Reasonable Accommodation [24 CFR 982.552(c)(2)(iv)]If the family includes a person with disabilities, the PHA’s decision to terminate the family’sassistance is subject to consideration of reasonable accommodation in accordance with 24 CFRPart 8.PHA PolicyIf a family indicates that the behavior of a family member with a disability is the reasonfor a proposed termination of assistance, the PHA will determine whether the behavior isrelated to the disability. If so, upon the family’s request, the PHA will determine whetheralternative measures are appropriate as a reasonable accommodation. The PHA will onlyconsider accommodations that can reasonably be expected to address the behavior that isthe basis of the proposed termination of assistance. See Chapter 2 for a discussion ofreasonable accommodation.12-II.E. TERMINATING THE ASSISTANCE OF DOMESTIC VIOLENCE, DATINGVIOLENCE, OR STALKING VICTIMS AND PERPETRATORS [Pub.L. 109-162,Pub.L. 109-271]The Violence Against Women Reauthorization Act of 2005 (VAWA) provides that “criminalactivity directly relating to domestic violence, dating violence, or stalking, engaged in by amember of a tenant’s household or any guest or other person under the tenant’s control shall notbe a cause for termination of assistance, tenancy, or occupancy rights if the tenant or animmediate member of the tenant’s family is the victim or threatened victim of that domesticviolence, dating violence, or stalking.”VAWA also gives PHAs the authority to “terminate assistance to any individual who is a tenantor lawful occupant and who engages in criminal acts of physical violence against familymembers or others, without evicting, removing, terminating assistance to, or otherwisepenalizing the victim of such violence who is also a tenant or lawful occupant.”VAWA does not limit the authority of the PHA to terminate the assistance of any participant ifthe PHA “can demonstrate an actual and imminent threat to other tenants or those employed at orproviding service to the property if that tenant is not evicted or terminated from assistance.”PHA PolicyIn determining whether a participant who is a victim of domestic violence, datingviolence, or stalking is an actual and imminent threat to other tenants or those employedat or providing service to a property, the PHA will consider the following, and any otherrelevant, factors:Whether the threat is toward an employee or tenant other than the victim ofdomestic violence, dating violence, or stalkingWhether the threat is a physical danger beyond a speculative threatWhether the threat is likely to happen within a short period of timeWhether the threat to other tenants or employees can be eliminated in some otherway, such as by helping the victim relocate to a confidential location© Copyright 2008 Nan McKay & Associates, Inc.
