Airline schedules may alteroccasionally causing a change to your flight timings and actual flight times will be confirmed onyour flights tickets. In the event of any major changes we will try to advise you as soon as wehave details.Some flights may need to stop en-route. Where we know about this in advance we will adviseyou and this will be highlighted on your travel documentation. This does not include flights and transfers.Where you have booked a boat only with Sunsail you will be sent an invoice which will detailyour boat only price and other mandatory costs associated with chartering a boat from Sunsailand any additional extras.Advance RegistrationWe may be able to advance register your holiday request before the release of airline schedulesand relevant yacht fleet. Requests that are made more than 11 months in advance are subjectto flight availability and prices. When you make a request you will be asked to pay a holdingfee, however, neither party is legally bond to a contract until the booking and prices areconfirmed and either party can withdraw without penalty up until the booking is confirmed.Once the fleet, airline schedule and or committed flight program is confirmed you will be givena priority option to book and advised accordingly of the yacht, airline, flight times and day ofdeparture. If you confirm the booking, the holding fee will be transferred to a deposit. Shouldthe final program not be suitable you can withdraw with a refund of the holding fee or you canmove the holding fee to a deposit on an alternative holiday with Sunsail with no amendment feecharged. An invoice will be issued once flights and or yacht has been confirmed.Late BookingsThis is a late holiday booked within 10 weeks of departure. Prices are set according to demandand may differ from any published price you may have seen. To guarantee the price advertisedthat day you must pay in full and provide all names and airline advanced passenger informationas required at time of booking. We can not accept a Late Booking without this information.A late booking fee will be charged for all bookings made within 14 days of departure to coveradministrative costs that are occurred for ticketing. The person making the booking (the ‘lead name’) must be 18years old or over and possess the legal capacity and authority to make the booking and acceptsthese booking conditions on behalf of everyone in their party. You will be expected to pay a depositat time of booking of 25% per person for a Sunsail Flight Inclusive Package Holiday and 25% whenbooking a Sunsail Boat Only Holiday. You may also be required to pay in full for any additionalpurchases such as flights and transfers. If you are booking within 10 weeks of departure full paymentmust be made. If we accept your booking, we will issue a Confirmation Invoice. A contract will existbetween us from the date we issue the Confirmation Invoice or if you book within 7 days of departurethe contract will exist when we accept your payment. When you receive the Confirmation Invoiceplease check the details carefully and inform us immediately if anything is incorrect.Once a booking has been confirmed, offers and discounts cannot be applied retrospectively. Thebalance of the price of your holiday must be paid at least 70 days (10 weeks) before your departuredate. If the balance is not paid in full by 10 weeks we will retain your deposit and cancel the booking.If you book through an agent, all contact with you will be via them.Any payment made by credit card will be subject to a 2.5% including VAT (capped at £50 pertransaction). We will not accept payment by cheque. There is no charge for debit cards.Names on travel documents must exactly match those in your passports. Unless we are responsiblefor the mistake, we will not accept liability if an airline or other supplier refuses boarding because thename(s) shown in your passport differ from those on your ticket. The prices are a guide price only and show the minimum available forSunsail Flight Inclusive Package Holidays and for Sunsail Boat Only Holidays shows prices by boattype and per person. You will be charged for the amountover and above that, plus an administration charge of £1.00 per person together with an amount tocover any agents’ commission. If this means that you have to pay an increase of more than 10% ofthe price of your travel arrangements, you will have the option to change to another holiday if we areable to offer one. If this is of equivalent or higher price you will not have to pay more but if it is of lowerprice you will be refunded the difference for increases of more than 10%, or cancel and receive a fullrefund, less for any amendment charges.Should you decide to cancel for this reason, you must exercise your right to do so within 14 daysfrom the issue date printed on your final invoice. Should the price of your holiday go down due to thechanges mentioned above by more than 2% of your holiday cost, then any refund due will be paidto you. Occasionally we may need to make a major change which includes, but is not limited to the following:a) A change of your UK departure airport or a change from a day to a night flight where the departuretime