Legal Ownership of UnitThe following represents PHA policy on legal ownership of a dwelling unit to be assisted underthe HCV program.PHA PolicyThe PHA will only enter into a contractual relationship with the legal owner of aqualified unit, or their designated representative. If a party other than the owner willmanage the property, the owner must provide a copy of the most current TAR/TRECmanagement agreement form or a notarized statement specifying the designee(s) andsigned by the owner.No tenancy will be approved without acceptable documentation of legal ownership (e.g.,recorded deed of trust, final settlement statement signed by all parties, proof of taxes formost recent year).13-I.E. NON-DISCRIMINATION [HAP Contract – Form HUD-52641]The owner must not discriminate against any person because of race, color, religion, sex,national origin, age, familial status, or disability, in connection with any actions orresponsibilities under the HCV program and the HAP contract with the PHA.The owner must cooperate with the PHA and with HUD in conducting any equal opportunitycompliance reviews and complaint investigations in connection with the HCV program and theHAP contract with the PHA.See Chapter 2 for a more thorough discussion of Fair <strong>Housing</strong> and Equal Opportunityrequirements in the HCV program.© Copyright 2008 Nan McKay & Associates, Inc.
