That the personnel to be assigned to the FIRST PARTY should possess the appropriateexperience, technical skills and competencies required for the job; he should also bementally, emotionally and physically fit, of good moral character and reputation, honest,hardworking, cooperative and with positive disposition. The FIRST PARTY may ask forreplacement of the assigned janitor should he fail to meet the requirements for the job.3. That the SECOND PARTY shall provide the FIRST PARTY copy of the most recentNBI, Police and Court Clearances and Medical Certificate of the janitor to be assigned tothe FIRST PARTY.4. That the janitor to be assigned by the SECOND PARTY to the FIRST PARTY is anexclusive employee of the SECOND PARTY and that there is no employee-employerrelationship between the janitor and the FIRST PARTY. In view of such employmentrelations, itre SECOND PARTY hereby agrees to comply with the labor Code of thePhilippines and suchrelated laws bearing on emplopnent, including minimum wage, workmen'scompensation, employer's liability, SSS, Philhealth coverage, PAG-IBIG Fund, incometax payment, permit fees and other requirements necessary for the execution of work.5. That the SECOND PARTY shall regularly supervise, monitor and discipline its janitor,taking into consideration the rules, policies and regulations of the FIRST PARTY. to the FIRST PARTY insofar as work implementation and adherence to the office rules,policies and regulations are concemed.6.7.8.9.l0That the SECOND PARTY shall not hold the FIRST PARTY responsible for anyliability, suit, action, demand or cost of fees on account of death, and/or injuries arisingfrom the performance of the duties and responsibilities of the janitor assigned to thelatter.That the SECOND PARTY shall assume responsibility for any and all acts or omissionscommitted or allowed to be committed by the assigned janitor, resulting in the loss ordamage to any of the property of the FIRST PARTY and its employees.That the FIRST PARTY shall determine the number of janitors to be assigned to itsoffica, and upon written notice, may increase or decrease its personnel, or may requestfor relief or replacement, anytime and for whatever reason.That the SECOND PARTY, upon request of the FIRST PARTY, shall provide additionaljanitors to the latter to be assigned to its Regional Office/s outside of Davao City.That the SECOND PARTY shall submit to thE FIRST PARTYremittance of SSS, Philhealth, PAG-IBIG Fund and ECC premiumweek of the month after quarterly payment.a copy of proof ofnot later than the 3'd11.That the general conditions and requirements enumerated in the bid proposal and suchother rules and regulations applicable hereto, including those found in the submitted postqualification documents are acknowledged by the parties as part of this confract.12.That the scope of work contemplated in this Contract shall include daily maintenance andcleaning of the entire area occupied by the FIRST PARTY, viz:DAILY ROUTINE OPERATIONS1.2.Sweeping, mopping, spot scrubbing and polishing of floors, stairways and alleysCleaning, disinfecting, sanitizing and deodorizing of all the washrooms includingtoilet bowls, urinals and lavatoriesDusting and cleaning of all glass tops, inside windows, window ledges, pieces offurniture, fixture, equipment and partitions4, Washing utensils5. Dusting and cleaning of horizontal and vertical surfaces, ceiling and walls6. Disposal of trash from the confines of the building to receptacles provided for thispurpose, and other related duties7. 13. That in accordance with the schedule of the operations, the general cleaning of the FIRSTPARTY's premises shall be performed once a month, on a Saturday. It shall cover thefollowing:a. Removing of stubborn dirt and stainb. Polishing of floorc. Wiping of walls, partitions and glass windowsd. Wax stripping and waxing of floorse. Shampooing of carpetsf. Cleaning and disinfecting comfort roomsg. Planting and replanting of ornamental plantsh. Vacuum cleaningi.
