He studied Art and Architecture in Dublin and Munichand originally made his name as a portrait painter, painting many prominentindividuals: Ingrid Bergman, Robert Mitchum, Harold Robbins, the Duke ofEdinburgh and Eamon de Valera, to name but a few. Having worked in Saudi Arabia,he kept an art studio in Provence in the 1970’s, where he was a neighbour of Picasso,and Le Musee Schwatschke was established, while his work was promoted by notedParis dealer Iris Clert. He later moved his studio to Santa Barbara, before finallyreturning to Ireland. Schwatschke is well known for his caricatures, which as worksof art, are always intensely personal and somehow universal.14

Herinterest in art goes back to her childhood,when her extraordinary talent was easilyrecognised. Thelma has always lovedthe seashore and has a long and happyrelationship with Connemara. He wenton to study Art and Architecture at UniversityCollege Dublin where he graduated with aBachelor of Architecture degree. He wenton to establish a successful internationalarchitecture business in Dublin. In the late1980’s he retired from the profession, tobecome a full time artist.Influenced by his architectural background,Val Byrne has a particular interest in the urbanlandscape of Ireland, so most of his workrelates to recording the Ireland of the 20thand 21st Century with an emphasis on theharbours, boats and the mixture of domesticand residential buildings which surroundthem. He often uses a cubist approach whenpainting traditional Irish scenes.Val has always sought to include in his work adegree of quirkiness and the absurd “if thereis wobbly leaning lamp post with stragglingwires in the scene, I leave it in”.61Today, Val Byrne’s paintings are heldin private and corporate art collectionsthroughout the world including FormerPresidents Mary McAleese and MaryRobinson, Seamus Heaney, The CrownPrince of Oman, General John de Chastelain,Brian Keenan and many others. DOLAN’SManus Walshb.194087Born in 1940, Manus Walsh began his career in the field ofstained glass, working for the Abbey Stained Glass Studiosin Dublin, in the sixties. It was during his time there thathe met artist, George Campbell, who became his mentorand friend, and also encouraged him to take up paintingfull time. Among Manus’s many stained glass designsare five windows for Galway Cathedral, and more recentlyin St John’s Church, Ballyvaughan. The landscape of theBurren has been a constant inspiration to him for the pastthirty years and more, and its barren limestone landscapecontinues to be a major influence on his work. Manus hastravelled widely, spending considerable periods of time, inboth Spain and Chile, and the Spanish landscape, togetherwith the city of Valparaiso continue to be a significantinfluence. Walsh has exhibited widely at home and abroad,including four exhibitions in South America and numerousone man shows. His work is to be found in many collectionsworldwide, both private and public. 12 th AUGUST 201290Arthur Armstrong RHABorn in Carrickfergus, Co. Antrim in 1924, his family moved to Belfastwhere Armstrong attended Queens University. After two years he departedand spent 6 months at Belfast College of Art evening classes, where hemet Gerard Dillon, also becoming acquainted with George Campbell andDaniel O’Neill.In 1946, he became a professional artist, but only surviving with clericaljobs, and in 1950 an exhibition of his work was held at the Grafton Gallery inDublin. His work was also exhibited in Belfast in a Group Show in 1951 andin a solo exhibition in 1956.Armstrong first exhibited at the Royal Hibernian Academy in 1962and up until 1995, contributed a total of 74 works at the RHA, becoming amember in 1972. DOLAN’STERMS & CONDITIONS OF SALE1. DefinitionsIn these Conditions, West of Ireland Art Auctions Limited, trading as Dolan’sArt Auction House, who act as auctioneers and agents for the vendor, are called‘The Auctioneers’ (which expression shall be deemed to include their servantsand agents) and the representative of Dolan’s Art Auction House conducting theauction is called ‘The Auctioneer’. As auctioneers, Dolan’s act as agent for theseller. A sale contract is made directly between the seller and the buyer. However,Dolan’s may own a lot (and in such circumstances act in a principal capacity asseller) and/or may have a legal, beneficial or financial interest in a lot.2. Third Party LiabilityEvery person at or on the ‘Auctioneers’ premises or at any premises being usedby the Auctioneer at any time shall be deemed to be there entirely at his/her ownrisk and shall have no claim whatsoever against the Auctioneers or their servantsor agents in respect of any accident or incident which may occur, nor any injury,damage or loss howsoever arising and whether or not same is the subject of anyallegation of negligence.3. GeneralWhilst the Auctioneers make every effort to