Attendance at the Informal HearingPHA PolicyA hearing officer and the following applicable persons may attend hearings:A PHA representative and any witnesses for the PHAThe participant and any witnesses for the participantThe participant’s counsel or other representativeAny other person approved by the PHA as a reasonable accommodation for aperson with a disabilityConduct at HearingsThe person who conducts the hearing may regulate the conduct of the hearing in accordance withthe PHA’s hearing procedures [24 CFR 982.555(e)(4)(ii)].PHA PolicyThe hearing officer is responsible to manage the order of business and to ensure thathearings are conducted in a professional and businesslike manner. Attendees are expectedto comply with all hearing procedures established by the hearing officer and guidelinesfor conduct. Any person demonstrating disruptive, abusive or otherwise inappropriatebehavior will be excused from the hearing at the discretion of the hearing officer and thetermination will stand.The hearing officer shall:Announce that this is an informal hearing of the PHA;Announce the time and date of the hearing;Introduce himself or herself and all parties present;State the intended action of the PHA, the reason for the action and the purpose ofthe hearing;Explain that the hearing is informal, but that the decision of the hearing officer isbinding on the PHA unless the decision concerns a matter for which the PHA isnot required to provide an opportunity for an informal hearing, or otherwiseexceeds the authority of the hearing officer, or the hearing decision is found to becontrary to HUD regulations or requirements, or otherwise contrary to Federal,State or local law;Explain that the proceedings may be recorded to maintain a record of thetestimony provided during the hearing;© Copyright 2008 Nan McKay & Associates, Inc.
