any conditions that cannot be corrected demands replacement for<br />

the safety of the Vehicles occupants. Replaced tires are covered for the time remaining on the Agreement.<br />

Claim Procedures: YOU MUST OBTAIN AUTHORIZATION PRIOR TO REPLACEMENT OF ANY TIRE, AND/OR PRIOR TO<br />

ANY REPAIR OR REPLACEMENT OF ANY WHEEL. For authorization and instructions please call the Administrator, NIU of<br />

repairs must be effected, You may obtain instructions and a proof of loss form online at www.niufl.com. All after-hours instructions<br />

must be followed in order to receive reimbursement. Alternatively, subsequent to after hours repairs/replacements, You may call NIU<br />

of Florida, Inc. at 888-684-9327 the next business day to report Your claim; (2) You must complete and return the proof of loss form<br />

<strong>with</strong>: the original, paid, repair invoice, legible copies of the front and back of Your Agreement, a legible copy of Your Vehicle<br />

purchase order or finance agreement and photos of the damaged tire(s) and/or wheel(s). IMPORTANT: Please note that alloy wheel<br />

damage can oftentimes be repaired. In the event that damaged wheels are replaced, Your repair facility must document the reasons<br />

why wheel repair was not possible. They should then attempt to obtain a remanufactured wheel to replace the damaged wheel.<br />

PROGRAM guidelines & vehicle eligibility<br />

Vehicle Eligibility:<br />

To be eligible for coverage the vehicle must be listed as an eligible vehicle in the Vehicle Eligibility Guide. All trucks or vans are limited to a<br />

gross carrying weight of one ton (15,000 lbs GVW).<br />

Plan Qualification:<br />

January 1st shall be the model year change for determining eligibility. The vehicle must be 15 model years or newer and have less than<br />

200,000 miles on the odometer at the time of sale.<br />

Plan Term:<br />

Coverage starts on the Contract Effective Date and will expire upon reaching the Contract Expiration Date.<br />

b. Vehicles altered or modified in a fashion not recommended by the manufacturer, including installation of high performance equipment, lift<br />

or lowering kits, incorrect tires/wheels or removal of any emission devices<br />

c. Vehicles that are Kits Cars; High Performance, Exotic or Special Purpose, Engines Over 8 Cylinders, Alternative Fuel (Natural Gas, LP<br />

All eligible vehicles must be 15 model years old or newer and have less than 200,000 miles <br />

Excluded Vehicles: Vehicles used for commercial towing, dump or refuse collection, hauling, <br />

taxi, livery, shuttle, rental, equipped <strong>with</strong> a snow plow, construction, racing or competitive <br />

driving, or emergency services are not eligible for coverage. Vehicles having multiple drivers <br />

are not eligible for coverage.<br />

Note: Surcharge is required in order to make the vehicle eligible for any coverage. The surcharge provides <br />

1. DEFINITIONS<br />

TERMS AND CONDITIONS<br />

Throughout this Vehicle Service Contract certain words and phrases are used that have special meanings. These terms appear in boldface type. Their meanings<br />

are listed below:<br />

Activation Period: means thirty (30) days from the original Contract Activation Date in which You can review this Contract.<br />

Actual Cash Value (ACV): shall be the “average trade-in” value for the Vehicle, adjusted for mileage as shown in the then-current N.A.D.A. Official Used Car<br />

Guide.<br />

Administrator: refers to Dimension Service Corporation, 5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888)705-8943.<br />

Aggregate Limit of Liability: means the amount of benefits allowed during all Renewed Terms.<br />

Breakdown: refers to the inability or failure of any Covered Part to perform the function for which it was intended by the manufacturer through the normal use of<br />

Your Vehicle.<br />

Contract, Service Contract, Vehicle Service Contract: refers to this Vehicle Service Contract which You have purchased from the Seller to protect Your<br />

Vehicle.<br />

Contract Activation Date: means the initial date of Contract purchase by You. A thirty (30) day AND one thousand (1,000) mile waiting period begins on this<br />

date, during which no claims may be filed.<br />

Contract Activation Payment: payment received by the Administrator to activate Contract coverage.<br />

