Appendix VI: Health Services (No. 3) Regulations, 1983 – S.I<br />

No. 381 of 1983 (People Aged 16-25 Years)<br />

The relevant regulation governing the provision of services to people aged 16 to 25 years is the<br />

Health Services (No. 3) Regulations, 1983 – S.I. No. 381 of 1983. The full text of those regulations<br />

is: -<br />

“The Minister for Health, in exercise of the powers conferred on him by Section 5 of the Health Act,<br />

1947 (No.28 of 1947) and by Section 72 of the Health Act, 1970 (No. 1 of 1970) hereby makes the<br />

following Regulations:<br />

1. These Regulations may be cited as the Health Services (No. 3) Regulations, 1983.<br />

2. The services provided under Section 58 (1), 59 (1) and 67 (1) of the Health Act, 1970 shall not<br />

extend to persons between the ages of 16 and 25 who are dependants of persons who do not have full<br />

eligibility for the services under Part IV of the Health Act, 1970 save where it is considered by the<br />

Chief Executive Officer of the appropriate Health Area that such a service should be made available<br />

to such a person in order to avoid undue hardship to that person.<br />

3. These Regulations shall not apply to persons in receipt of an allowance under section 69 (1) of<br />

the Health Act, 1970.<br />

4. These Regulations shall come into operation on the 1st day of January, 1984”.<br />

Note to HSE Staff:<br />

The Health Services (No.3) Regulations, 1983- S.I. No. 381 of 1983, set out the legislative basis for<br />

the assessment of this age category for <strong>Medical</strong> <strong>Card</strong> <strong>Assessment</strong>. Though this legislation does not<br />

extend to the assessment of GP <strong>Visit</strong> <strong>Card</strong>s, a policy decision has been taken, in the interest of equity<br />

and consistency, that this category would be assessed in the same manner for both the <strong>Medical</strong> <strong>Card</strong><br />

and GP <strong>Visit</strong> <strong>Card</strong> Applications when deciding the issue of whether a person is dependant or<br />

independent. The criteria used in Section 3.9 to determine whether a person is “Dependant or<br />

Independent” will be applied in a consistent manner in assessing <strong>Medical</strong> <strong>Card</strong>s and GP <strong>Visit</strong><br />

<strong>Card</strong>s.<br />
