<strong>of</strong> importer, customs authorities may allow extension <strong>of</strong>bond period on merits.Import <strong>of</strong> Overseas 2.45 On winding up <strong>of</strong> overseas <strong>of</strong>fices, set up with approval <strong>of</strong> RBI,Office Equipmentused <strong>of</strong>fice equipment and other items may be imported withoutAuthorisation.2.46 DeletedPrototypes 2.47 Import <strong>of</strong> new / second hand prototypes / second hand samplesmay be allowed on payment <strong>of</strong> duty without an Authorisation toan Actual User (industrial) engaged in production <strong>of</strong> or havingindustrial licence / letter <strong>of</strong> intent for research in item for whichprototype is sought for product development or research, as thecase may be, upon a self-declaration to that effect, to satisfaction<strong>of</strong> customs authorities.Restricted items 2.48 All restricted items and items permitted to be imported by STEs,for R&Dexcept live animals, required for R&D purpose may be importedwithout an Authorisation by Government recognized Research andDevelopment units.Export Policy 2.49 Policy relating to Exports is given in Chapter-2 <strong>of</strong> FTP. Further,Schedule 2, Appendix-1 <strong>of</strong> ITC (HS) specifies list <strong>of</strong> items, whichmay be exported without an Authorisation but subject to termsand conditions specified.Application for 2.50 An application for grant <strong>of</strong> Export Authorisation in respect <strong>of</strong> itemsGrant <strong>of</strong> Exportmentioned in Schedule 2 <strong>of</strong> ITC (HS) may be made in ANF 2DLicence / Certificate /(2E for SCOMET items) to DGFT along with documentsPermissionprescribed therein. EFC shall consider applications on merits forissue <strong>of</strong> export Authorisation.An Inter-Ministerial Working Group in DGFT shall considerapplications for export <strong>of</strong> Special Chemicals, Organisms,Materials, Equipment and Technologies (SCOMET) as specifiedin Appendix-3 to Schedule 2 <strong>of</strong> ITC (HS) based on guidelinesgiven below.Applications for licences to export items or technology onSCOMET List are considered case-by-case, based inter alia onthe following general criteria: -I. Following factors, among others, are taken into accountin the evaluation <strong>of</strong> applications for export <strong>of</strong> items onSCOMET List:a. Credentials <strong>of</strong> end-user, credibility <strong>of</strong> declarations<strong>of</strong> end-use <strong>of</strong> the item or technology, integrity <strong>of</strong>chain <strong>of</strong> transmission <strong>of</strong> item from supplier to end-33
