RATIONALEEmbalming is the process <strong>of</strong> cleaning, disinfecting and treating the dead human body withchemicals to delay its decompositi<strong>on</strong> after death, so as to provide time for viewing and mourningbefore the final dispositi<strong>on</strong>. In ancient times, embalming was d<strong>on</strong>e for religious reas<strong>on</strong>s. During theAmerican Civil War, it was d<strong>on</strong>e to preserve the bodies <strong>of</strong> soldiers so they could be brought home forburial by their families. Today, embalming is c<strong>on</strong>sidered a science and an art. lt is not <strong>on</strong>ly d<strong>on</strong>e todelay natural decompositi<strong>on</strong> but also to restore the pleasing appearance as family and friends say theirlast farewells. Likewise, the procedure is significant for preservati<strong>on</strong> <strong>of</strong> evidence that could be used inmedico-legal cases.Over the past decades, practices involving disposal <strong>of</strong> the dead have underg<strong>on</strong>e pr<strong>of</strong>oundtransformati<strong>on</strong>, not <strong>on</strong>ly in the Philippines but worldwide. These changes requires revisi<strong>on</strong> <strong>of</strong> thesubject implementing rules and regulati<strong>on</strong>s to improve the quality <strong>of</strong> embalming practice in the countryto become globally comparable with other countries. Embalmers today are therefore, looked up to,because <strong>of</strong> the significant services they render including counseling assistance to bereaved parties.The Department <strong>of</strong> Health created the Committee <strong>of</strong> Examiners for Undertakers andEmbalmers (CEUE) to regulate the practice <strong>of</strong> embalming in accordance with the provisi<strong>on</strong>s <strong>of</strong> the Code<strong>on</strong> Sanitati<strong>on</strong> <strong>of</strong> the Philippines (<strong>PD</strong> <strong>856</strong>) and Executive Order No. 102 s.1999. The issuance mandatesthe committee to ensure that <strong>on</strong>ly qualified individuals enter the regulated pr<strong>of</strong>essi<strong>on</strong> and that thecare and services which the embalmers provide are within the standards <strong>of</strong> the practice.This revised lmplementing Rules and Regulati<strong>on</strong>s (lRR) shall adopt am<strong>on</strong>g others, the currenttrends and modern practices <strong>of</strong> embalming towards competence and globally competitiveness <strong>of</strong> thepr<strong>of</strong>essi<strong>on</strong>, hence improve the quality <strong>of</strong> health service delivery.II. OBJECTIVESGeneral: To update the standards in the disposal <strong>of</strong> dead pers<strong>on</strong>s.Specific:1. Upgrade the quality <strong>of</strong> services accorded to dead pers<strong>on</strong>s;2. Recognize the specific <strong>of</strong>fices resp<strong>on</strong>sible relative to the disposal <strong>of</strong> dead pers<strong>on</strong>s;3. ,?:rilr. scoPEThis implementing rules and regulati<strong>on</strong>s shall apply to all embalmers, accreditedembalming training instituti<strong>on</strong>s and training providers public and private burial grounds andother similar instituti<strong>on</strong>s operated by government agencies or instrumentalities includinggovernment - owned or c<strong>on</strong>trolled corporati<strong>on</strong>s, private organizati<strong>on</strong>, firms, individuals or otherentities.IV. DEFINITION OF TERMSTo provide the implementers / stakeholders a comm<strong>on</strong> frame <strong>of</strong> reference in theinterpretati<strong>on</strong> <strong>of</strong> these rules and regulati<strong>on</strong>s, the following terms as used in this Order areherein defined.1, Burial - This refers to the interment or burying <strong>of</strong> the remains <strong>of</strong> a dead pers<strong>on</strong> in agrave or tomb.2. Code - This refers to the Code <strong>on</strong> Sanitati<strong>on</strong> <strong>of</strong> the Philippines, <strong>PD</strong> # <strong>856</strong>3. Committee - This refers to the Department <strong>of</strong> Health Committee <strong>of</strong> Examiners forUndertakers and Embalmers (CEUE)4. Death Certificate - This refers to a legal document certifying the death <strong>of</strong> a pers<strong>on</strong>issued by the attending physician or in his/her absence, by the city/municipal health<strong>of</strong>ficer or other duly authorized government <strong>of</strong>ficial, using the prescribed form.5. <strong>Dead</strong> - This refers to a pers<strong>on</strong> exhibiting <strong>on</strong>e or more <strong>of</strong> the following signs andobservati<strong>on</strong>s:r lrreversible absence <strong>of</strong> pulse and respirati<strong>on</strong>r Total absence <strong>of</strong> brain activityo Cooling <strong>of</strong> the body to well below normal temperature, 35oC or less after 6hours (algor mortis)o Pooling <strong>of</strong> blood in dependent {lower) parts giving the skin a red colorati<strong>on</strong> inthose areas (livor mortis)o Stiffening <strong>of</strong> the body due to rigor mortiso Sunken and cloudy eye ballso No moisture appears <strong>on</strong> a mirror placed near the mouth6. Department - This refers to the Department <strong>of</strong> Health (DOH)7 . Embalming - This refers to the process by which a dead body is sanitized, preserved andrestored before final dispositi<strong>on</strong> through the applicati<strong>on</strong>, injecti<strong>on</strong> or introducti<strong>on</strong> <strong>of</strong> anychemical substance, drug or herb internally and/or externally.8, Embalming Facility - This refers to a place authorized by law where dead bodies areembalmed and prepared for final dispositi<strong>on</strong>.,4/"'Llih h/cdmd/h hrdb/09-1 48


