If an owner fails to correct HQS deficiencies by the time specified by the PHA, HUD requiresthe PHA to terminate housing assistance payments no later than the first of the month followingthe specified correction period (including any approved extension) [24 CFR 985.2(f)]. Noretroactive payments will be made to the owner. Owner rents will be terminated as a result ofHQS failures that are the family's responsibility after reasonable notice of termination has beenprovided.PHA PolicyThe PHA will make all HAP terminations effective the last day of the month followingthe expiration of the PHA specified correction period (including any extension).The PHA may prohibit an owner from entering into further HAP contracts and terminatecurrent contracts if a cumulative pattern of HQS violations is established during theprevious 18 months with the owner’s properties.During any termination period the family continues to be responsible for its share of the rent.The owner must not seek payment from the family for the <strong>Housing</strong> Assistance Payment portionand may not use the termination as cause for eviction.HAP Contract TerminationThe PHA must give the owner reasonable notice of the termination. The PHA will issue avoucher to permit the family to move to another unit as described in Chapter 10.PHA PolicyIf the owner completes corrections and notifies the PHA within 30 calendar days of thetermination date of the HAP contract, the PHA may reinstate if (1) the family still residesin the unit and wishes to remain in the unit and (2) the unit passes inspection.Reasonable notice of HAP contract termination by the PHA is 30 calendar days.8.II.H. ENFORCING FAMILY COMPLIANCE WITH HQS [24 CFR 982.404(b)]Families are responsible for correcting any HQS violations listed in paragraph 8.I.D. If thefamily fails to correct a violation within the period allowed by the PHA (and any extensions), thePHA will terminate the family’s assistance, according to the policies described in Chapter 12.If the owner carries out a repair for which the family is responsible under the lease, the ownermay bill the family for the cost of the repair.8-III.A.