changes by more than 4 hours where you have booked a Sunsail Flight InclusivePackage Holiday or Boat Onlyb) A significant change of destinationc) A change of yacht to a significantly lower standardd An alteration to your schedule time of departure or return by more than 12 hoursIf we are unable to provide the booked travel arrangements and have had to cancel them before theholiday is due to start, you can either:a) Accept our offer of a replacement charter of equivalent or higher quality (subject to availability)b) Accept our offer of a replacement charter of lower quality (subject to availability) and we willrefund the difference in cost.c) Accept a full refund of the money you have paid.If you accept a major change, or if we have to cancel your charter then in addition to any refund, wewill pay you as a minimum, compensation in accordance with the amounts below. Accept wherethe major change is due to reasons of Force Majeure or where we have not obtained the minimumnumber of people to operate the charter. Children under 2 years are not entitled to any compensation.In no circumstances will we cancel your holiday less than 2 weeks before the scheduled departuredate except for reasons of force majeure (as defined below) or failure on your part to pay the finalbalance. We strongly recommend that you make no travel arrangements to your point of departure,make any connecting travel that is non-refundable or non-changeable or incurs penalties or incur anycosts in respect of visas or vaccinations until such time as your travel itinerary has been confirmed. If we are forced to cancel your holidayafter departure we will, wherever possible, make suitable alternative arrangements. If we are unableto make such alternative arrangements, or you reject these for good reason then we will return you toyour point of departure and refund you for any unused services, if appropriate.Circumstances amounting to “force majeure” include any event which we or the supplier of theservice(s) in question could not even with all due care, foresee or forestall such as (by way of exampleand not by way of limitation) war, threat of war, riot, civil strife, industrial dispute, terrorist activity,natural or nuclear disaster, fire, acts of God, adverse weather conditions, and all similar events.In February 2005 a new Europe-wide law relating to denied boarding, delays and cancellation offlights came into force. This law granted rights to passengers including in certain circumstancesthe right to cancel their flight and receive reimbursement of the cost of the flight from their airline.Full details of these rights are publicised at EU airports and are also available from affected airlines.However, you should note that reimbursement of the cost of a flight that forms part of your SunsailFlight Inclusive Package Holiday is the responsibility of your airline and will not automatically entitleyou to reimbursement of the cost of your holiday from us. Reimbursement of the cost of a flightwhere you have bought the flight is the responsibility of your airline and will not entitle you to anyreimbursement from us . If your airline does not comply with these rules you should complain to theAir Transport Users’ Council on 020 7240 6061 www.auc.org.ukCustomer BehaviourYou must accept responsibility for the proper conduct of yourself and any members of your party.Sunsail cannot be held responsible for under age consumption of alcohol. We reserve the right in ourabsolute discretion to terminate without further notice the holiday arrangements of any client whorefuses to comply with the reasonable instructions or orders of the company staff, agent or otherresponsible person whose behaviour in their opinion is likely to cause distress, damage, danger orannoyance to other customers, staff, any third party or to property. Animals, restricted items andillegal goods will not be permitted on board. Upon such termination our responsibility for your holidayceases and we shall not be liable for any extra costs incurred by you.Disruptive passengers: The captain has authority over the aircraft and passengers at all times whenthey are boarding or on board. He/she may prevent you from travelling if you are considered to beunfit to do so, or if you pose a danger to the aircraft or passengers. The captain will exercise thisright if, for example, you are found to be drunk before or after boarding, if you smoke on board or usethreatening, abusive or insulting words or behaviour. In those circumstances, we or the airline may,at our reasonable discretion, terminate your holiday, and we will not be responsible for completingyour holiday arrangements. Nor will Sunsail or the airline be liable for any refund, compensations orany other costs you have to pay.Our Liability To YouOur obligations, and those of our suppliers providing any service or facility included in your holiday,are to take reasonable skill and care to arrange for the provision of such services and facilities. Youmust show that reasonable skill and care has not been used if you wish to make any claim. Standardsof, for example, safety, hygiene and quality vary throughout the transport and destinations that yourholiday may involve. Sometimes these standards will be lower than those which would be expectedin the UK. The services and facilities included in your holiday will be deemed to be provided withreasonable skill and care if they comply with any local regulations which apply.Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of 3times the cost of your travel arrangements. Our liability in all cases will be limited in accordancewith and/or in an identical manner to The contractual terms of the companies that provide thetransportation for your travel arrangements. These terms are incorporated into this contract and anyrelevant international convention as detailed below. We are to be regarded as having all benefit ofany limitation of compensation contained in these or any conventions.You can ask for copies of the transport companies’ contractual terms, or the internationalconventions, from our offices at TUI Travel House, Crawley Business Quarter, Flemming Way,Crawley, West Sussex, RH10 9QL.We shall have no liability where the cause of the failure to provide, or failure in, your holiday or anydeath or personal injury you may suffer is not due to any fault on our part or that of our agents orsuppliers, because it is either attributable to you, or attributable to someone unconnected with yourholiday and is unforeseeable or unavoidable, or is due to unusual or unforeseeable circumstancesbeyond our control, the consequences of which could not have been avoided even if all due carehad been exercised, or an event which neither we, nor our agents or suppliers could have foreseenor forestalled.If any international convention applies to, or governs, any of the services or facilities included inyour holiday arranged or provided by us, or provided by any of our suppliers, and you make a claimagainst us of any nature arising out of death, injury, loss or damage suffered during or as a result ofthe provision of those services or facilities, our liability to pay you compensation and/or the amount(if any) of compensation payable to you by us will be limited in accordance with and/or in an identicalmanner to that provided for by the international convention concerned (in each case including inrespect of the conditions of liability, the time for bringing any claim and the type and amount ofany damages that can be awarded). International Conventions which may apply include, withoutlimitation: in respect of international air travel, the Warsaw Convention 1929 (as amended) or theMontreal Convention 1999; in respect of rail travel, the Berne Convention 1961; in respect of carriageby sea, the Athens Convention 1974; in respect of carriage by road, the Geneva Convention 1973;and, in respect of hotels, the Paris Convention 1962. For the avoidance of doubt, this means that weare to be regarded as having all benefit of any limitations of compensation contained in any of theseConventions or any other international conventions applicable to your holiday. Other than as setout above, and as is detailed elsewhere in these booking conditions, we shall have no legal liabilitywhatsoever to you for any loss or damage.Please note that when you purchase a flight through Sunsail where Sunsail is acting as an agent yourcontract for the flight is with the airline and any problems or issues with the provision of your flight arethe responsibility of the carrier and not Sunsail.Please note that the timings of air, sea, road or rail departures are estimates only. These timings maybe affected by operational difficulties, weather conditions or failure of passengers to check in on time.Personal Injury Unconnected With Your Booked Travel ArrangementsIf you, or any member of your party, suffer death, illness or injury whilst overseas arising out of anactivity which does not form part of your package travel arrangements or an excursion arrangedthrough us, we may at our discretion, offer advice, guidance and assistance. Where legal actionis contemplated and you want our assistance, you must obtain our written consent prior tocommencement of proceedings. Our consent will be given subject to you undertaking to assign anycosts and benefits received under any relevant insurance policy to ourselves. We limit the cost of ourassistance to you or any member of your party to £5,000. If your claim is successful then you mustrepay the amount of any financial assistance we have given you as soon as you recover it.Equipment And Yacht Insurance CoverOur equipment and yachts are comprehensively insured. Our policy provides full cover for theequipment and yachts and no less than $10m US third party cover for your skipper and crew. Sunsailcannot be held responsible for any loss which you may suffer as a result of the insurers failing toindemnify any risk through you providing incorrect information of previous sailing experience whenrequested. A refundable security deposit (refer to page 92 for details) payable at the Sunsail basein equivalent currency, will be required to cover the excess for any damage incurred to the yachtor damage to or loss of ancillary equipment such as dinghy tender, outboard engine, windsurfer,ocean kayak and GPS. However, should damage or loss to yachts and equipment be