ensure the accuracy of their catalogueand the description of every lot:a) Each lot as set out in the catalogue or as divided or combined with any other lotor lots is sold by the vendor with all faults, imperfections and errors of description.b) The auctioneer shall not be responsible for any discrepancies between the colourin the catalogue illustration and that of the original work being offered for sale.c) Any claim under any Statute must be received in writing by the Auctioneerswithin three months of the sale.d) The Auctioneers shall not be liable for consequential or resultant loss ordamage whether sustained by a Vendor or a Purchaser or the owner of any item ortheir respective servants and agents arising in any circumstances whatsoever andirrespective of any claim made by any party as to negligence or lack of care of theAuctioneers or any party acting on their behalf.e) All lots are made available for inspection for a reasonable period prior toauction. A buyer who makes a bid for any lot thereby acknowledges that he hassatisfied himself as to the physical condition, state of repair or restoration, age andcatalogue description of such lot and also that he accepts these conditions of sale.Dolan’s knowledge, in relation to each lot, is partially dependent on informationprovided by the seller and Dolan’s are not able to, and do not, carry out exhaustivedue diligence searches on each lot. Bidders acknowledge this fact and acceptresponsibility for carrying out inspections and investigations to satisfy themselvesas to the lots they may be interested in buying. Bidders also acknowledge the factthat many lots are of an age that they may not be in perfect condition. All lots areoffered for sale with any imperfections. Catalogue descriptions and conditionreports may on occasions make reference to particular imperfections of a lot, butBidders should note that lots may have other faults not expressly referred to in thecatalogue or condition report. Illustrations are for identification purposes only andwill not convey full information as to the actual condition of lots.4. The Auctiona) The Auctioneer has absolute discretion to divide any lot, to combine any twoor more lots or to withdraw any lot or lots from the sale, to refuse bids, regulatebidding or cancel the sale without in any case giving any reason or previous notice.He may bid on behalf of the vendor for all goods which are being offered subject toreserve or at the Auctioneer’s discretion.b) The highest bidder shall be the buyer except in the case of a dispute. If duringthe auction the Auctioneer considers that a dispute has arisen, he has absolutediscretion to settle it or to re-offer the lot for sale. The Auctioneer may at his solediscretion determine the advance or bidding or refuse a bid.c) Each lot is put up for sale subject to any reserve price placed by the vendor.Whether or not there is a reserve price the seller has the right to bid eitherpersonally or by any other person (who may be the Auctioneer).d) All conditions, notices, descriptions, statements and other matters in thecatalogue and elsewhere concerning any lot are subject to any statementsmodifying or affecting the same made by the Auctioneer from the rostrum priorto any bid being accepted for the lot.5. RescindmentNotwithstanding any other terms of these Conditions, if within 12 months afterthe sale, the Auctioneers have received from the buyer any notice in writing thatin his view the lot is a deliberate forgery and within twenty one days after suchnotification the buyer returns the same to the Auctioneers in the same conditionas at the time of sale and by producing evidence, the burden of proof to be uponthe buyer, satisfies the Auctioneers that considered in the light of the entryin the catalogue the lot is a deliberate forgery, then the sale of the lot will berescinded and the purchase price of the sale refunded. In the event of a disputethen the matter shall be settled by the President of the Institution of CharteredSurveyors in the Republic of Ireland. Both the buyer and the vendor agree to bebound by the decision.6. DefaultThe Auctioneers disclaim responsibility for default by either the buyer or the vendorbecause they act as Agents for the vendor only and therefore do not pay out to thevendor until payment is received from the buyer. Instructions given by telephone areaccepted at the sender’s risk and must be confirmed in writing forthwith.7. In the event of a sale by private treaty both the vendor and the buyer agree tobe bound by these conditions and any other special conditions of sale.Retention of TitleAll goods remain the property of the vendor until paid for in full. The Auctioneerswill not assume liability to discharge net proceeds arising from the sale of goodsuntil those goods have been paid for in full.8. InstructionsAll goods delivered to the Auctioneers’ premises will