DefinitionsFor purposes of determining whether a tenant may be covered by VAWA, the following list ofdefinitions applies:VAWA defines domestic violence to include felony or misdemeanor crimes of violencecommitted by any of the following:A current or former spouse of the victimA person with whom the victim shares a child in commonA person who is cohabitating with or has cohabitated with the victim as a spouseA person similarly situated to a spouse of the victim under the domestic or family violence lawsof the jurisdiction receiving grant moniesAny other person against an adult or youth victim who is protected from that person’s acts underthe domestic or family violence laws of the jurisdictionVAWA defines dating violence as violence committed by a person (1) who is or has been in asocial relationship of a romantic or intimate nature with the victim AND (2) where the existenceof such a relationship shall be determined based on a consideration of the following factors:The length of the relationshipThe type of relationshipThe frequency of interaction between the persons involved in the relationshipVAWA defines stalking as (A)(i) to follow, pursue, or repeatedly commit acts with the intent tokill, injure, harass, or intimidate another person OR (ii) to place under surveillance with theintent to kill, injure, harass, or intimidate another person AND (B) in the course of, or as a resultof, such following, pursuit, surveillance, or repeatedly committed acts, to place a person inreasonable fear of the death of, or serious bodily injury to, or to cause substantial emotional harmto (i) that person, (ii) a member of the immediate family of that person, or (iii) the spouse orintimate partner of that person.© Copyright 2008 Nan McKay & Associates, Inc. Chapter 17SOCIAL SECURITY NUMBER AND SOCIAL SECURITY BENEFITVERIFICATION[24 CFR 982.516, 24 CFR 982.551, 24 CFR 5.230]INTRODUCTIONThis chapter explains the procedures PHAs are required to use for verifying SocialSecurity numbers (SSN), Social Security benefits of applicants, participants andhousehold members at the time of application for rental assistance programs and duringmandatory reexamination of household income. Similar guidance with respect toverification of SS and SSI benefits was issued under Notice PIH-2008-44.This chapter also provides guidance related to the recent changes made to 24 CFR 5.216,24 CFR 5.218, and new verification requirements at 24 CFR 5.233, in accordance withthe Final Rule: Refinement of Income and Rent Determinations in Public and AssistedHousing Programs: Implementation of the Enterprise Income Verification System-Amendments, effective January 31, 2010, as published at 74 FR 68924, on December 29,2009. The section applies toHousing Choice Voucher Programs, Section 8 ModerateRehabilitation, Project Based Certificate, and Project Based Voucher Programs andMoving to Work (MTW) PHA’s.HUD uses the SSN (along with the name and date of birth) of an individual to validatehis/her identity, obtain employment and income information via computer matchingprograms, and ensure duplicate assistance is not being paid. These uses allow HUD,program administrators and auditors to determine compliance with programrequirements, as well, as determine the eligibility and level of assistance a family iseligible to receive. The chapter prescribes the procedures and clarifies the requirementsfor disclosure, documentation and verification of SSNs.In addition this chapter describes the required procedures for verifying SS and SSIbenefits of applicants, participants, and household members of HUD-assisted rental units,in order to comply with the new HUD regulation at 24 CFR 5.233, which requires PHAsto use EIV.Page 17- 1 Revised/Approved 04/08/10 (Eff: 07/01/10)
