It seems likely, but its application may change. Editor]In <strong>the</strong> 1980’s some cabbies in Toronto asked for and got UI benefits. Even if this was not applied inKingston, this made drivers self-employed for GST purposes, but eligible for EI benefits.Canada Customs and Revenue Agency (CCRA) administers <strong>the</strong> GST and Employment Insurance.Gordon Heath, CCRA Trust <strong>Account</strong>s Examiner, wrote that since all drivers employed by [a taxiowner] were operating under a contract for service, <strong>the</strong>y were self-employed and must have individualGST numbers, but remain eligible for EI.This regulation of drivers by <strong>the</strong> Excise Tax Act means that owners and drivers must register for GST,and owners must issue a T-4 Supplementary Slip, regardless of whe<strong>the</strong>r <strong>the</strong> drivers are self-employedor are employees.All self-employed drivers must keep a record of earnings, get a GST number, provide that number to<strong>the</strong> owner, and file a GST return with <strong>the</strong> amount of tax owing.In order to file, <strong>the</strong> driver must retain <strong>the</strong> proportion of <strong>the</strong> GST corresponding to his share of <strong>the</strong> sheet(usually 45% of <strong>the</strong> GST) and pay <strong>the</strong> rest to <strong>the</strong> owner. The owner claims <strong>the</strong> driver portion as anInput Tax Credit on his own return. A driver who pays half of <strong>the</strong> costs claims half of <strong>the</strong> GST paid outas a credit on his GST return.Regulation 6(e) of <strong>the</strong> EI act defines <strong>the</strong> earnings of any driver as insurable for EI purposes if <strong>the</strong>driver is not <strong>the</strong> owner of more than 50% of <strong>the</strong> vehicle or <strong>the</strong> owner or operator of <strong>the</strong> business.CCRA states that <strong>the</strong> owner currently must pay HIS portion of <strong>the</strong> EI premiums (3.15% of gross fares)and <strong>the</strong> employee portion (2.25% of <strong>the</strong> gross fares) for all self-employed drivers. The owner this pays5.4% of his gross as EI premiums.[The use of gross income as <strong>the</strong> basis of premiums is being challenged because <strong>the</strong> owner’s share of<strong>the</strong> gross is not EI insurable.]Can a partnership/lease exempt us?I don’t think so. In a 50/50 partnership, <strong>the</strong> plateholder might be defined as owner and pay EI for <strong>the</strong>o<strong>the</strong>r partner, even though nei<strong>the</strong>r one owns more than 50% of <strong>the</strong> business.The plateholder of a leased car may have to pay EI premiums whe<strong>the</strong>r he gets trip sheets or not. TaxCourts have established that <strong>the</strong> EI payable by an owner who doesn’t record employees’ earnings isbased on 2/3 of <strong>the</strong> maximum rate of earnings.Owners stand to lose 5.4% of <strong>the</strong>ir gross, or of drivers’ earnings, depending on <strong>the</strong> ruling. Drivers willhave to keep better records and get EI coverage.Will leasing be less attractive if owners have to pay EI?