Contract Renewal Date, Renewal Date: means the date on which the Contract Renewal Payment is due and Contract renewed for an additional subsequent<br />

thirty (30) day Contract Renewal Term.<br />

Contract Renewal Payment, Renewal Payment: the amount due to process the renewal of Your Contract. This amount is subject to change, but You will be<br />

provided sixty (60) days notice in advance of any changes.<br />

Contract Renewal Term, Renewal Term: a period of thirty (30) days subsequent to the original Activation Period or the previous Renewal Term beginning from<br />

Renewal Date and upon receipt of Renewal Payment. There is no waiting period for a Renewal Term.<br />

Covered Component: any part or component listed as covered in Section 6. WHAT IS COVERED.<br />

Declaration Page: means the document that is attached to and forms part of this Vehicle Service Contract. It lists information regarding You, Your Vehicle,<br />

coverage selected and other vital information.<br />

Deductible: means the amount You must pay, as shown on the Declaration Page, per repair visit in the event of a Breakdown.<br />

Exclusionary Coverage: refers to the coverage afforded by this Contract from purchase up until Your Vehicle has reached seventy-five thousand (75,000)<br />

odometer miles. This coverage includes all parts and/or components of Your Vehicle unless specifically listed under Section 9. WHAT IS NOT COVERED.<br />

Lifetime Engine Coverage: refers to the coverage afforded by this Contract after Your Vehicle has exceeded 200,000 miles up until all coverage expires as<br />

prescribed under Section 2. CONTRACT TERM. Only the parts and/or components specifically listed are covered.<br />

Named Component Coverage: refers to the coverage afforded by this Contract after Your Vehicle has reached seventy-five thousand (75,000) odometer miles or<br />

up until all coverage expires as prescribed under Section 2. CONTRACT TERM. Only the parts and/or components specifically listed are covered.<br />

Repair Facility: refers to the Repair Facility that is, has or will be performing repairs to Your Vehicle. Such facility must be licensed and/or approved by the state<br />

to perform automotive repairs. Such facility must work <strong>with</strong>in labor rates and times as approved by the Administrator. Such facility must have a tax identification<br />

number, where required, and be capable of performing the needed repairs to Your Vehicle.<br />

Seller: refers to the entity from whom You purchased this Contract.<br />

Vehicle: refers to the Vehicle covered by this Contract as described on the Declaration Page of this Contract.<br />

We, Us, Our, Provider: refers to Autoguard Advantage Corporation (5500 Frantz Road, Suite 100, Dublin, Ohio 43017, (888) 705-8943) the entity that is obligated<br />

to perform under this Contract.<br />

You, Your, His/Her, Contract Holder: refers to the person named on this Contract as the purchaser of this Contract.<br />

2. CONTRACT TERM<br />

This Contract shall be in effect as of the date the Contract was purchased from the Seller, provided this Contract is accepted by Us, and shall continue in effect<br />

until cancelled, terminated, non-renewed, voided (except in Arizona) or the Limit of Liability has been reached. UPON CONTRACT ACTIVATION THERE IS A<br />

THIRTY (30) DAY AND ONE THOUSAND (1,000) MILE WAITING PERIOD BEFORE COVERAGE BEGINS. Any Breakdown which occurs during the waiting<br />

period will not be covered.<br />

We reserve the right to refuse, cancel, terminate or void any Contract which does not meet Our underwriting guidelines (except in Arizona), is submitted <strong>with</strong><br />

insufficient payment or if You make a material misrepresentation in obtaining this Contract or in the submission of a claim. We further reserve the right to not renew<br />

Your Contract at any time for any reason. If We choose to do so, You will be given thirty (30) days notice in advance of non-renewal. Payments scheduled after the<br />

non-renewal date will not be processed, or if already processed will be refunded immediately.<br />

