In all other cases Earnest money deposit will be refundable.ii) Earnest money of the unsuccessful bidders will be refunded on their applicationonly after an intimation of rejection of their tender is sent to them.

2) SECURITY DEPOSIT:i) Amount of total security deposit to be paid shall be 4% (Four percent) of theawarded cost of work. The successful bidder shall have to pay half the securitydeposit for due performance of the contract within seven days of the acceptanceof the tender in the form of Pay order, Demand Draft, cash remittance in cashcounter of NWCMC or by unconditional, irrevocable Bank Guarantee withvalidity for the required period issued by Nationalised Bank / Scheduled Bank infavour of Municipal Commissioner, NWCMC, Nanded . The balance securitydeposit will be recoverable through the bills at the percentage specified or asmay be decided by the Executive Engineer (WS&SW), NWCMC Nanded duringcourse of execution of the work, looking to the position and circumstances thatmay prevail, whose orders will be final and binding on the Contractor.iii) In the event of failure on the part of the bidder to pay security deposit within 7days (unless extended in writing by the Municipal Commissioner,) from the dateof receipt of notice (sent by Registered Post/Courier/Fax) of acceptance of hisoffer, the amount of earnest money shall be forfeited by NWCMC Nanded andthe acceptance of his tender, shall be considered / stand withdrawn, except that inthe event of the notice of acceptance of the tender not being issued within 90days of the date of opening of Envelope No.2 (Financial bid),the bidder shallhave an option (to be intimated in writing fifteen days before the expiry of 90days period) of withdrawing his tender, in which case the earnest money shouldbe refunded in full. All the tenders shall remain open for acceptance for 90 daysfrom the date fixed for opening of Envelope No.1 and thereafter until it iswithdrawn by the bidder by notice in writing as per condition aforesaid.OTHER INSTRUCTIONS :1. The acceptance of the tender may be intimated to the successful bidder byFax/Telegraphically/in writing and by the Officer competent to accept the tender.2. In case, there is discrepancy in between the percentages written in figures andwords, the lower offer will be taken as final.3. No pages should be removed from, added in, or replaced in tender document.4. An Index showing the criteria required / criteria actually fulfill / Page No. ofdocuments attached, should be enclosed with the tender documents of TechnicalBid.5. Income Tax:The income tax @ 2.00% and surcharge if applicable or at the rates amendedfrom time to time as intimated by competent income tax authority shall bededucted from the bill amount, whether measured bill, advance payment orsecurity advance.6. Value Added Tax ( VAT):Value Added Tax ( VAT) tax @ 2.00% or at the rates amended from time to timeas intimated by competent authority shall be deducted from the bill amount,whether measured bill, advance payment or security advance .If TIN No. isprovided . In case of no TIN No. , VAT will be 4 %.

7. 1 % of Contract amount will be deducted from bills as per the provision oflabour Act.8 Right is reserved to revise or amend the contract document prior to the datenotified for the receipt of tender or extended date. TENDER FOR THE WORK OFPROVIDING AND LAYING OF SEWERAGE COLLECTION SYSTEM IN CIDCO,HUDCO AND OTHER AREA OF SOUTH NANDEDThe full name and address of the bidder and the name of the authorized agent delivering thesealed cover containing the tender shall be written on the bottom left hand corner. Ifsubmitted by post / courier service the sealed envelope marked as above, shall be enclosedin another cover properly addressed and shall be sent by Registered Post Acknowledgmentpost / courier service. The date and time of the receipt of Envelope containing tender shallstrictly apply in all cases. The bidder shall ensure that his tender is received by theMunicipal Commissioner, Nanded - Waghala City Municipal Corporation, Nanded beforethe expiry of the date and time. No delay on account of any cause shall be entertained for thereceipt of the tender offered or received after the date and time is over will either not beaccepted or if inadvertently accepted will not be opened and returned to the bidder.a. OPENING OF TENDERThe tenders will be opened on the same day and time, as specified. The following procedurewill be adopted for opening of the tender.1) TECHNICAL BID: First of all the Technical Bid will be opened. After downloadingall the documents of each bidder, the bids will be examined for technical evolution. If thevarious documents contained in this do not meet the requirements of the tender notice,conditions given in tender booklet, a note will be recorded accordingly by the tenderopening authority and the said tender the "Financial bid" will not be opened but the samewill be recorded and maintained for one year from date of opening. The details furnished inthe technical bid envelope will be evaluated and the bidders whose tenders are found to besubstantially responsive will be intimated about the date and time of opening of the financialbid envelope.2) FINANCIAL BID :The documents will be downloaded, opened, only in respect of those bidders for whomcontents of Technical Bid are found to be acceptable .The date for opening of Financial Bidwill be duly intimated to the bidders whose tenders are found acceptable. The tendered ratespercentage above / equal / below the estimated rates quoted on page No 26 shall then beread out.b. SIGNING OF TENDER PAPERSThe contractor will have to upload the declaration stating that he agree to do the work atdescribed in the original copy of the tender paper, addendum if any issued and the detaileddrawings. He shall also have to upload a declaration to the effect that he has fully studied