ttl9. Embalmer - This refers to a pers<strong>on</strong> duly licensed by the DOH to embalm dead bodies10. Extreme Case - This refers to an excepti<strong>on</strong>ally difficult situati<strong>on</strong> with <strong>on</strong>e or more <strong>of</strong> thefollowing c<strong>on</strong>diti<strong>on</strong>s:r Absence <strong>of</strong> a doctoro Far flung areao Mass casualty incidenceo Mass burialo Absence <strong>of</strong> relatives11". Funeral Establishment - This refers to a place authorized by law <strong>of</strong>fering funeralservices, chapels and embalming facilities for a deceased pers<strong>on</strong> for burial or cremati<strong>on</strong>.12. Health Certificate - This refers to an <strong>of</strong>ficial written certificati<strong>on</strong> issued by the city ormunicipal health <strong>of</strong>ficer to a pers<strong>on</strong> employed in a funeral establishment or otherrelated service after passing the required physical and medical examinati<strong>on</strong>s.13. Local Government Unit (LGU) - This refers to a local political subdivisi<strong>on</strong>; the province,city, municipality or barangay.14. Local Health Authority - This refers to the <strong>of</strong>ficial or employee resp<strong>on</strong>sible for theapplicati<strong>on</strong> <strong>of</strong> a prescribed health measure in a local political subdivisi<strong>on</strong>. For a province,the local health authority is the governor and for a city or municipality, the local healthauthority is the mayor.15. Local Health Officer - This refers to the <strong>of</strong>ficer heading the health team <strong>of</strong> the localhealth authority; the provincial, city or municipal health <strong>of</strong>ficer.1-6. Morgue - This refers to a place in which dead bodies are temporarily kept pendingidentificati<strong>on</strong>, autopsy and/or removal for final dispositi<strong>on</strong>.L7. Regi<strong>on</strong>al Director - This refers to the DOH <strong>of</strong>ficial heading the Regi<strong>on</strong>al Health Office orthe Center for Health Development (CHD).18. Sanitary Engineer - This refers to a pers<strong>on</strong> duly registered with the Board <strong>of</strong> Examinersfor Sanitary Engineers (Republic Act 1364) and who heads the Sanitati<strong>on</strong>Divisi<strong>on</strong>/Secti<strong>on</strong>/Unit <strong>of</strong> the provincial, city or municipal health <strong>of</strong>fice or rural health unitor employed with the Department <strong>of</strong> Health or its regi<strong>on</strong>al health <strong>of</strong>fices.19. Sanitati<strong>on</strong> Inspector - This refers to a government <strong>of</strong>ficer, employed by the nati<strong>on</strong>al,provincial, city or municipal government, who enforces sanitary rules, laws andregulati<strong>on</strong>s and implements envir<strong>on</strong>mental sanitati<strong>on</strong> activities under the supervisi<strong>on</strong> <strong>of</strong>the provincial/ citV/ municipal health <strong>of</strong>ficer/ sanitary engineer.20. Sanitary Permit - This refers to a written permissi<strong>on</strong> or certificati<strong>on</strong> <strong>of</strong> the city ormunicipal health <strong>of</strong>ficer or in his absence, the chief or head <strong>of</strong> the sanitati<strong>on</strong> divisi<strong>on</strong>/secti<strong>on</strong>/ unit, that the establishment complies with existing sanitati<strong>on</strong> requirementslhh/cdmd/hhrdb/09-148


'"'4up<strong>on</strong> evaluati<strong>on</strong> or inspecti<strong>on</strong> c<strong>on</strong>ducted in accordance with Presidential Decree No.522 and <strong>856</strong> and local ordinances.21. Undertaker-This refers to a pers<strong>on</strong> who practices undertaking.22. Undertaking - the care, transport and disposal <strong>of</strong> the body <strong>of</strong> a deceased pers<strong>on</strong> by anymeans other than embalming.V. GENERAL GUIDEIINESArticle ISanitary Requirements in Establishments and Operati<strong>on</strong>sSecti<strong>on</strong>l: BurialGroundRequirements1-.1 The requirement for a death certificate before burial may be waived in the case <strong>of</strong> specialcircumstances when the death certificate cannot be issued in time. These includes but arenot limited to:1.1a The deceased died from a dangerous communicable disease and must be buriedwithin L2 hours1.Lb The family members <strong>of</strong> the deceased have requested immediate cremati<strong>on</strong>without embalming or viewing1.l-c The kin opt for immediate burial1.1d Religious Beliefs or Traditi<strong>on</strong>, such as lslam or the Jewish faith calls for burialwithin 1"2 hours after deathIn these cases, death certificate issuance shall be completed within 12 hours after burial orsancti<strong>on</strong> shall be imposed by the local health authority.1.2 No remains shall be buried without a burial permit issued by the city/municipality where theburial willtake olace.1.3 Funeral parlors or embalming establishments shall not hold unclaimed bodies l<strong>on</strong>ger than60 days or sancti<strong>on</strong> shall be imposed by the local health authority.1.4 The following are declared as Dangerous Communicable Diseases:t.4a Hepatitis B and C1.4b Rabies1.4c Invasive group A streptococcal infecti<strong>on</strong>s1.4d Transmissible sp<strong>on</strong>giform encephalopathies (e.g. Creutzfeldt-Jakob Disease or CJDand mad cow disease)1.4e HIV/AIDS1.4f Meningiococcemia1.4g Viral hemorrhagic fevers (e.g. African Ebolas, Lassa or Marburg)/1 Ijhh/cdmd/hhrdb/09-148 |'/'{