Renewal Process:<br />

Upon acceptance by Us of the Renewal Payment upon each Renewal Date, this Contract will renew monthly for a subsequent thirty (30) day Renewal Term. All<br />

coverage will cease if the Aggregate Limit of Liability has been reached or upon non-renewal of Your Contract by You at any time (this may include a failure to<br />

collect the Renewal Payment due to any reason, either voluntary or involuntary).<br />

We will attempt to process each Renewal Payment no later than ten (10) calendar days prior to the scheduled Renewal Date to allow time for notification<br />

and/or update to Your payment information on file to be processed. If the Renewal Payment is collected by the Administrator on or before the Renewal<br />

Date, Renewal Term will be in effect; otherwise, the Contract will terminate at the end of the current Renewal Term.<br />

Purchase of this Vehicle Service Contract represents an authorization for a recurring charge to a credit card or debit of a bank account via electronic funds<br />

transfer which You provided Us. So that We may accurately process Your payments, it is Your responsibility to ensure that We have the correct account and billing<br />

information at all times.<br />

Should You change this information, or Your contact information (including phone number or email address), it is Your responsibility to notify Us in writing of the<br />

change immediately to avoid payment interruption and lapse in coverage. Coverage must continue <strong>with</strong>out any lapse in payment or this Contract will not renew,<br />

and all coverage will cease. If coverage is terminated or not renewed, We will not reinstate Your coverage.<br />

3. LIMITS OF LIABILITY<br />

For this Contract, the maximum Aggregate Limit of Liability is the lesser of Actual Cash Value at the time of Breakdown or $12,500.<br />

Once the Aggregate Limit of Liability has been reached, this Contract and its cancellation rights terminate, and no further claims can be made against Us. We<br />

shall not be responsible for lost time, wages, lost use or any other consequential or incidental damages. These limitations and exclusions of liability apply only to the<br />

extent allowed by law.<br />

4. OTHER SERVICE CONTRACTS, WARRANTIES OR INSURANCE POLICIES<br />

The term of this Contract may include a portion of the term of the manufacturer’s warranty issued to the original purchaser of the Vehicle. Coverage under this<br />

Contract is secondary to, and does not replace, the manufacturer’s warranty, but may provide certain additional benefits during the term of the manufacturer’s<br />

warranty. If more than one service contract, warranty or insurance policy can be applied to a Breakdown, coverage under this Contract shall be in excess over all<br />

other coverage, whether valid or collectible, except for benefits that may be applicable under Section 7. ADDITIONAL BENEFITS of this Contract.<br />

5. OUR OBLIGATIONS<br />

If You experience a Breakdown during the term of this Contract <strong>with</strong>in the United States or Canada, the We will pay the Repair Facility or reimburse You for the<br />

repair or replacement of the Covered Part(s) as described in this Contract, provided You have met Your obligations as stated in this Contract (see Section 10.<br />

WHAT TO DO IN THE EVENT OF A BREAKDOWN and Section 11. CONTRACT HOLDER’S OBLIGATIONS) and if the repair is not excluded under Section 9.<br />

WHAT IS NOT COVERED of this Contract. Replacement parts will be of like kind and quality and may include the use of new, remanufactured, rebuilt or<br />

serviceable used parts at the sole discretion of the Administrator. Labor time for any repair shall be based on the then-current All-Data labor guide and labor rates<br />

shall be <strong>with</strong>in accepted industry standards at the sole discretion of the Administrator. Additionally, the Administrator reserves the right to determine acceptable<br />

parts costs, in its sole discretion.<br />

6. WHAT IS COVERED<br />

If Your Vehicle has fewer than seventy-five thousand (75,000) odometer miles at the time of Breakdown, We will pay the Repair Facility or reimburse You for a<br />

stated in this Lifetime Engine Coverage ceases once this Contract is not renewed.<br />

7. ADDITIONAL BENEFITS<br />

Additional Benefits are included <strong>with</strong> all plans. No deductible applies to Additional Benefits.<br />

