Absence of Entire FamilyPHA PolicyThe guidelines below address situations when the family is absent from the unit, but hasnot moved out of the unit. In cases where the family has moved out of the unit, the PHAwill terminate assistance in accordance with termination procedures contained in this Plan.Families are required both to notify the PHA before they move out of a unit and to givethe PHA information about any family absence from the unit.Families must notify the PHA within 10 days after leaving the unit if they are going to beabsent from the unit for more than 45 consecutive days.If the entire family is absent from the assisted unit for more than 45 consecutive days, theunit will be considered vacated and the assistance will be terminated. If it is determinedthat the family is absent from the unit, the PHA will not continue assistance payments.HUD regulations require the PHA to terminate assistance if the entire family is absentfrom the unit for a period of more than 180 consecutive calendar days."Absence" means that no family member is residing in the unit.To determine if the family is absent from the unit, the PHA may:Write letters to the family at the unitTelephone the family at the unitInterview neighborsVerify if utilities are in serviceCheck with the post officeA person with a disability may request an extension of time as an accommodation,provided that the extension does not go beyond the HUD-allowed 180 consecutivecalendar day’s limit.If the absence that resulted in termination of assistance was due to a person's disability,and the PHA can verify that the person was unable to notify the PHA in accordance withthe family's responsibilities, and if funding is available, the PHA may reinstate the familyas an accommodation. The family must make this request within 10 business days of thedate of termination.Absence due to Military DutyPHA PolicyFamily members called to active duty will not be considered absent from the householdduring their term of active duty.© Copyright 2008 Nan McKay & Associates, Inc.
