Provided also that, where proceed<strong>in</strong>gs have been taken <strong>in</strong> respect of an <strong>in</strong>strument undersection 31 or 40, the amount certified by the Collector shall be deemed to be the stampactually used at the date of execution. , '28. Facts affect<strong>in</strong>g duty to be set forth <strong>in</strong> <strong>in</strong>strument.The consideration (if any) '[the market value] and all other facts andcircumstances affect<strong>in</strong>g the chargeability of any <strong>in</strong>strument with duty, or the amount ofthe duty with which it is chargeable, shall be fully and truly set forth there<strong>in</strong>.29. Direction as to duty <strong>in</strong> case of certa<strong>in</strong> conveyances.(1) Where any property has been contracted to be sold for one consideration for thewhole, and is conveyed to the purchaser <strong>in</strong> separate parts by different <strong>in</strong>struments, the2 [market value] shall be apportioned <strong>in</strong> such manner as the parties th<strong>in</strong>k fit, provided thata dist<strong>in</strong>ct 2 [market value] for each separate part is set forth <strong>in</strong> the conveyance relat<strong>in</strong>gthereto, and such conveyance shall be chargeable with ad valorem duty <strong>in</strong> respect of suchdist<strong>in</strong>ct 2 [market value].(2) Where property contracted to be purchased for one consideration for the whole, bytwo or more persons jo<strong>in</strong>tly, or by any person for himself and others, or wholly forothers, is conveyed <strong>in</strong> parts by separate <strong>in</strong>struments of the persons, by or for whom thesame was purchased, for dist<strong>in</strong>ct parts of the consideration, the conveyance of eachseparate___________________________________________--1.