t,1.4h Yellow fever1.4i Plague1.4i SARS1.4k Other communicable diseases that shall be declared by the Department <strong>of</strong> HealthIt is recognized that viral hemorrhagic fever, yellow fever, plague and SARS are not found inthe Philippines at this time but thev mav be brousht in at anv time bv travelers.1.5 The following are the requirements when the cause <strong>of</strong> death is dangerous communicabledisease:1.5a The remains shall be placed in a plastic cadaver bag or other durable, airtight c<strong>on</strong>tainerat the point <strong>of</strong> death and a biohazard tag attached, provided, that, this c<strong>on</strong>tainer shallnot be opened for viewing or any other purpose prior to burial or cremati<strong>on</strong>;Secti<strong>on</strong> 2: Closure and removal <strong>of</strong> cemeteries2.1 Up<strong>on</strong> the recommendati<strong>on</strong> <strong>of</strong> the local health authority, a cemetery may be ordered closedby the regi<strong>on</strong>al health director subject to the approval <strong>of</strong> the Secretary <strong>of</strong> Health when itsfurther use poses a threat to public health such as when:2.1a The requirements for the 25-meter and SO-meter distance from the nearest dwellinghouse and source <strong>of</strong> water supply, respectively, are no l<strong>on</strong>ger me!2.1b Refuse has been allowed to accumulate and the vermin abatement program has not beenmaintained;2.lc The sanitary requirements have not been maintained in good working order;2.1d Pers<strong>on</strong>s are being allowed to reside inside the cemetery;The Regi<strong>on</strong>al Health Director or his duly authorized representative shall have the authority tom<strong>on</strong>itor, implement and enforce sanitary rules and regulati<strong>on</strong>s, including violati<strong>on</strong> <strong>of</strong> regulati<strong>on</strong>sagainst residing inside the cemetery premises. Violati<strong>on</strong>s there<strong>of</strong> shall be a ground for closure andrevocati<strong>on</strong> <strong>of</strong> the permit if the deficiencies are not corrected within a specified time period.Secti<strong>on</strong> 3: Funeral and Embalming Establishments3.1. Pers<strong>on</strong>nel3.1.1 Undertakers3.1.1a Accompany the transfer <strong>of</strong> deceased pers<strong>on</strong> by land or by sea at a distance morejhh/cdmd/hhrdb/09-1 48/,1


IT.Fthan 50 kilometers from the place <strong>of</strong> origin or, in the case <strong>of</strong> air transport, makearrangements for the remains to be met by another undertaker at thedestinati<strong>on</strong>.3.1.i.b Update their knowledge by undergoing training c<strong>on</strong>ducted by Department <strong>of</strong>Health accredited trainers/ instituti<strong>on</strong>s3.1,.2 Embalmers3.L2a Embalmers shall be licensed to practice <strong>on</strong>ly after compliance with therequirements prescribed by the Department <strong>of</strong> Health. Such license is renewableevery three (3) years <strong>on</strong> their birth m<strong>on</strong>th at their respective regi<strong>on</strong>al health<strong>of</strong>fices;3.L.zb Resp<strong>on</strong>sibilities <strong>of</strong> embalmers shall include but shall not be limited to the following:i. Ensure the identity <strong>of</strong> the deceased before proceeding with embalming;ii. Attend to all procedures <strong>of</strong> embalming <strong>of</strong> remains;iii. Ensure that no parts <strong>of</strong> the remains shall be removed during embalming;iv. Apply all sanitary precauti<strong>on</strong>s in embalming <strong>of</strong> remains; andv. Update their knowledge by undergoing training c<strong>on</strong>ducted by Department <strong>of</strong>Health accredited trainers/ instituti<strong>on</strong>s/ associati<strong>on</strong>s.3.1.3 Other Pers<strong>on</strong>nelOther pers<strong>on</strong>nel <strong>of</strong> the establishment shall have an up-to-date health certificate.3.2 Classificati<strong>on</strong> <strong>of</strong> Funeral Establishments3.2.1 Funeral Establishments shall be classified in three (3) categories which are described asfollows:3.2.2 Category 1- establishments with chapels and embalming facilities and <strong>of</strong>fering funeraltransport services ;3.2.3 Category ll - Establishments with viewing chapels and <strong>of</strong>fering funeral transport servicesbut without embalmine facilities; and3.2.4 Category lll - Establishments <strong>of</strong>fering <strong>on</strong>lv funeral transport services from the place <strong>of</strong>origin and viewing to the place <strong>of</strong> burial place3.2.4a Category I establishments, in compliance with the provisi<strong>on</strong>s <strong>of</strong> Secti<strong>on</strong> 3.3 below,may enter into a memorandum <strong>of</strong> agreement (MOA) with Categories ll and lllestablishments to provide embalming services, provided, that, the Category ll and lllestablishments are within 50 kilometers <strong>of</strong> the Category I establishment. The dulynotarized memorandum <strong>of</strong> agreement shall c<strong>on</strong>tain the following:4,Yjh h/cdmd/h h rd b/09-1 48