caused as aresult of not obeying Sunsail instructions, then he or she will be liable for the full amount of repair orreplacement and any resulting costs. Adults will at all times be responsible for minors in their charge.What If My Yacht Is Not Available?Should your yacht not be available when you arrive through no fault of Sunsail (e.g. having beendamaged by a previous client) Sunsail may substitute another yacht if necessary of a different typeand in a different area but of similar or larger dimensions and facilities. If a yacht is not available thenaccommodation will be provided for you free of charge in a hotel of Sunsail’s choice while repairs arecarried out or an alternative yacht is provided. Should this happen you will be compensated underthe “Sunsail Four Hour Guarantee”.PhotographyAn essential part of the success of our brochures is using photography that gives clients a true ideaof the product, rather than using models. Photographers are occasionally in our cruising areas. If youhave any strong objections to close up photography of yourself and your party, please indicate yourfeelings to the photographer at the time.Brochure AccuracyThe brochure is prepared from information gathered prior to publication. Every care is taken toensure that this information is still correct at the time of going to press (July 2010) but it has tobe remembered that facilities may be withdrawn from Sunsail and holiday particulars altered as aresult. These circumstances are regrettably beyond our control and we are unable to accept liability.Our Sales Team are instructed to advise enquirers of amendments which the company regard assignificant. Sunsail shall be entitled to make any modifications it feels appropriate to the routes,yachts and the equipment provided at any time, without prior notice. Our Sales Team are often askedfor information not contained in the brochure. However, whilst every effort is made to ensure thatall information given is correct, Sunsail cannot however be held responsible if this should proveinaccurate, unless requested and answered in writing. You areresponsible for ensuring that other members of your party are aware of the content of our PrivacyPolicy and consent to your acting on their behalf in all your dealings with us. Theserequirements may differ depending on your destination and you are advised to check. This information notice summarises the liabilityrules applied by Community air carriers as required by Community legislation and the MontrealConvention. Compensation in the case of death or injury. There are no financial limits to the liabilityfor passenger injury or death. For damages up to approximately £109,000 the air carrier cannotcontest claims for compensation. Above that amount, the air carrier can defend itself against a claimby proving that it was not negligent or otherwise at fault. Advance payments. If a passenger is killedor injured, the air carrier must make an advanced payment, to cover immediate economic needs,within 15 days from the identification of the person entitled to compensation. In the event of death,this advance payment shall not be less than approximately £13,000.Passenger delays. In case of passenger delay, the air carrier is liable for damage unless it took allreasonable measures to avoid the damage or it was impossible to take such measures. The liabilityfor passenger delay is limited to approximately £4,500.Baggage delays. In case of baggage delay, the air carrier is liable for damage unless it took allreasonable measures to avoid the damage or it was impossible to take such measures. The liabilityfor baggage delay is limited to approximately £1,000.Destruction, loss or damage to baggage. The air carrier is liable for destruction, loss ordamage to baggage up to approximately £1,000. In the case of checked baggage, it is liableeven if not at fault, unless the baggage was defective. In the case of unchecked baggage, thecarrier is liable only if at fault.Higher limits for baggage. A passenger can benefit from a higher liability limit by making a specialdeclaration at the latest at check-in and by paying a supplementary fee.Complaints on baggage. If the baggage is damaged, delayed, lost or destroyed, the passenger mustwrite and complain to the air carrier as soon as possible. In the case of damage to checked baggage,the passenger must write and complain within seven days, and in the case of delay within 21 days, inboth cases from the date on which the baggage was placed at the passenger’s disposal.Liability of contracting and actual carriers. If the air carrier actually performing the flight is not thesame as the contracting air carrier, the passenger has the right to address a complaint or to makea claim for damages against either. If the name or code of an air carrier is indicated on the ticket,that air carrier is the contracting air carrier.Time limit for action. Any action in court to claim damages must be brought within two yearsfrom the date of arrival of the aircraft, or from the date on which the aircraft ought to have arrived.Basis for the information. The basis for the rules described above is the Montreal Convention of 28May 1999, which is implemented