PART IV: OWNER OR FAMILY DEBTS TO THE PHA16-IV.A. OVERVIEWPHAs are required to include in the administrative plan, policies concerning repayment by afamily of amounts owed to the PHA [24 CFR 982.54]. This part describes the PHA’s policies forrecovery of monies that have been overpaid on behalf of families, or to owners.PHA PolicyWhen an action or inaction of an owner or participant results in the overpayment ofhousing assistance, the PHA holds the owner or participant liable to return anyoverpayments to the PHA.The PHA will enter into repayment agreements in accordance with the policies containedin this part as a means to recover overpayments.When an owner or participant refuses to repay monies owed to the PHA, the PHA willutilize other available collection alternatives including, but not limited to, the following:Requests for lump sum paymentsCivil suitsPayment agreementsReductions in HAP to ownerDenial or Termination of assistanceCollection agenciesSmall claims court16-IV.B.