3.2.4b Name <strong>of</strong> the c<strong>on</strong>tracting parties and the registered name <strong>of</strong> their corresp<strong>on</strong>dingfuneral establishments3.2.4c Schedule <strong>of</strong> fees for embalming services;3.2.8 Date c<strong>on</strong>tracted and dates <strong>of</strong> effectivity;3.2.9 Signature <strong>of</strong> the c<strong>on</strong>tracting parties;3.2.10 Certificate <strong>of</strong> Registrati<strong>on</strong> and Updated License <strong>of</strong> Embalmer(s).3.3 The number <strong>of</strong> Category ll and lll establishments that may be served by a Category Iestablishment shall be governed by the table below.NUMBER OF LICENSED EMBALMERSALLOWED NUMBER OF ACCREDITED CATEGORY II ORCATEGORY III ESTABLISHMENTL-2 1.-42-4 5-85-UP3 or more3.3.1 Categories ll and lllfuneralestablishments shall have a current and valid memorandum <strong>of</strong>agreement with a Category I establishment for embalming services as a requirement forrenewal <strong>of</strong> their annual sanitary permit. The memorandum <strong>of</strong> agreement shall be valid for theentire period <strong>of</strong> the sanitary permit. Pers<strong>on</strong>nel <strong>of</strong> Category ll and Category lll shall notembalm dead pers<strong>on</strong>s except in a licensed facility. Violati<strong>on</strong> <strong>of</strong> this provisi<strong>on</strong> shall be a groundfor cancellati<strong>on</strong> <strong>of</strong> their permit to operate.3.3.2 All Category I establishments providing embalming services to other establishments shallmaintain a record <strong>of</strong> all bodies embalmed for each subscribing Category ll or lllestablishments. These records shall c<strong>on</strong>tain the name, sex, age and home address <strong>of</strong> thepers<strong>on</strong> embalmed and the name <strong>of</strong> the next <strong>of</strong> kin. Said records shall be maintained for aminimum <strong>of</strong> five (5) years after the services were provided.3.3.3 For embalming rooms, ventilati<strong>on</strong> shall be provided with an exhaust fan drawing from about60 cm above the floor with fresh air inlet(s) <strong>on</strong> or near the opposite side <strong>of</strong> the room. Theexhaust fan shall have a capacity <strong>of</strong> not less than 0.3 cubic meters per minute. Duringembalming, no fresh air inlet shall be opened <strong>on</strong> the same wall as the exhaust fan or <strong>on</strong>nearby side walls.3.3.3a Embalming shall be performed <strong>on</strong> a table made <strong>of</strong> single marble slab, aluminum,stainless steel or other equally impervious materials with a minimum size <strong>of</strong> 0.60 m. x1.80 ;3.3.3b Embalmers and undertakers shall use pers<strong>on</strong>al protective equipment (PPE) such asrubber gloves, apr<strong>on</strong>s, boots and safety goggles while working;"tqjhh/cdmd/hhrdb/09-148


tlb3.3.3c Washing facilities with soaps, detergents and germicidal soluti<strong>on</strong>s shall be provided foruse <strong>of</strong> the working pers<strong>on</strong>nel;3,3.3d Embalmers and undertakers shall be provided with lockers and closets for pers<strong>on</strong>alprotective equipment and a separate closet for chemicals used for embalming.Secti<strong>on</strong> 4: Evaluati<strong>on</strong> and Inspecti<strong>on</strong>4.1 Sanitati<strong>on</strong> Inspecti<strong>on</strong> FeeThe fees payable for every inspecti<strong>on</strong> shall be <strong>of</strong> such amount prescribed by local ordinance.FLOW CHART OF EVALUATION AND INSPECTION PROCEDUREPayment <strong>of</strong> amount prescribed by local ordinance shall be made at the city/municipal treasurerc<strong>on</strong>cerned.Inspecti<strong>on</strong> <strong>of</strong> the establishment within 7 days after payment <strong>of</strong> inspecti<strong>on</strong> fee at thecity/municipal treasurer c<strong>on</strong>cernedCity/Municipal Health Officer or Chief <strong>of</strong> Sanitati<strong>on</strong> Divisi<strong>on</strong> / Secti<strong>on</strong> / Unit or local health<strong>of</strong>fice, issues a Missi<strong>on</strong> Order (EHS Form No. 112) as specified in Sect. 8.3.bSanitary Engineer / Sanitati<strong>on</strong> Inspector c<strong>on</strong>ducts the sanitati<strong>on</strong> Inspecti<strong>on</strong>{jhh/cdmd/hhrdb/09-1 48


Article llOrganizati<strong>on</strong>, Examinati<strong>on</strong> & Registrati<strong>on</strong>Secti<strong>on</strong> 5:Committee <strong>of</strong> Examiners for Undertakers and Embalmers5.1 Membershio5.1.1 There shall be a Committee <strong>of</strong> Examiners for Undertakers and Embalmers, hereinafterreferred to as the "Committee", which shall be under the direct supervisi<strong>on</strong> <strong>of</strong> theSecretary <strong>of</strong> Health (DOH). lt shall be a collegial body composed <strong>of</strong> a chairpers<strong>on</strong> andmembers to be appointed by the Secretary <strong>of</strong> Health;5.1'.2 The Committee shall be created through a Department Pers<strong>on</strong>nel Order (DPO) and shallbe composed <strong>of</strong> members from the following <strong>of</strong>fices/instituti<strong>on</strong>s:5.1,.2a Nati<strong>on</strong>al Center for Disease Preventi<strong>on</strong> and C<strong>on</strong>trol (NCDPC)- Chairpers<strong>on</strong>5.1.2b Health Human Resource Development Bureau (HHRDB)- Vice-Chairpers<strong>on</strong>5.1,.2c Sanitary Engineer - Member5.1.2d Pathologist - Member5.1.2e Legal