38. Collector's power to refund penalty paid under section 37, sub-section (1).(1) When a copy of an <strong>in</strong>strument is sent to the Collector under sub-section (1) of section37 he may, if he th<strong>in</strong>ks fit, refund any portion of the penalty <strong>in</strong> excess of five rupeeswhich has been paid <strong>in</strong> respect of such <strong>in</strong>strument. .(2) When such <strong>in</strong>strument has been impounded only because it has been written <strong>in</strong>contravention of section 12 or section 14, the Collector may refund the whole penalty sopaid.39. Collectors' power to stamp <strong>in</strong>struments impounded.(1) When the Collector impounds any <strong>in</strong>strument under section 33, or receives any<strong>in</strong>strument sent to him under sub-section (2) of section 37, not be<strong>in</strong>g an <strong>in</strong>strumentchargeable with a duty of twenty naye paise, or less, he shall adopt the follow<strong>in</strong>gprocedure: -(a) if he is of op<strong>in</strong>ion that such <strong>in</strong>strument is duly stamped or is not chargeable with duty,he shall certify by endorsement thereon that it is duly stamped, or that it is not sochargeable, as the case may be;(b) if he is of op<strong>in</strong>ion that such <strong>in</strong>strument is chargeable with duty and is not dulystamped he shall require the payment of the proper duty or the amount required to makeup the same, together with a penalty of Iran amount equal to 2[2 per cent of the deficientportion of the stamp duty, for every month or part thereof] from the date of execution ofthe <strong>in</strong>strument subject to the payment of a m<strong>in</strong>imum penalty of rupees one hundred]:3 [Provided that, <strong>in</strong> no case, the amount of the penalty shall exceed double the deficientportion of the stamp duty:]4 [Provided further that], when such <strong>in</strong>strument has been impounded only because it hasbeen written <strong>in</strong> contravention of section 13 or section 14, the Collector may, if he th<strong>in</strong>ksfit, remit the whole penalty prescribed by this section.(2) 5 [Subject to the provisions of section 53A, every certificate] under clause (a), of subsection(1) shall, for the purposes of this Act, be conclusive evidence of the matters statedthere<strong>in</strong>.(3) Where an <strong>in</strong>strument has been sent to the Collector .under sub-section (2) of section37 the Collector shall, when he has dealt with it as provided by this section return it to theimpound<strong>in</strong>g officer._______________________1.
