We are market leaders in hotel valuations with a team of<br />

20 specialists, who value and advise on over £10 billion<br />

worth of properties per annum. Our market coverage<br />

ranges from single properties to large portfolios, working<br />

department advises a wide range of public bodies<br />

including local and district authorities, development<br />

agencies and government departments.<br />

The team is dedicated to advising public sector clients<br />

and has an in depth understanding of the requirements<br />

of the sector.<br />

The team has 14 chartered surveyors including three<br />

dual qualified surveyors and chartered town planners<br />

experienced in providing regeneration and development<br />

consultancy, strategic estates advice and accommodation<br />

studies. Within the team we have in-depth valuation;<br />

landlord and tenant; land disposal and compensation<br />

skills. Our professional advice covers a wide diversity<br />

of buildings and land within public ownership, and our<br />

value where land and property is to be transferred between<br />

compulsory purchase orders to support negotiations<br />

As part of our development consultancy role, we regularly<br />

undertake valuations both within and outside the<br />

provisions of the RICS Red Book to determine the value of<br />

sites owned by the public sector, both on an existing use<br />

and development value basis. These reports are usually<br />

required to inform a land disposal, or to test proposed<br />

schemes on a wider area basis as part of a masterplan,<br />

feasibility study, or formal planning document, such as an<br />

gives advice on all aspects of applications to<br />

extend leases or to buy the freehold of houses<br />

or blocks of flats.

The Rights available<br />

The leasehold reform legislation provides for three<br />

principal different rights:<br />

1) If you are the owner of a flat, we can advise you how to<br />

extend your lease by 90 years at a nil ground rent<br />

2) If you are the owner of a house, we can advise you how<br />

to buy your freehold<br />

3) If you live in a block of flats and a majority of the<br />

leasees want to buy the freehold<br />

Extending the lease of your flat<br />

This is governed by the Leasehold Reform, Housing<br />

and Urban Development Act 1993, as amended by the<br />

Commonhold and Leasehold Reform Act 2002.<br />

Qualification<br />

In order to qualify, you must have a lease which, when it<br />

was granted, was for a term of over 21 years. It does not<br />

matter how long now remains. You must have owned this<br />

lease for a minimum period of two years.<br />

Procedure<br />

In summary, you serve a Notice on the freeholder, stating<br />

a realistic figure which you are prepared to pay for the<br />

lease extension. The freeholder replies with a Counter-<br />

Notice which will put forward the price at which he is<br />

prepared to sell. There is then a period for negotiations.<br />

If an agreement is not reached, the matter is referred to a<br />

leasehold valuation tribunal for the tribunal to determine<br />

the figure.<br />

Buying the freehold of your building<br />

Again, this is governed by the Leasehold Reform, Housing<br />

and Urban Development Act 1993 (as amended).<br />

Qualification<br />

The building must be a qualifying block (self-contained<br />

unit) consisting of at least 2 flats held by qualifying<br />

tenants. A qualifying tenant is an individual or a company<br />

who holds a long lease (defined as being one granted for<br />

a term in excess of 21 years). There is no minimum period<br />

of ownership and you do not have to occupy the flat, which<br />

can be let. In order to proceed, at least one half of the total<br />

number of qualifying tenants in the building must agree to<br />

participate in a claim.<br />

Procedure<br />

The procedure is broadly the same as for extending an<br />

individual lease except of course the notice is served by the<br />

nominee purchaser instead of the individual leaseholder.<br />

Buying the freehold of your house<br />

This is governed by the Leasehold Reform Act 1967.<br />

as amended.<br />

Qualification<br />

In order to qualify, the building must be “a house”. You<br />

must have owned the lease for a minimum period of 2<br />

years. You no longer have to have lived in the house as<br />

your main home, so the lease can be in the name of a<br />

company and the house can be let.<br />

Procedure<br />

The process is started by serving a Notice on the freeholder<br />

and any head leaseholder. This fixes the valuation date.<br />

The freeholder replies with a Counter-Notice, usually 2<br />

In an ever changing world, trying to keep up to date with<br />

the value of an asset can be a difficult task. Yet it is this<br />

value that is often fundamental in determining personal<br />

plans and proposals. Ensuring that this valuation is<br />

accurate and can be trusted is essential and at <strong>Knight</strong><br />

<strong>Frank</strong> LLP this is achieved by active support and liaison<br />

between teams, including Residential Research,<br />

Information Services, Planning, Building Consultancy,<br />

Leasehold Reform and Development. Whatever the issue,<br />

there is up to date and integrated information and advice,<br />

honestly given.<br />

These issues will be various but may include:<br />

� Loan security – valuations for mortgage purposes. We<br />

operate for the vast majority of High Street and Private<br />

Banks providing RICS “Red Book” compliant reports in<br />

a bank approved format. These are detailed reports in<br />

order to aid the bank in making their lending decision.<br />

� Asset Purposes – whether for the Charities Act,<br />

Company or Public Accounts or for internal transfer<br />

purposes the value of the asset will be a fundamental<br />

requirement.<br />

� Taxation – for Capital Gains Tax, Inheritance Tax or to<br />

provide asset values for overseas taxation, taking in to<br />

account recent case law and precedent. We will also<br />

carry out any necessary negotiation with the Inland<br />

Revenue or appointed Valuation Officer for HMRC.<br />

� Litigation – whether for negligence, contract,<br />

compensation or matrimonial purposes we provide<br />

reports for court purposes which are for the guidance<br />

of the court and are CPR compliant. These can be<br />

single, joint or party appointed.<br />

� Purchase – advice on purchase to include Building<br />

Surveys and Home Buyer Reports in order to assess<br />

the structural integrity and maintenance requirements<br />

of a building.<br />

� Trust – for personal trust purposes, tax assessments<br />

and planning.<br />

� Compensation – for Blight purposes, Compulsory<br />

Purchase due to road or rail schemes, pipeline or<br />

telecoms claims.<br />

� International – we have dedicated teams on both<br />

residential and commercial sides of the business able<br />

to provide valuation assessments across the globe.<br />

� Agricultural – a specialised team dealing only with the<br />

formal valuation of farms and estates and up to date<br />

with rural issues and statute.<br />
