Hysni Hoxha- President of the PRBSubject: NotificationEconomic operator “Ripten Enginering” with residence in Prishtina, asdissatisfied party on the 10.07.20<strong>12</strong>, has lodged a complaint with protocolno.<strong>178</strong>/<strong>12</strong> in the Procurement Review Body, regarding the procurement activityfor the tender “Supply with protection equipment at work” with procurementno.ST/<strong>12</strong>/078/<strong>12</strong>1, initiated by the contracting authority-Trepqa-Enterprise inAdministration of the AKP, claiming that contracting authority has violated thearticle 6, 7, 27, 28, 59 and 60 of the LPP.Procurement Review Body after the receipt of the complaint, based in thearticle 113 and article 114 of the LPP no.04/L-042, has authorized theprocurement review expert to review the procurement activity “Supply withprotection equipment at work”, as well the validity of all complaining claims ofthe complaining party EO “Ripten Engineering” from Prishtina.Review expert on the 23.07.20<strong>12</strong> has submitted the expertise’s report, hasascertained that examination, evaluation and comparison of the tenders wasn’tperformed conform the article 59 of the LPP, therefore proposes the review panelto approve as grounded the complaint of the complaining EO and the case isreturned for re-evaluation.On the 23.07.20<strong>12</strong>, contracting authority-Trepqa-Enterprise inAdministration of AKP and complaining EO “Ripten Enginering”, electronicallywas sent the expertise’s report of the review expert, for the procurement activity“Supply with protection equipment at work” with procurementno.ST/<strong>12</strong>/078/<strong>12</strong>1.Contracting authority-Trepqa-Enterprise in Administration of AKP,through memo with protocol no.<strong>178</strong>/<strong>12</strong> of the 24.07.20<strong>12</strong>, has notified the reviewpanel given in the expertise’s report of the review expert of the 23.07.20<strong>12</strong>. Aswell also the complaining economic operator through memo with protocol
no.<strong>178</strong>/<strong>12</strong> of the 24.07.20<strong>12</strong>, has notified the review panel that agrees with theopinion of the review expert given in the expertise’s report.Procurement Review Body, notifies the contracting authority that conformarticle 115 point 3 of the LPP, the complaint’s procedure ends in this phase.Contracting authority- Trepqa-Enterprise in Administration of AKP, it is orderedthat during the process of re-evaluation of the bids must restrain to the selectioncriterions mentioned in the tender dossier, as well criterion for contract award“The accountable tender with the lowest price”.Procurement Review Body, requests from contracting authority that forthe process of re-evaluation of the bids to establish another professionalcommission, and within the deadline of 15 days to inform in written the Reviewpanel for undertaken measures regarding this procurement activity.Complaining economic operator “Ripten Engineering”, conform article118 point 3 it is returned the insurance fee of the complaint in the sum of 500.00Euros (five hundred Euros).
