The same document recommendsthat national law and practice in the area of hate speech should take dueaccount of the role of the media in communicating information and ideaswhich expose, analyze and explain specific instances of hate speech andthe underlying phenomenon in general as well as the right of the public toreceive such information and ideas. To this end, national law and practiceshould distinguish clearly between the responsibility of the author ofexpressions of hate speech on the one hand and any responsibility of themedia and media professionals contributing to their dissemination as partof their mission to communicate information and ideas on matters ofpublic interest on the other hand. 971Using, among other things, above mentioned legal arguments the Initiativefiled charges for determination of hate speech to the First Municipal Courtin Belgrade 972 regarding this article for hate speech in terms of internationaland domestic standards and undoubted consequences of its publicationare spreading, inciting, encouraging, justifying national hatred, xenophobiaand intolerance. The charges were pressed against Ivan Corbic who was, atthat time, editor-in-chief 973 . With the charges, the Initiative demanded fromthe First Municipal Court in Belgrade to reach the ruling determining thatthe mentioned article represents hate speech, to remove article in questionfrom this daily paper’s website 974 , to ban its publishing or any similar articlein the future, to publish the ruling in GLAS JAVNOSTI in whole andwithout any comments and to pay out the prosecutor for the expenses oflegal proceedings.In response to the charges, defendants’ lawyer Aleksandra Glogonjacdisputed complaint and demand in whole 975 . It reply to the complaint it isstated: “The mentioned announcement enabled use of rights guaranteedby fundamental state laws and exiled Serbs publicly expressed their opiniontowards the state which violated their human and civil rights and expressedextreme intolerance, xenophobia, discrimination and hostility and exiledthem from their homes 976 ….
