Terms and Conditions of SalePlease note that the first 20 lots in this auction, numbered ‘A to T’, will be auctioned by way of a ‘Silent<strong>Auction</strong>’ during the Convention itself on Thursday, June 23 rd , 2011. These lots will be available for youto view and place your bids at the auction table on the bourse floor.1. This is an auction sale conducted by the <strong>Casino</strong> <strong>Chip</strong> and <strong>Gaming</strong> Token <strong>Collectors</strong> <strong>Club</strong>, Inc.(CC&GTCC) hereinafter referred to as “the <strong>Club</strong>” and “<strong>Auction</strong>eer”. <strong>Part</strong>icipation in the floor bidding ofthe sale will be limited to members of the <strong>Club</strong>. The <strong>Auction</strong>eer may not withdraw any lot after a call forbids from the floor of the sale has been made. This is an auction sale and not a fixed price list. This is notan approval sale. Lots may be returned only if there has been a misrepresentation of the merchandise. Allsales will be considered final on the 30th day after the close of the sale. Lots are sold to the highest bidderas of the close of the sale on Thursday, June 23, 2011.2. The highest bidder acknowledged by <strong>Auction</strong>eer shall be the buyer. In the event of any disputebetween bidders, the <strong>Auction</strong>eer may at his sole discretion immediately put the lot up for sale again. The<strong>Auction</strong>eer’s decision shall be final and binding upon all bidders. The <strong>Auction</strong>eer reserves the right to acceptor reject any bid at his discretion. We will not accept a ‘buy” bid on any lot. The <strong>Auction</strong>eer reserves theright to refuse blanket or ‘total value” bids. The <strong>Auction</strong>eer reserves the right to refuse to honor any bid orto limit the amount of any bid which in his opinion is not submitted in “Good Faith” or as the case dictates, isnot supported by satisfactory credit references, as the <strong>Auction</strong>eer in its sole discretion shall determine.Reserved lots are noted, otherwise lots are unreserved. All advance bids for lots will be accepted on thefloor of the convention until 4pm, Thursday, June 23, 2011, at which time ALL bidding will close for the Silent<strong>Auction</strong> Lots ‘A to T’. The winning bids for those lots will be announced immediately prior to the start of Live<strong>Auction</strong> (<strong>Part</strong> II).3. All bids are to be per lot as numbered in this catalog. No lots will be broken. The <strong>Auction</strong>eer reservesthe right to withdraw prior to a call for bids any lot or lots from the sale. Bids are to be submitted accordingto the bidding increments indicated below. Bids received in fractional amounts will be rounded down to thenext bidding increment. If your bid is the highest bid we receive for the lot, and you comply with the termsof the sale, you will be the buyer of that lot. Raises in floor bidding will be made in the same fixedincrements. There will be a minimum starting price of $5 for all donated lots, and $50 for all consigned lots,except where vendors have given express permission for this to be lowered. This will apply for all advanceand proxy bids although the auctioneer may reduce this in the auction room at his discretion only in the eventof no bids whatsoever having been made. Bidding thereafter will be in the following incrementsBids from $5 to $100 – increments of $5, e.g. $5, $10, $15 ...Bids from $100 to $300 – increments of $10 e.g. $110, $120, $130 ...Bids from $300 to $500 – increments of $20 e.g. $320, $340, $360 ...Bids from $500 to $1,000 – increments of $25 e.g. $525, $550, $575 ...Bids $1,000 and above – increments of $50 e.g. $1,050, $1,100, $1,150 ...4. A “buyer’s fee” is payable by the buyer as part of the total purchase price. A “buyer’s fee” of 10% ofthe winning bid price will be charged on all lots (RESERVED & UNRESERVED) in this sale. The buyer’s fee willbe added to the winning bid (i.e. a winning bid of $100 will be charged $10 buyers fee) and added to theinvoice. Please calculate your bids accordingly.5. All sales are strictly for cash in U.S.A. dollars and are due and payable immediately upon receipt ofthe auction invoice or, if payment is to be made at the auction sale, then simultaneously with the receipt ofthe lots won. Bidder personally guarantees payment of all successful bids. Title to all items remains with the<strong>Auction</strong>eer until full payment is effected. For lots sold to mail bidders, invoices will be prepared and mailedwithin 10 days after the sale closes. Payment is due upon receipt of invoice. All lots will be sent to thesuccessful bidder upon receipt of payment. Lots delivered in the State of Nevada are subject to all applicablestate and local taxes. All applicable taxes will be paid unless the buyer submits to the <strong>Auction</strong>eer a validresale permit. Shipping, handling, and transit insurance charges will be added to invoices for the lotsdelivered by mail. Overseas buyers must furnish their own insurance covering shipment. In the event that a<strong>Casino</strong> <strong>Chip</strong> & <strong>Gaming</strong> Token <strong>Collectors</strong> <strong>Club</strong> • <strong>Auction</strong> 2011 • Page 2


