items, appliances or services cannot be placed under a separate non-lease agreementbetween the owner and family. Side payments for additional rent, or for items, appliancesor services customarily provided to unassisted families as part of the dwelling lease forthose families, are prohibited.Any items, appliances, or other services that are not customarily provided to unassistedfamilies as part of the dwelling lease with those families, are not permanently installed inthe dwelling unit and where the family has the sole option of not utilizing the item,appliance or service, may be included in a separate non-lease agreement between theowner and the family.The family is not liable and cannot be held responsible under the terms of the assisteddwelling lease for any charges pursuant to a separate non-lease agreement between theowner and the family. Non-payment of any charges pursuant to a separate non-leaseagreement between the owner and the family cannot be a cause for eviction ortermination of tenancy under the terms of the assisted dwelling lease.Separate non-lease agreements that involve additional items, appliances or other servicesmay be considered amenities offered by the owner and may be taken into considerationwhen determining the reasonableness of the rent for the property.If the family and owner have come to a written agreement on the amount of allowablecharges for a specific item, so long as those charges are reasonable and not a substitutefor higher rent, they will be allowed.All agreements for special items or services must be attached to the lease approved by thePHA.
