6General Information & Sale NotesLOCATION - The Sale will be held in the Borderway Mart, Carlisle Cumbria. Motorists should leave theM6 at Junction 43 and follow CARLISLE signs. The market is on the left hand side of the road within 1/4mile of M6.METHOD OF SALE – All sheep will be sold in guineas and in catalogue order unless any alteration isannounced by the Auctioneers. A commission of 5% will be charged on all sheep sold, a further 1%levy will be charged and paid to the Zwartbles Sheep Association.CONDITIONS OF SALE - The Sale is held subject to the LAA Conditions of Sale in addition to theAuctioneers General Conditions of Sale and the Rules and Regulations of the Zwartbles SheepAssociation.RESERVE PRICES – Vendors shall have the right to refuse to accept the final bid for their animals. Anyanimal in the Sale Premises which are sold by private treaty after the Auction are subject to the fullcommission on the price realised and all such transactions must be passed through the Auctioneers.MAEDI VISNA - All sheep from Maedi Visna Accredited flocks will only be accepted into the marketand penned for sale if they are accompanied by an official ministry Certificate of official MV statuswhich has been correctly completed. Please note – a representative will be on duty to collect andinspect all Maedi Visna certificates.All sheep must have ear tags to comply with current ministry regulations.INSPECTION PROCEDURE - All sheep must be presented for inspection. All sheep that are rejectedby the inspectors must be removed from the pens. All sheep must be marked with their lot number orticket prior to inspection. Unmarked sheep will not be inspected. The Association expressly forbidsthe use of OP dips or other noxious substances within the sale area or prior to the sale. Any sheepwhich is found to have had its fleece coloured artificially , will result in the whole of that vendors runof sheep being barred from that sale, as well as any other disciplinary action Council renders fit uponreport by the inspectors. The person responsible for the sheep or vendor should be present.INSPECTION - For all official sales the Association shall appoint inspectors who will consider thepoints below and are empowered either to disbar the animal from the sale or alternatively any faultsfound by the inspectors shall be declared by the auctioneer, who shall announce these at the time ofsale. The inspectors decision shall be final and binding to all concerned and neither the inspectors, theAssociation, nor the auctioneers shall be liable to the owners of such animals or any other person orcompany for damage or any loss arising out of such rejection.- The lot number must correspond with the ear number as entered for sale. Animals without thecorrect identification will be rejected from the sale.- The animal is not suffering from any infectious or contagious disease.- All rams must have two adequately sized testicles of similar size and normal consistency.- Ewes shall be sound in udder.- The animal is of a quality commensurate with that set by the association and is of adequate weightfor the age and shows no malformation of structure.- The teeth of the animal shall be on the plate and in the correct position. Account will be taken ofthe age of the animal , however all lambs must have correct mouths .- There is no abnormal deviation in the structure of the feet and/or legs.All sheep must be presented for inspection between the following times:Thursday 8th August 1pm – 4pm (all sheep for judging MUST BE INSPECTED during this time)Friday 9th August 8am – 9amSETTLEMENT AND CLEARANCE OF STOCK - Settlement in full is due immediately at the close of Sale.No animal may leave the Sale Premises without an official ‘Pass Slip’, obtainable only from the Auctioneersupon settlement.