successful bidder fails to pay all amounts due, the <strong>Auction</strong>eer reserves the right to resell the merchandise orreturn it to the consignor and the buyer agrees to pay for the reasonable costs of such a sale including aseller’s commissions, and also to pay any difference between the resale price and the price of his previouslysuccessful bid. All payments will be made to CC&GTCC.6. ALL SUCCESSFUL BIDDERS WHO ARE PRESENT AT THE CONVENTION (regardless of whether they were inthe live auction room) must pay for their lots before the end of the convention with no exceptions.7. Nevada Sales TAX will be added to the price of all lots purchased and taken at the time of the sale.Lots that are shipped out of Nevada to the buyer will not be charged sales tax, but will be subject to shippingand insurance charges. Dealers with valid resale licenses MUST PROVIDE a copy of their resale number to thecashier to avoid sales tax.8. All bidders who have mailing addresses outside the United States of America, the Territories of theUSA, Canada or Mexico, or have addresses through the U.S. Military and persons who have APO or FPO boxnumbers must deposit with the <strong>Auction</strong>eer 25% of the total amount bid in U.S.A. dollars unless terms andarrangements have been agreed in advance with the <strong>Auction</strong> Chairman or <strong>Auction</strong>eer. Any portion of suchdeposit not used will be promptly refunded after the sale.9. The <strong>Auction</strong>eer is selling only such right or title to the merchandise being sold as <strong>Auction</strong>eer may haveby virtue of his consignment agreements on the date of sale and disclaims any warranty of title to themerchandise. Any description of the gaming checks, gaming tokens or other items contained in this catalog isfor the sole purpose of identifying the items in the lot and no description of the lots has been made part ofthe basis of the bargain or has created any express warranty that the goods would conform to any descriptionmade by the <strong>Auction</strong>eer. The <strong>Auction</strong>eer disclaims any warranty of merchantability or fitness for anyparticular purpose. All lots are guaranteed to be genuine.10. The descriptions provided in this catalog are intended solely for the use of those bidders who cannotview the lots in person prior to bidding. All bidders who have inspected the lots prior to the auction will notbe granted any return privileges, except for reasons of authenticity. It is presumed that all floor biddershave inspected the lots prior to bidding. Therefore, lots purchased by floor bidders are sold “as is” and mayNOT be returned. Floor bidders include those bidders acting as agent for others. No claims of any kind(except for reasons of authenticity) can be considered after the settlements have been made with theconsignors. Any dispute after the settlement date, June 23, 2011, is strictly between the bidder andconsignor without involvement or responsibility of the <strong>Auction</strong>eer. The <strong>Auction</strong>eer or affiliates may consignitems to be sold in this auction sale, and may bid on those items or any other in the sale. An award granted in arbitration enforceable in anycourt. BY THE ACT OF PLACING BIDS IN THIS ACUTION, YOU ARE AGREEING TO THE TERMS OF SALE. As statedin the call for lots, there will be a 10% commission fee to the seller on all RESERVED & UNRESERVED lots.11. Consignors have the right to protect their own UNRESERVED lots by bidding in advance, by proxy or inthe live auction room. A consignor that buys back his lot will pay the regular 10% buyers premium but the10% sellers commission will be waived.12. CLEANLINESS (or the lack thereof, resulting in a soiled chip or token)This may not be a permanent condition. To clean or not to clean is the choice of the owner.While cleaning chips is a commonly accepted practice for aesthetic or hygienic purposes, itdoes not improve the grade but may damage the chip and diminish its value and grade. Onthe other side, non-cleaning should have no effect on the grade unless the specimen is sodirty that grading is not possible. In a situation involving a permanent stain that cannot heeasily removed, the chip or token will fall into the “Damaged” category.
