EDITORIALResurrectionAs if in time for the Halloween, the Officeof the Ombudsman virtually revived a mothballedcase against Mexico Mayor TeddyTumang and ordered the official’s immediatesuspension from service for at least 90days without pay.Tumang was officially relieved from activeduty Monday by virtue of an order issued bythe Department of Interior and Local Government(DILG) informing him that he hadbeen preventively suspended over a caseof misconduct allegedly committed severalyears back.The case has been so ancient that Tumanghad been re-elected twice in officesince the case was filed by a retired armyofficer, who, by the way, has died a long timeago, too.The mayor’s camp has been invokingthe “Aguinaldo Doctrine” which set a landmarkdecision that all administrative casesagainst an elected official are renderedmoot and academic upon the re-election ofthe respondent official. This assumption bythe mayor has prevailed when the DILG, underthen Sec. Jesse Robredo attempted toissue a suspension order on Tumang a fewmonths back.This time, however, with Interior SecretaryMar Roxas signing the suspension order,Tumang was officially ordered to temporarilyvacate his post and give way to the incumbentvice mayor to assume the mayorship inacting capacity.Tumang was not in his office when thesuspension order was served, but the DILGseemed to believe that the same had beenserved with or without the respondent acceptinghis copy.For political observers, however, the suspensionorder’s timing is a suspect in itself.Why had it not been served before it reallypassed through the legal and proper procedure?Had it lack the legal fiat to take effectseveral months ago, reason why Tumangremained in office unscathed by the suspensionorder?This time, what was the difference of thenew order to the last one that it finally hit thetarget and Tumang wasn’t able to dodge thesuspension bullet once again? I set my mind that no amountof obstacle can hamper my travel, and I felt that no one canundermine that belief.The June sky back then was gloomy, it was like a precursorto an imminent trouble that came our way. At the airportin Paris, my aunt Rona--who was my travelling partner thattime--and I were questioned by respectable authorities. Butno, I wasn’t shocked nor caught off guard. Fact is, I anticipatedthat situation prior to my travel. I was like a chess playerwith a minimum of five moves advanced into the game: Igave forethought and foresight to any moves and incidents.You can catch me in a siesta the day before my flight, but todecipher my thoughts back then, I was just trying to determineany ins and outs, every probabilities and any loopholes.When we were questioned, they found a discrepancywith one of my documents, that single flaw raised cynicismthroughout the whole process. But I was not appalled. I maintainedmy composure.But they are on the verge of deporting us back to our country.Something that I cannot accept. Just the thought of periland the trouble, the experiences that some people set againstme back in my beloved country gave me tears and chills. Itwas a thought that my finite mind did not like to fathom.On the day-to-day course of interviews and questioning,we were given food, shelter to rest and sleep, materials for ourhygiene, even calling cards to inform our relatives and lovedones about our situation.