7PEDIGREE CERTIFICATES – Pedigree certificates and transfers will be dealt with by the Auctioneersand Association following the sale.NUMBERING – All entries must be identified by their catalogue number by means of a neck cardwhich will be provided. This must stay with the sheep at all times.SCRAPIE GENOTYPE RESULTS – This catalogue lists Genotype results where official writtenconfirmation has ben provided.Whilst the Society will make all possible effort to provide purchasers with the correct information, theycan in no way be held responsible for any error or omission of information.SUBSTITUTES – Substitute entries must be notified to the Secretary no later than 7 days before thesale.GUIDANCE TO BUYERS – Each animal has a unique number which includes a year letter as follows:2009 - R, 2010 - S, 2011 - T, 2012 - W, 2013 - AErrors and Omissions. 8CONDITIONS OF SALEAll sheep are sold under the Conditions of Sale as displayed inthe market recommended for use by theLivestock Auctioneers’ Association Ltd53 Female sheep not described as in lamb53.1 Vendor’s warrantyThe vendor warrants that a female sheep not described in thecatalogue or at the time of sale as in lamb is not in lamb at the timeof sale. This warranty is a 14 week +5 day warranty.53.2 Purchaser’s rightsIf the purchaser proves a breach of warranty then, at the purchaser’soption, either the purchaser may exercise his rights under Condition66, or the vendor shall pay to the purchaser as liquidated damagesa sum equal to the amount in paragraph (i) of the Appendix. Noticeof a claim must be supported by a veterinary surgeon’s certificateor a slaughter-house manager’s or other competent person’scertificate confirming that that the sheep was in lamb.54 Female sheep described as correct54.1 Vendor’s warrantyThe vendor warrants that all female sheep described in thecatalogue or at the time of sale as correct are sound in mouth andudder, that is they are not lacking any of the 8 broad teeth and donot have any damaged or worn teeth or a defective udder. Thiswarranty is a 5 day warranty.54.2 Purchaser’s rightsIf the purchaser proves a breach of warranty then, at the purchaser’soption, either the purchaser may exercise his rights under Condition66, or the vendor shall pay to the purchaser as liquidated damagesa sum equal to the amount in paragraph (i) of the Appendix. Notice of a claim must be supported bya veterinary surgeon’s certificate.59 Stock Rams59.1 Vendor’s WarrantyThe vendor warrants that any ram sold as a stock ram for theamount in paragraph(j) of the Appendix or more is capable of and effective at naturalservice. This warranty is a 10 week warranty.59.2 Purchaser’s rightsIf the purchaser proves a breach of warranty then the purchasermay return the ram to the vendor who shall, at the purchaser’soption, either replace the ram with another ram of equal valuewhich is capable of and effective at natural service, or refund thepurchase price together with such other costs and charges as thepurchaser may be entitled to under these Conditions. 87AUCTIONEER’S TERMS & CONDITIONS OF SALE(Incorporating the Auctioneer’s Terms and Conditions)1. The biddings to be regulated by the Auctioneers and the highest bidder, subject to the Vendor’sreserve (if any), to be the purchaser. No bid shall be retracted and if any dispute should arisebetween two or more bidders, the Lot in dispute to be put up again and resold, or the Auctioneersmay determine the dispute at their own discretion and their decision shall be final. TheAuctioneers reserve the right to refuse the bid of any person without being called upon to givereason for such action.2. The Purchaser to give his full name and dwelling place and pay for all Lots purchased immediatelyat the close of sale. No Lot or Lots shall be removed from the sale premises until paid for and apass-out slip obtained from the Auctioneer’s clerk but each and every Lot shall immediately atthe fall of the hammer be considered as delivered and be and remain in every respect at theabsolute risk and expense of the respective purchaser or purchasers thereof and shall beremoved from the sale premises at the purchaser’s expense. The right of property shall not passuntil the full purchase price is paid.3. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference. Asa result of the Money Laundering Regulations (2003) the auctioneers are unable to accept cashpayments in excess of nine thousand pounds sterling for any any single or linked purchasetransaction.4. All statements in the catalogue, or made by the Auctioneers at the time of sale, also the correctidentification of the animals, are the entire responsibility of the Vendors. All statements in the catalogue, or any made by the Auctioneers at the time of sale relating toany veterinary or other tests are to be taken as statements of fact only. They should ensure that livestock handlers are fit, experienced in livestockhandling and familiar with the livestock in their charge.Children must not be permitted in any area where they may be at risk from livestock ormachinery.In the case of bulls, during the period when the show/sale is open to visitors, bulls in stallsor pens should not be left unattended. If the handler is temporarily absent, arrangementsshould be made with another vendor, steward or member of Harrison & Hetherington staffto oversee the bull until the handler returns.Handling of Livestock at shows and sales: Harrison & Hetherington Limited recommendthat an adult person should accompany any junior person during the showing/sale oflivestock in the ring and reserves the right to intervene at any point if, in the company’sopinion, the person showing the livestock is at risk in undertaking that activity.Passageways must be kept clear at all times during the auction sale. PLEASE DO NOTSTAND IN THE SALE RING ENTRANCE AND EXIT PASSAGES.The auction ring man escapes and refuges must be kept clear at all times.All portable electrical equipment supplied and/or used by visitors and traders must be safeand fit for the purpose and should have a valid portable appliance test certificate.
