1. INTRODUCTION1.1 BackgroundThis report is <strong>on</strong>e of a series of technical guidance documents relating to <strong>Special</strong> <strong>Sites</strong> that arepart of the statutory regime for c<strong>on</strong>taminated land introduced by the implementati<strong>on</strong> of s.57 ofthe Envir<strong>on</strong>ment Act 1995 that added Part IIA into the 1990 Envir<strong>on</strong>mental Protecti<strong>on</strong> Act(EPA 1990). The applicati<strong>on</strong> of this primary legislati<strong>on</strong> is via the C<strong>on</strong>taminated <str<strong>on</strong>g>Land</str<strong>on</strong>g>(England) Regulati<strong>on</strong>s 2000 and the accompanying DETR Circular 02/2000.This report provides technical informati<strong>on</strong> relevant to acid tar lago<strong>on</strong>s.Within the C<strong>on</strong>taminated <str<strong>on</strong>g>Land</str<strong>on</strong>g> (England) Regulati<strong>on</strong>s 2000 this category of <strong>Special</strong> Site isdefined as:−land which is c<strong>on</strong>taminated land by reas<strong>on</strong> of waste acid tars in, <strong>on</strong> or under the land.For the purposes of this definiti<strong>on</strong>, “waste acid tars” are tars which c<strong>on</strong>tain sulphuricacid, were produced as a result of the refining of benzole, used lubricants orpetroleum and are or were stored <strong>on</strong> land used as a retenti<strong>on</strong> basin for the disposal ofsuch tars.This report serves as a supplement to, and should be used in c<strong>on</strong>juncti<strong>on</strong> with, the followingEnvir<strong>on</strong>ment Agency documents to provide supporting informati<strong>on</strong> relevant to the discharge ofEnvir<strong>on</strong>ment Agency resp<strong>on</strong>sibilities for <strong>Special</strong> <strong>Sites</strong>:• Part IIA EPA 1990 Process Documentati<strong>on</strong> ; and• DETR/Envir<strong>on</strong>ment Agency. CLR11. Model Procedures for the Management ofC<strong>on</strong>taminated <str<strong>on</strong>g>Land</str<strong>on</strong>g> (in preparati<strong>on</strong>).In additi<strong>on</strong>, the reader is directed to other documents published by the Envir<strong>on</strong>ment Agency,the DETR and others in the references and bibliography secti<strong>on</strong> of this report.1.2 The Role of the Envir<strong>on</strong>ment Agency in Relati<strong>on</strong> to <strong>Special</strong> <strong>Sites</strong>Full details of Envir<strong>on</strong>ment Agency regulatory roles, resp<strong>on</strong>sibilities and procedures fordealing with <strong>Special</strong> <strong>Sites</strong> are provided in the Part IIA process documentati<strong>on</strong>, and <strong>on</strong>ly abrief overview is included here.The principal regulators for Part IIA (EPA 1990) are Local Authorities. The Envir<strong>on</strong>mentAgency has an important complementary regulatory role with specific resp<strong>on</strong>sibilitiesincluding the provisi<strong>on</strong> of informati<strong>on</strong> and advice, and acting as enforcing authority inrelati<strong>on</strong> to <strong>Special</strong> <strong>Sites</strong>.Local Authorities are resp<strong>on</strong>sible for identifying land in their areas which meets the statutorydefiniti<strong>on</strong> of c<strong>on</strong>taminated land under Part IIA (EPA 1990). In doing so, Local Authoritieswill seek informati<strong>on</strong> from the Envir<strong>on</strong>ment Agency, and advice in respect of polluti<strong>on</strong> ofc<strong>on</strong>trolled waters. Part IIA (EPA 1990) provides for certain land that meets the definiti<strong>on</strong> ofR&D <str<strong>on</strong>g>Technical</str<strong>on</strong>g> Report P5-042/TR/04 1
