(8) The Minister may make regulations for the purposes of this section and such regulations may<br />

contain such incidental, supplementary and consequential provisions as appear to the Minister to be<br />

necessary for the purposes of the regulations.<br />

(9) Without prejudice to the generality of subsection (8), regulations may –<br />

and<br />

a) provide for the manner in which payments by boards or the Board to community pharmacies<br />

and persons referred to in subsection (4) and (5) in respect of drugs supplied by such<br />

pharmacies and persons under this section and in respect of fees charged by such pharmacies<br />

and persons for services provided by them in connection with such supply are to be made<br />

and, subject to subsection (6), for the manner in which or the matters by reference to which<br />

the amounts of such payments are to be determined by boards or the Board,<br />

b) provide for the furnishing by community pharmacies and persons referred to in subsections<br />

(4) and (5) to a board or the Board, if so requested by it, of such information as it may<br />

reasonably require for the purposes of its functions under this Act, including such proof as it<br />

may reasonably require of –<br />

(i) the quantities and kinds of drugs supplied under (1) to (5) by community<br />

pharmacies and persons referred to in subsections (4) and (5),<br />

(ii) the services referred to in paragraph (a) and the provisions of such services,<br />

(iii) the cost to community pharmacies and persons referred to in subsections (4)<br />

and (5) of drugs supplied, and services provided, by them as aforesaid, and<br />

(iv) the dates on which or periods during which drugs or specified drugs were so<br />

supplied and such services or specified such services were so provided.<br />

c) provide for the furnishing by suppliers to a board or the Board, if so requested by it, of such<br />

information as it may reasonably require for the purposes of its functions under this Act,<br />

including such proof as it may reasonably require of –<br />

(i) the quantities and kinds of drugs supplied by them to community pharmacies<br />

and persons referred to in subsections (4) and (5) or classes of such pharmacies or<br />

persons or particular such pharmacies or persons for the purposes of those subsections<br />

and subsections (1), (2) and (3),<br />

(ii) the cost of such drugs, and<br />

(iii) the dates on which or periods during which such drugs or specified such drugs<br />

were so supplied,<br />

d) provide that a board or the Board may refuse to make a payment referred to in paragraph (a)<br />

if the community pharmacy, or person referred to in subsection (4) or, as the case may be,<br />

(5), concerned fails or refuses to comply with a request pursuant to regulations under<br />

paragraph (b), and different provision may be made in respect of different classes of<br />