Officer - Member5.L.2f 4 Embalmers - assessors / facilitators (active members <strong>of</strong> an organizati<strong>on</strong> <strong>of</strong>licensed embalmers);5.1.3 The Health Human Resource Development Bureau shall serve as the CommitteeSecretariat;5.1.4 The chairpers<strong>on</strong>, vice-chairpers<strong>on</strong> and the members shall hold <strong>of</strong>fice for three (3) yearsor until their successors shall have been appointed and duly qualified without prejudiceto reappointment for another term.5.2 Duties and Functi<strong>on</strong>s <strong>of</strong> the CommitteeThe Committee shall have the following functi<strong>on</strong>s and duties5.2.1' To announce, schedule and hold examinati<strong>on</strong>s for embalmers; to approve or disapproveapplicati<strong>on</strong>s for examinati<strong>on</strong> and to perform all other duties pertinent and relatedthereto;5.2.2 To issue licenses to embalmers who have satisfactorily passed the licensureexaminati<strong>on</strong> and have complied with the requirements prescribed by law; to deny theissuance <strong>of</strong> license to any candidate and / or to cancel the license issued to any holder<strong>of</strong> certificate up<strong>on</strong> c<strong>on</strong>victi<strong>on</strong> <strong>of</strong> any criminal <strong>of</strong>fence involving moral turpitude, or hasbeen declared to be <strong>of</strong> unsound mind or physically unfit, or who has been foundviolating existing laws, rules and regulati<strong>on</strong>s as the case maybe;5.2.3 To issue certified true copies <strong>of</strong> lost or damaged licenses for embalmers;jh h/cdmd/h h rd b/09-1 48


105'2.4 To c<strong>on</strong>duct investigati<strong>on</strong>s to all sworn complaints against licensed embalmers and tosubmit its findings and recommendati<strong>on</strong>s to the Secretary <strong>of</strong> Health for appropriateacti<strong>on</strong>;5.2.5 To accredit instituti<strong>on</strong>s, associati<strong>on</strong>s or trainers c<strong>on</strong>ducting training programs andreview courses for embalmers;5'2.6 To establish criteria for the accreditati<strong>on</strong> <strong>of</strong> instituti<strong>on</strong>s, associati<strong>on</strong>s or trainers whoshall train the embalmers;5.2'7 lt shall be the duty <strong>of</strong> the Department <strong>of</strong> Health (DOH) Committee <strong>of</strong> Examiners forUndertakers and Embalmers (CEUE) to cause the m<strong>on</strong>itoring <strong>of</strong> embalmers at leasttwice a year or as may deem necessary for the enforcement <strong>of</strong> the rules and regulati<strong>on</strong>sas applied to licensed embalmers;5.2'8 To perform other functi<strong>on</strong>s necessary to regulate, standardize, pr<strong>of</strong>essi<strong>on</strong>alize and upliftthe practice <strong>of</strong> embalming;5.2.9 To perform such other related duties assigned by the Secretary <strong>of</strong> Health to implementpertinent provisi<strong>on</strong>s <strong>of</strong> the Code <strong>on</strong> Sanitati<strong>on</strong> <strong>of</strong> the Philippines (<strong>PD</strong> <strong>856</strong>) and theseimplementing rules and regulati<strong>on</strong>s.5.3 H<strong>on</strong>oraria <strong>of</strong> the CommitteeThe Chairpers<strong>on</strong>, Vice-Chairpers<strong>on</strong> and Members <strong>of</strong> the Committee shall receive a m<strong>on</strong>thlyallowance during their term <strong>of</strong> <strong>of</strong>fice. Likewise, they are allowed to receive h<strong>on</strong>orarium as resourcespeakers/pers<strong>on</strong>s under Administrative Order No. 93 s.2003 dated September 23, 2003.Secti<strong>on</strong> 5. Examinati<strong>on</strong> and Registrati<strong>on</strong> <strong>of</strong> Embalmers6.1, Date <strong>of</strong> Examinati<strong>on</strong>Examinati<strong>on</strong>s for embalmers shall be c<strong>on</strong>ducted any day within the first week <strong>of</strong> March andSeptember <strong>of</strong> every year. In excepti<strong>on</strong>al cases, the committee may give the examinati<strong>on</strong> <strong>on</strong> otherdates outside the prescribed <strong>on</strong>es as may be deemed necessary.6.2 Place <strong>of</strong> Examinati<strong>on</strong>The examinati<strong>on</strong> for embalmers shall be c<strong>on</strong>ducted at the Department <strong>of</strong> Health, Manila orother venues as determined by the Committee. The CEUE may c<strong>on</strong>duct simultaneous licensureexaminati<strong>on</strong>s in the Central Office and the Centers for Health Development (CHDs). However, it isrecommended that CHDs must have a minimum <strong>of</strong> FIFTY (50) examinees per schedule for costeffectiveness.jhhicdmdihhrdb/09-1 48I/q