the plans, specifications, local conditions and availability of labour and materials and that hehas quoted his rates with due consideration to above all facts. There is no need to upload thetender documents again.c. EXAMINATION OF DRAWING AND SITE CONDITIONS:The bidder shall, in his own interest carefully examine the drawings, conditions of contractspecifications etc. He shall also inspect the site and get acquainted himself about theclimate, physical and all other conditions prevailing at site, the nature, magnitude, specialfeatures, and practicability of the works, all existing and required means of communicationsand access to site, availability of housing and other facilities, the availability of labour andmaterials, labour camp site stores and Godowns etc. He shall obtain all necessaryinformation as to the risk. Contingencies and other circumstances which may affect andinfluence the tender. No claims on any of the above or any other factors which may affect orinfluence the tender will be entertained by the Municipal Corporation should there be anydiscrepancy or doubt or obscurity as to meaning of any of tender documents or as toinstructions to be observed by him he shall set forth in writing such discrepancies, doubts,obscurity and submit the same to the Executive Engineer (WS&SW), Nanded - WaghalaCity Municipal Corporation, Nanded for elucidation as soon as possible.d. The contractor whose tender is accepted is required to note that no foreign exchange will bereleased by the Municipal Corporation.e. The notice-inviting tender shall form a part of the tender agreement.f. The successful tender shall be required to produce to the satisfaction of the specifiedconcerned authority, a valid and concurrent license issued in his favor under the provisionsof the contractor labour (Regulation and Abolition) Act 1970, before starting the work. Onfailure to do so acceptance of the tender shall be withdrawn and security deposit forfeited.

ADDITIONAL CONDITIONS:1. In case the contractor quotes more than 10% below the percentage rate than the estimatedrates in the specified space the contractor will have to pay additional security deposit equalto the amount of difference between % quoted by him and the amount of 10% below.Additional security deposit will have to be produced in shape of FDR or in the form asdirected by the Municipal Commissioner, NWCMC before the letter of acceptance of tenderis issued by this office. The additional security deposit will be released along with the finalbill.2. In case the additional security deposit is not paid, the amount of EMD will be forfeited.3. It is compulsory for contractors to submit paid certificate issued by the Collector, Nandedfor Royalties, Quarry fees before completion of the work or as and when demanded byExecutive Engineer (WS&SW), NWCMC, Nanded.4. Contractor shall take out necessary insurance policy / Policies (Viz. contractors all risksinsurance policy, Erection all risks insurance policy etc. so as to provide adequate insurancecover for execution of the awarded contract work for total contract value and completecontract period.5. All workmen appointed to complete the contract work are required to be insured underworkmen's compensation Insurance Policy. Insurance policy from the company owned byGovernment.6. The work should not be started unless clearance there for is given by MunicipalCommissioner / Executive Engineer (WS&SW) NWCMC Nanded.7. Contractor should have registration with state Govt. in respect of EPF and ESI under StateInsurance Rule 1 ( 5). Attested copies of these documents should be submitted.

