6LLEYN SHEEP SOCIETY CONDITIONS OF SALE1. The Sale will commence with all the M.V. Accredited sheep going through the ring first in balloted vendororder. The Non-M.V. Accredited sheep will then follow in the same format. The order of the sale will be by a ballotin the presence of a Society representative. The Sale catalogue will be printed strictly in accordance with theoutcome of the ballot.2. Sheep will be accepted at the sale yard on the morning of the sale. To delivery earlier please arrange directlywith the market.SPECIAL IN-LAMB CONDITIONS3. UDDERS – All sheep are sold as correct in the udder. Any complaint about udders should be made to theAuctioneer before removal from the sale premises.4. BREEDING GUARANTEES – All sheep (except geld/empty hoggs) are sold as having been scanned in-lamb.The service/due dates and number of lambs given should be accurate to the best of the Vendor’s ability.However cannot be guaranteed. If a sheep proves NOT to be in-lamb, the purchaser must notify the auctioneerssupported by a Veterinary Certificate confirming the same within 30 days of the date of the sale.5. SCANNING – This information, if available will be printed in the catalogue. If not, it must be given out by theVendor at the time of sale.6. IDENTIFICATIONi. Ewes born in 2007 - These ewes must be tagged with information as defined by Defra (or equivalent) in theleft ear and either tagged in the right ear with a Society tag (white tag) showing the Society's managementinformation or, in the event of not utilising a Society tag, the right ear should be tattooed with the Member's flocknumber. Members electing not to use a Society tag are required to show the Society management information ona tag of their choice.ii. Ewes born in 2008 - These ewes must be tagged with information as defined by Defra (or equivalent) in bothears. In addition, the ewe should either be tagged in the right ear with a Society tag (white tag) showing theSociety’s management information or, in the event of not utilising a Society tag, the right ear should be tattooedwith the Member’s flock number. Members electing not to use a Society tag are required to show the Societymanagement information on at least one of the double tags.iii. Ewes born in 2009and 2010 – These ewes must be tagged with information defined by Defra (or equivalent)in both ears. One of these tags may be a Society tag (white tag) which carries both Society managementinformation and Defra (or equivalent) information. In the event of not utilising a Society tag, the right ear shouldbe tattooed (for 2009 born only) with the Member’s flock number. Members electing not to use a Society tag arerequired to show the Society management information on at least one of the double tags.iv. All females born in 2011 and after - these females must be tagged with information defined by DEFRA (orequivalent) in both ears. The Society tag will act as a third tag but should members wish not to have three tagsthen they must include Society information (flock number, year number and individual number to match the EID)on the visual tag in addition to the DEFRA requirements.ALL SHEEP ENTERED MUST BE PROPERLY TAGGED AND TATTOOED AND THOSE NOT CONFORMING WITH THEABOVE WILL NOT BE ALLOWED IN THE SALE. PLEASE NOTE THAT TATTOOING IS NO LONGER A NECESSITY ASFROM 2010 ONWARDS.It is the individual Member’s responsibility to comply with the current Government tagging regulations andMembers are strongly advised to check the requirements with Defra (or equivalent).PRESENTATION7. All sheep must be accompanied by the appropriate Ministry movement licence and, in the case of Maedi-VisnaAccredited stock, a Maedi-Visna movement form. In the absence of either form, sheep will not be permitted tounload.8. All sheep are to be penned as advised on the official sales catalogue. Late arrivals will be refused admission tothe sale ring.9. Sheep presented at the sales must be untrimmed. Moreover, the Society discourages artificial colouring ofwool. In the event of any sheep creating inspection difficulties, the vendor will, at the discretion of the Inspectors,be asked to wash them.10. All ewes must be sound in the mouth any complaints regarding any defects should be reported to theAuctioneers within two hours of the end of the sale. Ewes born in 2010 or earlier must have reared a lamb.11. Undocked sheep will not be accepted.12. All sheep showing forward in teeth must be declared at the time of sale, otherwise they are returnable.13. A fine of £20 per pen will be imposed if a vendor fails to present his or her sheep on the day of the sale.14. All prize winners at the Show preceding the Sale must be sold through the ring or prize money (if any) will bewithheld.15. Vendors are allowed to display only the following items on their sheep pens:

A panel chosen by the Society’s Council will inspect all sheep. Any entry which does not meet the Society’sbreed standards will be withdrawn. NOTE: THE PANEL’S DECISION IS FINAL and any query arising from theInspectors’ decisions should be directed to the Secretary or other Society Representative on the day of the Sale.The Inspection criteria is to ensure the sheep conform to ‘breed type’.MINIMUM SALE PRICE17. Sheep shall be sold in guineas and no sheep can be sold for a price less than 200gns.ANIMAL HEALTH18. It is advised that all sheep are treated against scab within 28 days before the sale. Take advice from yourmedical supplier before treating in-lamb sheep.19. Organic sheep farmers – all sheep must be injected against scab as part of your health plan and you mustnote the treatment in your medicine record (as per Soil Associations’ instructions).20. Vendors with sheep showing signs of any contagious disease at any sale will be asked to remove the sheepfrom the market premises immediately and those sheep will not be offered for sale. Where necessary the wholeconsignment may have to be removed. If a vet is called, and supports the Society decision, the fees incurred willbe the responsibility of the vendor.DISPUTES21. In the case of a dispute between a Vendor and the Society in which a Veterinary Surgeon is called, if theVeterinary Surgeon finds in favour of the Vendor, the Society will be liable to pay the veterinary fees. However, ifthe Veterinary Surgeon finds in favour of the Society, the Vendor will be liable to pay the veterinary fees.22. A Society Committee will be present to be consulted in the case of disputes.23. Any complaint should be made to the Auctioneers within 2 hours of the end of the Sale and before theremoval of animals from the Sale premises.24. Any dispute concerning the ear tag numbers of sheep sold at the Sales will be the responsibility of the Vendorand any cost incurred as a result will fall entirely upon the Vendor.25. If sheep have not been tagged and tattooed correctly, according to the Society’s rules (see para 6), thePurchaser may, within 2 hours of the end of the Sale and before removal of the animals from the Sale premises,return the animals to the Vendor and be refunded the purchase price. However, should any disputes arise whichinvolve Maedi-Visna accredited sheep that have been moved by the Purchaser to the non Maedi-Visnaaccredited section, any claim will be void.GUIDANCE TO BUYERS26. All statements in the catalogue, or made by the Auctioneers atthe time of sale, also the correct identification of the animals,are the entire responsibility of the Vendors. The Auctioneerstake no personal responsibility for the correctness of suchstatements or identities.5. All statements in the catalogue, or any made by theAuctioneers at the time of sale relating to any veterinaryor other tests are to be taken as statements of fact only.No such statements shall guarantee the purchaser of anyanimal against loss arising from the subsequent reaction ofsuch animal to any test administered after the sale and theVendors shall not be liable in any way should this occur.6. All stock is sold subject to the Conditions of Salerecommended for use at markets by the LivestockAuctioneers’ Markets Committee for England and Walesexcept in so far as these conflict with any Special Conditionsapplicable to the sale of pedigree stock, when the latterConditions shall prevail.7. Neither the Vendors nor the Auctioneers will be responsiblefor any accident or injury to persons or property, throughfire or any other cause whatsoever, nor for any damage byanimals prior to, during or after the sale.8. No undertaking by the Auctioneers or their servants totake charge of any Lot or Lots after the sale or to forwardthem to their destination shall be held to impose upon theAuctioneers any legal obligation or vitiate any of theseConditions.9. Inasmuch as the Auctioneers act as agents for a disclosedprincipal they shall not be considered personally responsiblefor any default on the part of either purchasers or Vendorsand the remedy shall be against them only and not againstthe Auctioneers.10. If these conditions are unfulfilled, the Vendors orAuctioneers shall have the power to resell the Lots,retaining any surplus and charging any deficiency andexpense to the defaulter.11.
