MAYOR'S ANNUAL REPORT. 365owners their proper bill for the same, as it may beascertained by the city council; and, if such bill sosent be not paid within thirty (30) days after the presentationor sending of the same, it shall then becomethe duty of the City Treasurer to issue an executionfor the amount, together with costs, againstthe persons and property aforesaid, which executionshall be made and levied out* of the property describedtherein, as are executions for city taxes.Sec. 4. Be it further ordained, That all ordinancesand parts of ordinances in conflict with this ordinanceare hereby repealed.Ordinance passed December 25th, 1901.An ordinance for the improvement of Berrienstreet, from the west side of Tattnall street to theeast side of Jefferson street, and from the west sideof Jefferson street to the east side of West Broadstreet, under the terms and provisions of an act ofthe Legislature of Georgia, approved October 1, 1887.Section 1.. Be it ordained by the Mayor and AldermenofiheCity of Savannah, in Council assembled,under the terms and provisions of an act of theLegislature of Georgia, approved Oct. 1, 1837, Thatthe Director of Public Works of the City of Savannahand the Committee on Streets and Lanes of thesaid city be, and they are hereby authorized anddirected to build and construct on Berrien street, inthe city of Savannah, from the west side of Tattnallstreet to the east side of Jefferson street, and from thewest side of Jefferson street to the east side of WestBroad, a roadway of vitrified brick thirty-two (32) feetin width between the curbing, and they are authorizedand directed to lay the necessary curbing and to do
366 MAYOK'8 ANNUAL REPORT.all the work in the way of grading, the placing ofcatch basins, drains and crossings, and all otherthings incident to the construction and completionof the said roadway on the said portion of Berrienstreet.Sec. 2. Be it further ordained. That after the totalcost of the said work shall have been ascertained,one-third* of such total cost shallbe paid out of the city treasury and the othertwo-thirds from the persons owning at thedate of the adoption of this ordinance the real estateabutting on said Berrien street to be improved underthis ordinance, according to frontage, and the prorata amount of the cost of such work is herebyassessed against the said abutting real estate and itsowners, as aforesaid, according to the frontage. Thefrontage of intersecting streets and lanes is assessedas real estate abutting upon said Berrien street to beimproved, and the Mayor and Aldermen of the cityof Savannah shall be, for all intente and purposes ofthis ordinance, the owner of the real estate so abutting,and shall pay irom the city treasury its just prorata as such owner of the cost of said work, accordingto the frontage, in addition to its one-third of theentire cost as heinbefore provided.Sec. 3. Be it further ordained, That after the improvementhereinbefore provided for has been completed,the Director of Public Works for the city ofSavannah and the said Committee on Streets andLanes shall prepare and submit to Council of thecity of Savannah a statement showing the cost of theimprovement herein provided for; and also an assessmentroll showing as to two-thirds of the cost to be
