Ineligible <strong>Housing</strong> Types [24 CFR 983.53]THE PHA may not attach or pay PBV assistance to shared housing units; units on the grounds ofa penal reformatory, medical, mental, or similar public or private institution; nursing homes orfacilities providing continuous psychiatric, medical, nursing services, board and care, orintermediate care (except that assistance may be provided in assisted living facilities); units thatare owned or controlled by an educational institution or its affiliate and are designated foroccupancy by students; manufactured homes; cooperative housing; and transitional housing. Inaddition, THE PHA may not attach or pay PBV assistance for a unit occupied by an owner andTHE PHA may not select or enter into an agreement to enter into a HAP contract or HAPcontract for a unit occupied by a family ineligible for participation in the PBV program.High-rise Elevator Projects for Families with Children [24 CFR 983.53(b)]THE PHA may use high-rise elevator building for families with children if it makes adetermination that there is no practical alternative and HUD approves THE PHA determination.THE PHA may make this initial determination for its project-based voucher program, in wholeor in part, and need not review each project on a case-by-case basis, and HUD may approve onthe same basis.THE PHA will not use high-rise elevator projects for families with children.Subsidized <strong>Housing</strong> [24 CFR 983.54]A PHA may not attach or pay PBV assistance to units in any of the following types of subsidizedhousing: A public housing unit; A unit subsidized with any other form of HCV assistance; A unit subsidized with any governmental rent subsidy; A unit subsidized with any governmental subsidy that covers all or any part of the operatingcosts of the housing; A unit subsidized with Section 236 rental assistance payments (except that a PHA may attachassistance to a unit subsidized with Section 236 interest reduction payments);A Section 202 project for non-elderly with disabilities;Section 811 project-based supportive housing for persons with disabilities;Section 202 supportive housing for the elderly;A Section 101 rent supplement project;A unit subsidized with any form of tenant-based rental assistance;A unit with any other duplicative federal, state, or local housing subsidy, as determined byHUD orthe PHA in accordance with HUD requirements.18-II.E.