I26.4 Examinati<strong>on</strong> FeesApplicants shall pay an examinati<strong>on</strong> fee in the amount prescribed by the Department.The applicati<strong>on</strong> form and the examinati<strong>on</strong> fee, including the necessary documents stated, mustbe filed two weeks before the examinati<strong>on</strong> date in order for the applicant to be included in thelist <strong>of</strong> examinees.6.5 Scope <strong>of</strong> Examinati<strong>on</strong>The examinati<strong>on</strong>s shall c<strong>on</strong>sist <strong>of</strong> the theoretical and oral / practical questi<strong>on</strong>s. Thetheoretical examinati<strong>on</strong> shall be c<strong>on</strong>ducted in writing and comprise basic questi<strong>on</strong>s based <strong>on</strong>Secti<strong>on</strong> 6.3.7. The oral/ practical examinati<strong>on</strong> shall c<strong>on</strong>sist <strong>of</strong> the procedures and techniques inembalming the remains.6.6 Passing Average6.6.1 For an examinee to pass the examinati<strong>on</strong>, he/she must obtain a general average <strong>of</strong> 75%inthe written examinati<strong>on</strong> and a general average <strong>of</strong> 75% in the oral /practical examinati<strong>on</strong>.6.6.2 Only those who have passed the theoretical examinati<strong>on</strong> shall be allowed to take theora l/practica I examinati<strong>on</strong>;6.6.3 All the examinees who passed the theoretical examinati<strong>on</strong> shall take the oral/practicalexaminati<strong>on</strong> within <strong>on</strong>e (1) m<strong>on</strong>th after <strong>of</strong>ficial advice, otherwise, the results <strong>of</strong> thetheoretical examinati<strong>on</strong> shall be deemed cancelled;6.7 Certificate <strong>of</strong> Registrati<strong>on</strong>6.7.I lssuance6.7.L.a All examinees who have passed the required examinati<strong>on</strong> shall be issued acertificate <strong>of</strong> registrati<strong>on</strong> duly signed by the chairpers<strong>on</strong> <strong>of</strong> the Committee andapproved by the Secretary <strong>of</strong> Health6.7.1.b The certificate <strong>of</strong> registrati<strong>on</strong> shall bear the recent picture and signature <strong>of</strong> thesuccessful examinee and will be valid for three (3) years. Payment <strong>of</strong> registrati<strong>on</strong>and miscellaneous fees shall be paid to the Department <strong>of</strong> Health (central <strong>of</strong>fices).6.7.1.c The certificate <strong>of</strong> registrati<strong>on</strong> shall be posted c<strong>on</strong>spicuously in the establishmentc<strong>on</strong>cerned.6.7.1.d Renewal <strong>of</strong> the Certificate <strong>of</strong> Registrati<strong>on</strong>An embalmer shall apply for the renewal <strong>of</strong> the certificate <strong>of</strong> registrati<strong>on</strong> <strong>on</strong> his /her birth m<strong>on</strong>th and pay the registrati<strong>on</strong> and miscellaneous fees every three yearsin any Regi<strong>on</strong>al Health Office/Center for Health Development;jhh/cdmd/hhrdb/09-1 48


'tl 13F The following requirements shall be presented when applying for renewal <strong>of</strong> theCertificate <strong>of</strong> Registrati<strong>on</strong>:i. Health certificate;ii. Current pr<strong>of</strong>essi<strong>on</strong>al tax receipt;iii. Current community tax certificate;iv. Receipt as payment <strong>of</strong> registrati<strong>on</strong> and miscellaneous fees for three years inthe amount prescribed by the Department <strong>of</strong> Health;v. Certificate <strong>of</strong> attendance to c<strong>on</strong>tinuing educati<strong>on</strong>/training <strong>on</strong> undertakingand embalming c<strong>on</strong>ducted by instituti<strong>on</strong>s/associati<strong>on</strong>s/trainers accredited bythe Department <strong>of</strong> Health (AO 2003-0031 Form # 3 and Department CircularNo.2009-001); andvi. When all the requirements are found in order, the said certificate shallvii. be stamped with the notati<strong>on</strong>"VAllD UNTIL _" and the receipt number<strong>of</strong> the registrati<strong>on</strong> fee and the signature <strong>of</strong> the Regi<strong>on</strong>al Health OfficeDirector c<strong>on</strong>cerned shall be affixed below.6.7.L.e The Regi<strong>on</strong>al Health Office Director/CHD c<strong>on</strong>cerned shall submit the list <strong>of</strong> renewedlicenses <strong>of</strong> undertakers and embalmers to the committee every last quarter <strong>of</strong> theyear.6.8 Suspensi<strong>on</strong> or Revocati<strong>on</strong> <strong>of</strong> Certificate <strong>of</strong> Registrati<strong>on</strong>The Committee and / or the Regi<strong>on</strong>al Health Office Director c<strong>on</strong>cerned shall recommend tothe Secretary <strong>of</strong> Health to reprimand those erring embalmers or those embalmers found guilty afterdue process and investigati<strong>on</strong> <strong>on</strong> any <strong>of</strong> the following grounds:i. C<strong>on</strong>victi<strong>on</strong> by a court <strong>of</strong> competent jurisdicti<strong>on</strong> <strong>of</strong> any criminal <strong>of</strong>fense involvingmoralturpitude;ii. Insanity;iii. Fraud in the acquisiti<strong>on</strong> or renewal <strong>of</strong> the certificate <strong>of</strong> registrati<strong>on</strong>;iv. Gross negligence, ignorance or incompetence in the practice <strong>of</strong> his/ heroccupati<strong>on</strong>;v. Addicti<strong>on</strong> to alcoholic beverages and prohibited drugs;vi. False or unethical advertisement and practice;vii. Physical incapacity which will impair the performance <strong>of</strong> the duty as undertakersand embalmers; andviii. Failure to revalidate the certificate <strong>of</strong> the registrati<strong>on</strong> for at least five (5) years; andix. Other analogous grounds affecting the occupati<strong>on</strong>.ihh/cdmd/hh rdb/09-'1 48