be deemed to be delivered forsale by auction and will be catalogued and sold at the discretion of the Auctioneerand accepted by them subject to all the Sale Conditions. By delivering the goods tothe Auctioneers for inclusion in their auction sales the vendor acknowledges thathe or she has accepted and agreed to be bound by all these Conditions.9. Collection and DeliveriesThe Auctioneers do not normally undertake the packing, collection or deliveryof goods but will if requested use their best endeavours as Agent of the Ownerto arrange for an independent contractor on the owner’s behalf to deal withpacking, collection and/or delivery. The Auctioneer will not in any eventarrange insurance of the goods and will accordingly not be liable for any loss ordamage to goods howsoever arising including breakages or for any damage topremises, fixtures or fittings therein caused by such contractor or otherwise andthe owner is responsive for all arrangements to verify that any such contractorand the goods is/are appropriately insured. Unless instructions are received tothe contrary, charges (including VAT) for such services will be charged to thevendor’s account or discharged through the Auctioneers by the purchaser asthe case may be. The Auctioneers’ liability (if any) will arise only where theythemselves carry out packing and collection/delivery and only in the case ofbreakage or loss caused through deliberate negligence of their employees andin any event in one single contract and the Auctioneers’ liability will not exceedC=500. Provided further the Auctioneers will not be liable for consequential lossin any circumstances whatsoever.10. Loss or Damage and StorageThe Auctioneers reserve the right to store or arrange for the storage of goodsheld by them or delivered to them either on their own premises or elsewhere attheir sole discretion and entirely at the owner’s risk. The Auctioneers shall notbe liable for any loss (including consequential loss) howsoever caused or damageto goods of any kind including breakages, or for unauthorised removal of goods.11. Right to Re-sellThe Auctioneer reserves the right to re-sell any item that has not been collectedwithin fourteen days.12. Telephone biddingEvery effort will be made to facilitate persons wishing to bid by telephone atauction but the auctioneer disclaims responsibility for any failures for whateverreason, in this regard.13. Absentee BiddingEvery effort will be made to facilitate persons wishing to leave commission bidswith the auctioneer but the auctioneer disclaims responsibility for any failuresfor whatever reason, in this regard.14. Droit de SuiteThe artist’s resale levy, the droit de suite, where applicable, will be deemed to bethe responsibility of the vendor. Dolan’s Art Auction House will not charge thislevy to the purchaser. The vendor by entering his goods for sale with Dolan’sArt Auction House acknowledges that he/she is responsible for the payment ofthis artist’s resale levy. Dolan’s Art Auction House will not be responsible forpayment of the droit de suite and the vendor by entering his/her goods for saleacknowledges that he/she has accepted and agreed to be bound by this conditionof sale. Furthermore Dolan’s Art Auction House accepts goods for sale from thevendor on the condition that the vendor authorizes Dolan’s Art Auction House towithhold monies due for payment of the droit de suite from the auction proceedsdue to the vendor, and the vendor further authorizes Dolan’s Art Auction Houseto pay the droit de suite, on the vendors behalf, to the artist. Furthermore thevendor acknowledges that the droit de suite payment where applicable will becharged to the vendors account in addition to the vendors commission chargedby the auctioneer and any illustration or other charges applicable to the account.15. Special ConditionsPURCHASER:a) The purchaser shall pay a commission to the auctioneer, viz. a Buyer’s Premium,of 20% plus VAT on the hammer price of each lot.b) The Purchaser acknowledges that the auctioneer may also receive acommission from the vendor.c) All accounts must be discharged by certified cheque, bank draft or cash. Theauctioneer reserves the right not to release goods until cheque payments havebeen cleared by the bank. Credit cards also accepted with a 2.5% surcharge.d) Responsibility for items purchased passes to the purchaser on the fall of thehammer. The Auctioneers reserve the right to look for a 25% deposit on all goods.e) The buyer authorises the Auctioneer to use any photographs, drawings orillustrations of any lot purchased by the buyer, and, to indicate the price paid atauction for the lot, and the buyer acknowledges that same may be used for anyadvertising, promotional or other such purposes.16. Purchasers will NOT be charged the Artists Resale Levy.17. VAT Regulations:All lots are sold within the Auctioneers VAT margin scheme.
