Family Debts to the PHAPHA PolicyA Payment Agreement as used in this Plan is a document entered into between the PHAand a person who owes a debt to the PHA. It is similar to a promissory note, but containsmore details regarding the nature of the debt, the terms of payment, any specialprovisions of the agreement, and the remedies available to the PHA upon default of theagreement.The PHA will prescribe the terms of the payment agreement, including determiningwhether to enter into a payment agreement with the family based on the circumstancessurrounding the debt to the PHA.If the family refuses to repay the debt, enter into a repayment agreement, or breaches arepayment agreement, the PHA will terminate the assistance upon notification to thefamily and pursue other modes of collection.There are some circumstances in which the PHA will not enter into a payment agreement.They are:• If the family is an applicant• If the family already has a Payment Agreement in place and is in default• If the PHA determines that the family committed program fraud.• If the PHA determines that the debt amount is larger than can be paid back by thefamily within one year.• If the amounts owed by the family or owner exceeds the Federal or Statethreshold for criminal prosecution.The amount for which the PHA will enter into a payment agreement with a family will bedetermined on a case-by-case basis, depending on the family’s ability to pay in a twelvemonthperiod.The minimum amount for which the PHA will enter into a payment agreement with afamily will be $500. Any amount less than $500 must be paid in full.The maximum length of time the PHA will enter into a payment agreement with a familyis one year.To qualify for a payment agreement, the family must make a down payment of one thirdof the amount owed.Repayment Agreement [24 CFR 792.103]The term repayment agreement refers to a formal document signed by a tenant or owner andprovided to the PHA in which a tenant or owner acknowledges a debt in a specific amount andagrees to repay the amount due at specific time periods.© Copyright 2008 Nan McKay & Associates, Inc.
