(4) This section does not apply in relation to the functions of the Hospital Bodies Administrative<br />

Bureau”.<br />

Section 68 of the Health Act 2004<br />

“Subject to section 59, references (however expressed) in any Act passed before the establishment<br />

day or in any instrument made before that day under such Act to-<br />

a) the chief executive officer of the health board,<br />

b) the Regional Chief Executive of the Eastern Regional Health Authority, or<br />

c) the area chief executive of an Area Health Board,<br />

are to be read as references to the chief executive officer of the Executive”.<br />

Section 46 of the Health Act 1970<br />

“Any person ordinarily resident in the State who is without full eligibility shall, subject to section 52<br />

(3), have limited eligibility for the services under this Part”<br />

Section 47 of the Health Act 1970<br />

“(1) When, in the administration of section 45, 46 or 58(46 referring to limited eligibility), an officer<br />

of a Health Board decides that a person does not come within a category specified by or under the<br />

relevant section, an appeal shall lie from the decision to a person (being either another officer of the<br />

Health Board or a person not such an officer) appointed or designated by the Minister.<br />

(2) The Minister may by regulation provide for the making and determination of appeals under this<br />

section.”<br />

Section 47(A) –“The Minister may issue guidelines to –<br />

a) the chief executive officers of health boards, and<br />

b) persons appointed or designated by him under section 47 (1),<br />

to assist each of them in deciding whether or not a person is ordinarily resident in the State for the<br />

purposes of sections 45, 46 and 58.”<br />