After verifying the details furnished by the bidders in the Envelope No.1, the bidderswhose tenders are found to be substantially responsive to the conditions will beintimated about the time and date of opening of their Financial Bid cover. TheMunicipal Commissioner, Nanded Waghala City Municipal Corporation, Nanded orhis duly Authorized assistant shall open the Envelopes containing the Financial Bidin the presence of Contractors who have submitted tenders or their representativeswho may be present at the time, and he will enter the amounts of the several tendersin a comparative statement in a suitable form. In the event of a tender being acceptedthe Contractor shall for the purpose of identification, sign copies of thespecifications and other documents mentioned in Rule 1. In the event of tender beingrejected, the Executive Engineer (WS&SW), NWCMC, Nanded shall refund theamount of the earnest money deposited, to the contactor making the tender, on hisgiving a receipt for the return of the money.6. The officer competent to dispose of the tenders shall have the right of rejecting all orany of the tenders without assigning any reason.7. No receipt for any payment alleged to have been made by a Contractor in regard toany matter relating to this tender or the Contract shall be valid and binding onMunicipal Commissioner, unless it is signed by Municipal Commissioner, Nanded -Waghala City Municipal corporation, Nanded.8. The memorandum of work to be tendered for and the schedule of materials to besupplied by the Department and their rates shall be filled in and completed by theoffice of the Executive Engineer (WS&SW) . Nanded - Waghala city MunicipalCorporation, Nanded before the tender form is issued. If a form issued to anintending bidder has not been so filled in and completed he shall request and saidoffice to have this done before he complete and delivers his tender.9. All works shall be measured according to the rules and customs of the PublicWorks Department and I.S.I and without reference to any local custom.10. Under no circumstance shall any Contractor be entitled to claim enhanced rates forany items in this contact.11. Every registered Contractor should produce along with his tender Certificate ofregistration as approved Contractor in the appropriate class and renewal of suchregistration with date of expiry minimum three months ahead from the date ofsubmission of tender (copies to be attested by Gazetted Officer). If the successfulbidder is a registered contractor in some other department, he then should registerhimself in NWCMC submitting necessary application form and remitting the fees.12. All corrections and additions or pasted slips should be signed.

13. The measurements of work will be taken according to the usual methods in use inthe Public Works Department and no proposals to adopt alternative methods will beaccepted. The Executive Engineer (WS&SW), NWCMC Nanded decision as to whatis "the usual method in use in the "Public Works Department" will be final.14. Every bidder shall submit along with the tender information regarding the incometax circle or ward of the district in which he is assessed to income tax, the referenceto the number of the assessment and the assessment year.15. No foreign exchange would be released by the Department for the purchase of plantand machinery required for the execution of the work contracted for.16. The Contractor will have to construct shed / Godowns for storing controlled andvaluable materials issued to him if any at work site having double lockingarrangement. The materials will be taken for use in the presence of the departmentperson. No materials will be allowed to be removed from the site of works.17. The tendering Contractor shall furnish a declaration along with the tender showingall works for which he has already entered into Contract and the value of the workthat remains to be executed in each case on the sate of submitting the tender (withcopy of Certificate from the head of the office concerned duly attested formGazetted officer).18. The Contractors shall also upload a list of machinery in their possession and whichthey propose to use on the work in the form of Statement No. II and Statement II(A).19. Successful bidder will have to produce to the satisfaction of the accepting authority avalid and current license issued in his favour under the provision of contractor labour(Regulation and Abolition) Act, 1970 before starting work, failing which acceptanceof the tender will be liable for withdrawal and earnest money will be forfeited toMunicipal Corporation. However, the contractors who are registering themselves inNWCMC newly will be given a deadline by the Commissioner, NWCMC beforewhich the same shall be produced.20. The Contractor shall comply with the provision of the Apprentices Act, 1961 and therules and orders issued there under from time to time. If he fails to do so, his failurewill be breach of the contract and the Municipal commissioner, Nanded - WaghalaCity Municipal Corporation, Nanded may in his discretion cancel the Contract. TheContractor shall also be liable for any pecuniary liability arising on account of anyviolation by him of the provisions of the Act.ADDITIONAL CONDITION:If the offer is less than the estimated rate put to tender then the total and full amountof difference between less quoted rates and 10% below the estimated rate will haveto be paid in the shape of FDR issued from the Natinalised Bank / Schedule Bank orin the form as directed by Commissioner in favour of Municipal Commissioner,NWCMC, Nanded along with the security deposit.