in the Community by Regulation (EC) No. 2027/97 (as amendedby Regulation (EC) No. 889/2002) and national legislation of the Member States.In accordance with EU directive (EC) no. 2111/2005, Article 9, we are required to bring to yourattention the existence of a ‘Community list’ which contains details of air carriers that are subjectto an operating ban within the EU Community. The Community list is available for inspection atwww.air-ban.europa.euSailing Qualifications and SafetyAs with other activity based holidays, watersports activities contain an element of risk. It shouldbe understood that participation in these activities is your decision and at your risk. The skipperof a yacht has primary responsibility for the safety of the crew and craft at all times. By acceptingthis contract you, the lead name is confirming that you and/or members of your crew are capableand competent to sail the yacht in the conditions and cruising area of charter. Sunsail reservethe right not to hand over the vessel if, after inspection, it is of the opinion that the chartereris not, or may not be, competent to be in charge of the vessel. The skipper is responsible forassuring that he/she and the crew is competent to undertake the planned itinerary. The skippermust take note of safety information contained in any written material or delivered to the yachtand in chart briefings and is responsible for briefing the crew on this, the yacht and its systems.The skipper is responsible for checking the inventory and yacht systems before the yacht makespassage. Yachts may not be sailed single handed and the second crew member should be fit andqualified to RYA Competent Crew standard (or equivalent). In certain cruising areas, the secondcrew member must be over 18 years of age. Night sailing (except the UK) and partaking in anythird party race is not permitted without written approval from Sunsail. In the interests of safety,Sunsail’s staff may order a change to your itinerary, decide whether or not conditions are safe touse a craft or make a passage and whether this should be under power or sail. Sunsail reserve theright to instruct the charterer not to take the yacht out if Sunsail consider the weather conditionsto be too dangerous. The charterer must return the yacht to the home port on the date andby the time specified on the booking form but agree not to take the yacht out in bad weathereven if this may lead to the yacht not being returned by the agreed date. If it becomes apparentthat the charterer is unable to return the yacht on the specified date then they should adviseSunsail accordingly but will still be subject to an additional charter fee for each day or part ofday that the yacht is overdue. Upon return of the yacht the charterer shall hand the yacht overto an authorised member of Sunsail staff but Sunsail cannot accept that the vessel is free fromdefects that may not be immediately apparent. Any damage, incident or defect must be reportedto Sunsail’s authorised staff. In the event of any disagreement over damage or loss, the matterwill be referred to a senior member of Sunsail staff. The charterer agrees not to carry crew otherthan those specified on the crew list, which must be submitted prior to the start of the charter.At time of booking our dedicated sales agent will qualify your sailing experience inline with therelevant levels required for your chosen destination. Your declaration will be recorded to ensurewe have the relevant experience logged alongside important advanced passenger information.You will have nominated your Skipper and 1st Mate and advised Sunsail of the qualifications heldby these individuals. The lead skipper and 1st mate must ensure they travel with their relevantsailing certificates i.e. RYA, ICC or other. On the occasion that the Skipper or 1st Mate doesnot hold a formal RYA endorsed qualification Sunsail will provide a Sunsail Certificate which isrequired when sailing in Greece, valid for this purpose for this charter holiday only and issue aspart of the travel documentation.Please note that at the time of going to press it is compulsory to hold your ICC or RYA Day Skipperqualification when sailing in Croatia. These important documents must be presented with yourpassport to the Port Police upon requests.The yacht charter we arrange for you must only be used by those people named on yourConfirmation Invoice (or on any Amendment Invoice issued). You are not allowed to share youryacht or let anyone else stay onboard. See YDW and Security deposits page 92.Participation requirementsAll Clients are expected to satisfy themselves prior to booking that they are fit and able todemonstrate suitable sailing ability and competence to sail in the chosen destination describedin this brochure. No unaccompanied minors (those under 18 years of age) can be acceptedhowever. The minimum age for skippers is 18 years.Anyone suffering from mobility impairment, illness or disability or undergoing treatment for anyphysical or medical condition must declare the true nature of such condition at the time of bookingand make arrangements for the provision of any medication or other treatment which may berequired during the holiday.