Rental Reimbursement: In the event of a Breakdown covered by this Contract, We will pay or reimburse You for receipted expenses to rent a replacement<br />

vehicle (from a licensed rental agency) while Your Vehicle is at a Repair Facility. Coverage will be provided to You up to a maximum of forty dollars ($40) for<br />

every eight (8) hours or portion thereof of approved labor time to complete the covered repair <strong>with</strong> a five (5) day maximum, not to exceed two hundred dollars<br />

($200). You must submit receipts to the Administrator for reimbursement. This coverage does not apply to service or parts delays or other time delays beyond Our<br />

control or that of the Repair Facility.<br />

Trip Interruption (Available Only Where Allowed By Law): If You experience a Breakdown which occurs more than one hundred (100) miles from Your home<br />

and results in a Repair Facility keeping Your Vehicle overnight, We will reimburse You for receipted motel and meal expenses not to exceed seventy-five dollars<br />

($75) per day for up to three (3) days and a maximum benefit per occurrence of two hundred twenty-five dollars ($225).<br />

8. MANDATORY SURCHARGES<br />

Business Use Vehicle: a surcharge is required if Your Vehicle is used for repair work, service work, route work and delivery work (ex: floral delivery, cable TV<br />

repair, plumber, vending machine attendant, catering company, medical supply delivery, home repairs, realtor, etc.). Vehicles used for farm use or oil field work are<br />

eligible provided their primary use is for transportation purposes and not used at any time for excessive hauling and/or off-road pasture or field work. Coverage is<br />

limited to single use drivers.<br />

Vehicles used for commercial towing, dump or refuse collection, hauling, taxi, livery, shuttle, rental, equipped <strong>with</strong> a snow plow, construction, racing or competitive<br />

driving, or emergency services are not eligible for coverage. Vehicles having multiple drivers are not eligible for coverage.<br />

Selection and purchase of the surcharge is required in order to make the Vehicle eligible for any coverage, provides basic eligibility only, and does not add any<br />

additional coverage to this Contract.<br />

24-Hour Roadside Assistance<br />

When arranging for Roadside Assistance, please reference Your Producer Code and Contract Number (located on the front of this form). You<br />

will not be required to pay any additional fee or sum in addition to the contract fee when Your service is for a tow of up to twenty five (25)<br />

miles or other covered service listed below. You are entitled to one (1) free service <strong>with</strong>in a seventy two (72) hour period. Covered services<br />

Windshield Repair Protection<br />

Covers the cost of repairs to the front windshield ONLY of minor chips and cracks caused by propelled rocks or other propelled road debris.<br />

Tire and Wheel (Rim) Road Hazard Protection<br />

This Agreement provides for the repair or replacement of the Vehicle's tires and wheels, which during the term of this Agreement become<br />

Unserviceable due to a Road Hazard. Unserviceable means that the tire(s) has been punctured or otherwise damaged to the extent that it is<br />

unsafe, or that the wheel will no longer hold a seal <strong>with</strong> its tire. Tire and/or wheel damage that is cosmetic in nature and that does not render<br />

the tire and/or wheel Unserviceable is specifically excluded. A Road Hazard is a condition on a public roadway, which should not exist<br />

there, such as potholes, nails, glass, or other road debris.<br />

Flat Tires: You will be reimbursed up to thirty dollars ($30) for the reasonable costs You incur to repair a flat tire caused by a Road<br />

Hazard while operating the Vehicle on public streets and in a legal manner.<br />

Tire Replacement: You will be reimbursed up to two hundred fifty dollars ($250) for the reasonable costs You incur to replace a tire, only<br />

if a tire covered by this Agreement becomes unrepairable due to damage caused by a Road Hazard. Replacement will be made <strong>with</strong> a tire<br />

of like kind and quality to the original tire. You will be required to pay a deductible of fifty dollars ($50) at the time service is<br />

rendered.<br />

Wheels (Rims): You will be reimbursed up to four hundred dollars ($400) for the repair or replacement of wheels rendered Unserviceable<br />

due to a Road Hazard covered under this Agreement. We reserve the right to have damaged wheels repaired at Our cost by a service<br />

provider of Our choosing. We further reserve the right to replace the damaged wheel at Our cost <strong>with</strong> a remanufactured wheel of like kind<br />

and quality to the wheel that was damaged by the covered Road Hazard. We will cover wheel replacement only in the event that the<br />

damaged wheel cannot be repaired. You will be required to pay a deductible of fifty dollars ($50) at the time service is rendered.<br />

