Collection of Housing Assistance OverpaymentsThe owner/agent will not be charged for any unearned HAP for termination due to FamilyObligations.PHA PolicyTermination due to Family ObligationsWithout a hearing:If a hearing is not requested, the PHA will terminate as outlined in Chapter 12Hearing requested but not attended:If a hearing is requested but not attended by the family representative, the PHA willterminate as outlined in Chapter 12With a hearing (termination upheld):If a hearing is requested and the termination is upheld, the Housing Assistance Paymentwill be paid to the owner through the end of the month the hearing was held provided thefamily is still residing in the unit.Bad Debt Write OffsBad debts will be written off by the PHA if:The debt is 7 years old or olderThe debtor is deceased or is otherwise “judgment proof”The debtor is confined to a penal institution for more than 7 yearsThe amount is $50 or less and the debtor cannot be locatedThe PHA cannot produce supporting documentation of the debt incurred© Copyright 2008 Nan McKay & Associates, Inc.
