50. Allowance for misused stamps.(1) When any person has <strong>in</strong>advertently used, for an <strong>in</strong>strument chargeable with duty, astamp of a description other than that prescribed for such <strong>in</strong>strument by the rules madeunder this Act, or a stamp of greater value than was necessary or has <strong>in</strong>advertently usedany stamp for an <strong>in</strong>strument not chargeable with any duty; or(2) when any stamp used for an <strong>in</strong>strument has been <strong>in</strong>advertently rendered useless undersection 15, ow<strong>in</strong>g to such <strong>in</strong>strument hav<strong>in</strong>g been written <strong>in</strong> contravention of provisionsof section 13;the Collector may, on application made with<strong>in</strong> l [six months] after the date of the<strong>in</strong>strument, or, if it is not dated, with<strong>in</strong> l[six months] after the execution thereof by theperson by whom it was first or alone executed, and upon the <strong>in</strong>strument, if chargeablewith duty, be<strong>in</strong>g re-stamped with the proper duty, cancel and allow as spoiled the stampso misused or rendered useless.2 [51. Allowance for spoiled or misused stamps how to be made.In any case <strong>in</strong> which allowance is made for spoiled stamps under section 47 or misusedstamps under section 50, or <strong>in</strong> respect of pr<strong>in</strong>ted forms no longer required under section49, the Collector may give, <strong>in</strong> lieu thereof,-(a) the same value <strong>in</strong> money, deduct<strong>in</strong>g 3[therefrom such amount as may be prescribedby rules made <strong>in</strong> this behalf by the State Government]; 01(b) if the applicant so requires, other stamps of the same description and value; or(c) if the applicant so requires, stamps of any other description of the same amount <strong>in</strong>value:____________________________-1. Section 51 was substituted for the orig<strong>in</strong>al by Mah. 27 of 1985, s.31, (w.e.f. 10-12-1985).3.