Mounting and Balancing: You will be reimbursed for the reasonable costs that You incur for mounting, balancing, valve stems, and tire<br />

disposal for any tire replaced under this Agreement. However, charges for pressure sensing devices and unspecified charges for shop<br />

supplies are excluded.<br />

Taxes: You will be reimbursed for the cost of local and state taxes, as directed by state agencies for any tire or wheel replaced under this<br />

Agreement.<br />

Limit of Coverage: The maximum aggregate provided for either tire or wheel replacement on this Agreement will be the amount per each<br />

item as stated below times the number of tires on the Vehicle (i.e. Automobile: $250 per tire x 4 tires = $1,000).<br />

Agreement Holder Responsibility: You must maintain proper air pressure in all covered tires. Tires should be checked monthly for proper<br />

pressure, signs of dry rot, improper wear, and tread depth less than 3/32". Any conditions that cannot be corrected demands replacement for<br />

the safety of the Vehicles occupants. Replaced tires are covered for the time remaining on the Agreement.<br />

Claim Procedures: YOU MUST OBTAIN AUTHORIZATION PRIOR TO REPLACEMENT OF ANY TIRE, AND/OR PRIOR TO<br />

ANY REPAIR OR REPLACEMENT OF ANY WHEEL. For authorization and instructions please call the Administrator, NIU of<br />

Florida, Inc., at 888-684-9327 Monday through Friday from 9 a.m. to 8 p.m. eastern time. A proof of loss form will be provided which<br />

You MUST complete and return to NIU of Florida, Inc. at 800 Yamato Road, Suite 100, Boca Raton, Florida 33431 <strong>with</strong>in thirty (30)<br />

days along <strong>with</strong> the following documentation: 1) Front and back copy of this Agreement; 2) Original replacement or repair invoice<br />

which must reflect: a) The tread depth of the damaged tire; b) Whether or not the damaged tire or wheel was repairable, and if not,<br />

why not; c) Whether or not the damage was due to a manufacturer's defect; and 3) Any other information that the Administrator<br />

reasonably requests.<br />

In the event that both the tire and/or wheel damage occurs after the Administrators regular business hours, or on a weekend, and<br />

repairs must be effected, You may obtain instructions and a proof of loss form online at www.niufl.com. All after-hours instructions<br />

must be followed in order to receive reimbursement. Alternatively, subsequent to after hours repairs/replacements, You may call NIU<br />

of Florida, Inc. at 888-684-9327 the next business day to report Your claim; (2) You must complete and return the proof of loss form<br />

<strong>with</strong>: the original, paid, repair invoice, legible copies of the front and back of Your Agreement, a legible copy of Your Vehicle<br />

purchase order or finance agreement and photos of the damaged tire(s) and/or wheel(s). IMPORTANT: Please note that alloy wheel<br />

damage can oftentimes be repaired. In the event that damaged wheels are replaced, Your repair facility must document the reasons<br />

why wheel repair was not possible. They should then attempt to obtain a remanufactured wheel to replace the damaged wheel.<br />

NOTE: THE ADMINISTRATOR RESERVES THE RIGHT TO INSPECT ANY DAMAGED TIRE AND/OR WHEEL PRIOR TO<br />

NoGAP HAS NO CAP ON OVER ADVANCES: Other GAP products calculate total losses from 100% up to a <br />

maximum of 150% of the MSRP/NADA valuation regardless of the amount borrowed.<br />

NoGAP COVERS UP TO $1,000 OF THE CUSTOMER'S PRIMARY INSURANCE DEDUCTIBLE: Others may only cover <br />

$250 to $500 of the customer's primary insurance deductible. Many people are utilizing higher deductibles in <br />
