Resolution 4 G.R. <strong>No</strong>. <strong>192727</strong>After <strong>the</strong> crowning ceremony, <strong>the</strong> petitioner delivered a speech,stating that he had never won at Barangay Biasong in any election. Thiscaught <strong>the</strong> ire <strong>of</strong> a group <strong>of</strong> supporters <strong>of</strong> <strong>the</strong> rival political party who <strong>the</strong>nshouted invectives at <strong>the</strong> petitioner. 11Shamed by <strong>the</strong> insults hurled at him, <strong>the</strong> petitioner cut short hisspeech and, <strong>the</strong>reafter, went back to his table. However, <strong>the</strong> mockingcontinued. Thereupon, <strong>the</strong> petitioner, with <strong>the</strong> loaded firearm in hand, wentto <strong>the</strong> table occupied by his political rivals. He <strong>the</strong>n stared at Atty. Maglanaand <strong>the</strong>reafter fired a shot upwards, causing <strong>the</strong> crowd to scamper for safety.The petitioner’s bodyguards immediately took hold <strong>of</strong> his hand to preventhim from firing ano<strong>the</strong>r shot. Consequently, Ali Prudenciado, a formerpoliceman and <strong>the</strong>n, a kagawad, disarmed <strong>the</strong> petitioner. 12The following morning, <strong>the</strong> Chief <strong>of</strong> Police <strong>of</strong> Almagro, Samarentered <strong>the</strong> incident into <strong>the</strong> police blotter as an “accidental firing”. 13The Defense’s VersionThe petitioner denied that he was in possession <strong>of</strong> a firearm during <strong>the</strong>April 3, 1995 fiesta celebration in Barangay Biasong. He claimed that, whilehe was delivering his speech <strong>the</strong>rein, a group <strong>of</strong> people were shouting insultsat him. <strong>No</strong>t wanting to aggravate <strong>the</strong> situation, <strong>the</strong> petitioner abruptly endedhis speech and went to <strong>the</strong> group to ask <strong>the</strong>m not to disturb <strong>the</strong> festivities. 14The group, however, continued to mock <strong>the</strong> petitioner, prompting PO3Conrado Unajan (PO3 Unajan) to draw his firearm from his holster to pacify<strong>the</strong> unruly crowd. When <strong>the</strong> petitioner saw this, he tried to take <strong>the</strong> firearmaway from PO3 Unajan and, in <strong>the</strong> process, a shot was accidentally fired.11121314Id.Id. at 21-22.Id. at 22.Id.
