Maracaibo,Venezuela 2006. p. 136RESUMENEl nuevo constitucionalismo procesal venezolano cristaliza la i<strong>de</strong>a e intenciónque en todo momento tuvo el legislador patrio <strong>de</strong> crear una jurisdicción y unprocedimiento especial que dirimiera los conflictos individuales <strong>de</strong> trabajo;hasta hace poco regulados por la Ley Orgánica <strong>de</strong> Tribunales y <strong>de</strong>Procedimiento <strong>de</strong>l Trabajo, el Código Civil y el Código <strong>de</strong> Procedimiento Civil,caracterizados por ser lentos, pesado, excesivamente escrito, formalista,mediato, oneroso y no obsequioso para nada a la justicia. Imponiendocambios radicales orientados por los principios <strong>de</strong> oralidad, inmediación,concentración, simplicidad, celeridad y gratuidad; procurándole ampliospo<strong>de</strong>res al juez, como director y sujeto principal <strong>de</strong>l proceso, aparte <strong>de</strong>substanciales e importantes iniciativas probatorias. Es con la promulgación<strong>de</strong> la estrenada Ley Orgánica Procesal Laboral que el Estado, apuesta agarantizar el buen funcionamiento y la eficacia <strong>de</strong> una jurisdicción autónomay especializada con normas y principios propios que rigen todas y cada unas<strong>de</strong> las distintas etapas <strong>de</strong>l proceso y muy especialmente <strong>de</strong> la faseprobatoria sobre la que no existía regulación alguna en materia <strong>de</strong> medios <strong>de</strong>prueba y su valoración; y por tanto, estrictamente sometida a la leyOrdinaria Civil, lo que se traducía en una limitación en cuanto a los mediosprobatorios <strong>de</strong> que podían valerse tanto el juez como las partes y unamarcada falta <strong>de</strong> libertad en el juez para la apreciación <strong>de</strong>l materialprobatorio, quien <strong>de</strong>bía restringirse al obsoleto sistema <strong>de</strong> la prueba legal otarifada.De tal forma que, <strong>de</strong> lo expuesto surge una interesante proposición<strong>de</strong> realizar un análisis comparativo entre el antiguo proceso laboral y elrecientemente instituido a partir <strong>de</strong> Agosto <strong>de</strong> 2.003; concretamente <strong>de</strong>lrégimen probatorio, etapa esta, que introduce un nuevo y audaz diseño <strong>de</strong>forma, lugar y tiempo, cargado en opinión <strong>de</strong> muchos laboralistas <strong>de</strong>inconcebibles errores imprecisiones, contradicciones y vacíos.Palabras claves:Principios, Fase Probatoria, Pruebas, Apreciaciónmedinayaa@hotamil.com

Maracaibo,Venezuela 2006. p. 136ABSTRACThe new Venezuelan procedural constitutionalism crystallizes the i<strong>de</strong>a andintention that always had had the fatherland’s legislator to create ajurisdiction and a special procedure to resolve the individual’s labour relationconflicts; until recently regulated by the Statutory law of Courts andProcedure of the Work, the Civil Co<strong>de</strong> and the Co<strong>de</strong> of Civil Procedures,characterized by being slow, heavy, excessively written, formalist, expensiveand for nothing generous with the justice. Imposing radical changes orientedby the orality principles, immediacy, concentration, simplicity, celerity andgratuity; grating ample powers to the judge as the director and maincharacter of the process, asi<strong>de</strong> from substantial and important probatoryinitiatives.It is with the promulgation of the released The procedural OrganicLaboural Law that the State, bids to guarantee the good operation and theeffectiveness of an in<strong>de</strong>pen<strong>de</strong>nt and specialized jurisdiction with norms andown principles that govern all and each of the different stages of the processand very specially of the probatory phase on which did not use to exist anyregulation in the matter of means of proof and their valuation; and therefore,strictly subjected to the ordinary Civil Law, which was translated into alimitation regarding the probatory means which could be used by the judgeas much as the parts and a marked lack of freedom in the judge for theappreciation of the probatory material, who had to self restrict to theobsolete system of the legal or priced proof.Of such form that, from theexposed thing arises an interesting proposal to make a comparative analysisbetween the old labour process and recently instituted since August 2.003;concretely of the probatory regime, stage this, that introduces a new andaudacious <strong>de</strong>sign of form, place and time, loa<strong>de</strong>d in the opinion of manylabour specialists of inconceivable mistakes, impreciseness, contradictionsand emptiness.Key Words: Principles, Stage Probatory, Prove, Appreciation.medinayaa@hotmail.co
