Implementation of Transitional Laws in Serbia 2006Commercials in which it was called to circle YES in the referendum werebroadcasted in almost all informative shows, even though advertising inshows shorter than 30 minutes is prohibited (Article 17, Paragraph 7 of theLaw on Advertising), but also the regulations on the length of broadcastingwere violated, because on Sunday, in the afternoon hours, calls to vote wereincessantly broadcasted in the top or the bottom of the screen on most TVstations, including the Public Service of Serbia 231 . The Law on Advertisingprohibits the advertising of political parties outside of pre-electioncampaigns 232 . Considering that these were not elections, all the TV stationshad severely violated this regulation of the law. The Republic BroadcastingAgency did not react to the violations of the Law on Broadcasting.In the end, the very members of RIK were included in the campaign tovote and confirm the Constitution. The Secretary of RIK Marko Danilovicadvocated during the voting that the citizens should vote in the referendumand for the Constitution in large numbers 233 , while the President of RIK,and also the judge of the Supreme Court of Serbia, Mihajlo Rulic, statedin a press conference on 30th September: „As a citizen, I am very pleasedtoday that I live in Serbia. Implementation of Transitional Laws in Serbia 2006Law on Free Access to Information of PublicImportanceThe Law on free access to information of public importance (in furthertext the Law on free access to information) 235 was adopted, on theproposition of the Government of the Republic of Serbia (in further textthe Government), by the National Parliament of the Republic of Serbia (infurther text the National Parliament) on November 2 nd , 2004, and came intoeffect on November 13 th , of the same year. This Law regulates the right ofcitizens to access information of public significance and the obligation ofstate organs to enable the implementation of this right.The methodology of the way the implementation of the Law on free accessto information was monitored was based on activating the mechanismsanticipated for the implementation and protection of this right. Requestsfor free access to information were submitted (in further text the requests),as well as complaints to Commissioner, and misdemeanor procedureswere started in cases when there was a legal basis for it. By this research,the Initiative wants to separate precisely and clearly the legal mechanismswhich are applied in practice, from those whose implementation was nottaken up. Their recognition, as well as introducing the authorities into theirexistence, could add to a more complete implementation of this law, alongwith informing the citizens of Serbia on issues of public interest. Theinformation was also obtained through daily monitoring of the media anddirect contact with all state organs which are included in the implementationof this law. The purpose of the research is also to introduce as large anumber of public organs with the contents of the Law on free access toinformation, through direct contact with requests.Statistical Data on the Implementation of the Lawon Free Access to InformationSubmitted requests and received informationThe Initiative had submitted 747 requests for free access to informationin 2006 at the addresses of 378 organs of public authorities in Serbia, and235 The Law on free access to information, see above under 361