t4Article lllPractice <strong>of</strong> Undertaking and EmbalmingSecti<strong>on</strong> 7: Legal Functi<strong>on</strong>s Defined7.1' Licensed embalmers shall practice embalming in accordance with the following:7.1'.1 No embalmer shall embalm any remains without first obtaining the corresporrdingdeath certificate duly signed by the attending physician or, in the absence <strong>of</strong> anattending physician, the city/municipal health <strong>of</strong>ficer and permissi<strong>on</strong> <strong>of</strong> the resp<strong>on</strong>siblefamily member, provided, that, in case the death certificate is not available and toavoid delay in sanitizing the remains, the embalmer may proceed with a written"permissi<strong>on</strong> to embalm" executed by the attending physician or an "attestati<strong>on</strong> <strong>of</strong>death" executed by a local health <strong>of</strong>ficer. Both documents shall c<strong>on</strong>tain the name <strong>of</strong>the deceased, age, sex and home address. The "permissi<strong>on</strong> to embalm" shall alsoindicate the cause <strong>of</strong> death.7.L.2 The said embalmer, before proceeding <strong>on</strong> his/her work, must assure himself/herselfthat no autopsy <strong>of</strong> the remains will be necessary for medico-legal and pathologicalpurposes;7.I.3 No embalmer shall embalm any dead human body that died from dangerouscommunicable disease as set out in Secti<strong>on</strong> 1.4 above. lf the embalmer is uncertain if acommunicable disease case should or should not be embalmed, the same shall bereported first to the local health <strong>of</strong>ficer before embalming;7.1'.4 Every licensed embalmer shall certify, sign and affix his/her license number afterhis/her signature <strong>on</strong> the back <strong>of</strong> the death certificate stating the time and date <strong>of</strong>embalming. Failure to do so, he/she must submit to the Municipal Health Officer asworn statement attesting that he/she did embalm the corresp<strong>on</strong>ding body executedbefore two witnesses who were present at the time <strong>of</strong> embalming;7.1.5 No embalmer shall embalm any dead human body with any fluid or preparati<strong>on</strong> <strong>of</strong> anykind c<strong>on</strong>taining arsenic, strychnine, mercury, or any pois<strong>on</strong>ous alkaloid without specialpermissi<strong>on</strong> from the Secretary <strong>of</strong> Health or his duly authorized representative;7.I.6 Embalming operati<strong>on</strong> shall <strong>on</strong>ly be performed in an embalming roomfacility dulypermitted to operate. Such establishment shall be free from vermin.7.1'.7 In excepti<strong>on</strong>ally difficult circumstances that hinder transporting the remains to a dulypermitted embalming room / facility, the unembalmed remains must be buriedimmediately within 48 hours. A written report shall be submitted to the local health<strong>of</strong>ficer by the embalmer right after;7.L.8 Embalming operati<strong>on</strong>s shall <strong>on</strong>ly be performed in a morgue or embalming room dulypermitted to operate. Such establishment shall be free from vermin. In excepti<strong>on</strong>allydifficult circumstances, embalming operati<strong>on</strong>s may be d<strong>on</strong>e at the home <strong>of</strong> thejhh/cdmd/hhrdb/09-1 48lq


' I 15deceased, provided, that intracavity or arterial injecti<strong>on</strong>s <strong>on</strong>lv are used and precauti<strong>on</strong>sare taken to safeguard public health. Within six (6) hours after performing anemergency embalming operati<strong>on</strong>, a written report shall be submitted to the localhealth <strong>of</strong>ficer by the embalmer. Failure to do so shall subject the embalmer tosancti<strong>on</strong> by the local health authority and/or the Department <strong>of</strong> Health or its dulyrepresentative.7.L9 Embalmers shall comply with the procedure, method <strong>of</strong> embalming and embalmingfluid to be used; and other preparati<strong>on</strong>s promulgated by the Committee and approvedby the Secretary <strong>of</strong> Health; and7.1..I0 In case <strong>of</strong> calamity, disaster or epidemic where the number <strong>of</strong> victims can no l<strong>on</strong>gerbe attended by local embalmers, the local health authority may institute cremati<strong>on</strong> ormass disinfecti<strong>on</strong> prior to burial.7.2 Undertakers shall practice undertaking in accordance with the following:7.2.1. The undertaker shall ensure that the remains are properly laid in the casket and freefrom odor and excess moisture to the extent possible;7.2.2 The undertaker shall be resp<strong>on</strong>sible for the physical arrangements <strong>of</strong> the remainsincluding the make-up, floral and lighting arrangement;7.2.3 The undertaker shall prepare the burial site to meet the provisi<strong>on</strong> <strong>of</strong> these rules andregulati<strong>on</strong>s; and7.2.4 The undertaker shall accompany the remains from the funeral parlor to the burial site.Secti<strong>on</strong> 8: Autopsy and Dissecti<strong>on</strong> <strong>of</strong> Remains8.1 The following pers<strong>on</strong>s are authorized to perform autopsy and dissecti<strong>on</strong>:8.1.1 Health Officer- provincial, municipal, city health <strong>of</strong>ficers;8.1".2 Medical <strong>of</strong>ficers <strong>of</strong> law enforcement agencies such as:i. Philippine Nati<strong>on</strong>al Policeii. Nati<strong>on</strong>al Bureau <strong>of</strong> lnvestigati<strong>on</strong>8.1.3 Members <strong>of</strong> the medical staff <strong>of</strong> accredited hospitals8.2 Autopsies shall be performed in the following cases:8.2.1 Whenever required by special laws. t68.2.2 Up<strong>on</strong> order <strong>of</strong> a competent court, a mayor and a provincial or city prosecutor;8.2.3 Up<strong>on</strong> written request <strong>of</strong> police authorities;8.2.4 Whenever the solicitor general, provincial or city prosecutor as authorized by existinglaws, shall deem it necessary to disinter and take possessi<strong>on</strong> <strong>of</strong> remains forexaminati<strong>on</strong> to determine the cause <strong>of</strong> death;8.2.5 Whenever the nearest <strong>of</strong> kin request in writing the authority c<strong>on</strong>cerned toascertain the cause <strong>of</strong> death;8.3 Requirement <strong>of</strong> the autopsies who died in accredited hospitals:8.3.1 The director or chief <strong>of</strong> the hospital shall notify in writing the next <strong>of</strong> kin <strong>of</strong> thecause <strong>of</strong> death <strong>of</strong> the deceased and request permissi<strong>on</strong> to perform autopsy;8.3.2 Autopsy can be performed when the permissi<strong>on</strong> is granted or when no objecti<strong>on</strong> israised <strong>on</strong> such autopsy within 48 hours after death; and8.3.3 ln cases where the deceased has no next <strong>of</strong> kin, the permissi<strong>on</strong> shall be securedfrom the local health authority.secti<strong>on</strong> 9: Human Resource Producti<strong>on</strong>, utilizati<strong>on</strong>, Placement and DevelopmentThe Committee, in coordinati<strong>on</strong> with the accredited training instituti<strong>on</strong>s, accredited trainingproviders, as well as the pr<strong>of</strong>essi<strong>on</strong>al organizati<strong>on</strong>s, is hereby mandated to formulate and develop acomprehensive Embalmers Program indicating a c<strong>on</strong>tinuing embalmers educati<strong>on</strong> (CEE) that includesa valid assessment <strong>of</strong> career performance and potential, towards upgrading the level <strong>of</strong> skills <strong>of</strong>embalmers in the country, such as but not limited to the areas <strong>of</strong> performing embalming proceduresas may be determined by the Committee.Secti<strong>on</strong> 10: Salary and Compensati<strong>on</strong>ln order to enhance the general welfare and commitment to service and pr<strong>of</strong>essi<strong>on</strong>alism <strong>of</strong>embalmers, the minimum base pay <strong>of</strong> licensed embalmers working in funeral parlors and areasrelevant to the practice <strong>of</strong> the pr<strong>of</strong>essi<strong>on</strong>, shall not be lower than the prevailing minimum Wage Law.Provided, that for licensed embalmers working in small funeral establishments, adjustments <strong>of</strong> theirsalaries shall be in accordance with the number <strong>of</strong> cadavers per m<strong>on</strong>th as per agreement between theembalmer and the employer.Secti<strong>on</strong> 11: Penal Provisi<strong>on</strong>1"1.1' Any pers<strong>on</strong> who shall practice embalming in the Philippines within the meaning <strong>of</strong> thismandate without a certificate <strong>of</strong> registrati<strong>on</strong> issued in accordance herewith, or any pers<strong>on</strong>ih h/cdmd/h hrdb/09-1 48


t7presenting or using as his /her own certificate <strong>of</strong> registrati<strong>on</strong> or that <strong>of</strong> another or anypers<strong>on</strong> assuming, using or advertising himself/herself, as a licensed embalmer withouthaving been c<strong>on</strong>ferred such title by the Department <strong>of</strong> Health, Committee <strong>of</strong> Examinersfor Undertakers and Embalmers, shall be prosecuted before the Court <strong>of</strong> Justice asprovided for in Secti<strong>on</strong> 103 (a) and (b) <strong>of</strong> the Code <strong>on</strong> Sanitati<strong>on</strong> <strong>of</strong> the Philippines (<strong>PD</strong>8s6).11.2 All licensed embalmers and other pers<strong>on</strong>nel who shall violate the provisi<strong>on</strong>s <strong>of</strong> the Code<strong>on</strong> Sanitati<strong>on</strong> <strong>of</strong> the Philippines (P.D <strong>856</strong>) and these implementing rules and regulati<strong>on</strong>sshall be punishable by revocati<strong>on</strong> / suspensi<strong>on</strong> <strong>of</strong> license to practice the pr<strong>of</strong>essi<strong>on</strong>, orshall be prosecuted before the Court <strong>of</strong> Justice as provided for in Secti<strong>on</strong> 103 (a)and (b)<strong>of</strong>the said Presidential Decree.Secti<strong>on</strong> 12: Separability ClauseIn the event that any rule, secti<strong>on</strong>, paragraph, sentence, clause or words <strong>of</strong> these implementingrules and regulati<strong>on</strong>s is declared invalid for any reas<strong>on</strong>, the other provisi<strong>on</strong>s there<strong>of</strong> shall not beaffected thereby.Secti<strong>on</strong> 13: Repealing ClauseAll rules and regulati<strong>on</strong>s which are inc<strong>on</strong>sistent with the provisi<strong>on</strong>s <strong>of</strong> these implementing rulesand regulati<strong>on</strong>s are hereby repealed or amended accordingly.Secti<strong>on</strong> 14: EffectivityThese lmplementing Rules and Regulati<strong>on</strong>s shall take effect after fifteen (15) days from date <strong>of</strong>publicati<strong>on</strong> in the <strong>of</strong>ficial gazette or newspaper <strong>of</strong> general circulati<strong>on</strong>./---,ENNauflNek,FPcs, FAcsSecretary <strong>of</strong> Healthjhh/cdmd/hhrdb/09-1 48
