delayed start of periodic social security or supplemental security income (SSI) payments are notcounted as income [CFR 5.609(b)(4)].PHA PolicyLump-sum additions to Family assets, such as inheritances, insurance payments (includingpayments under health and accident insurance and worker's compensation), capital gains,and settlement for personal or property losses, are not included in income but may beincluded in assets.Lump-sum payments caused by delays in processing periodic payments such asunemployment or welfare assistance are counted as income. Lump sum payments fromSocial Security or SSI are excluded from income, but any amount remaining will beconsidered an asset. Deferred periodic payments, which have accumulated due to adispute, will be treated the same as periodic payments, which are deferred due to delays inprocessing.In order to determine amount of retroactive tenant rent that the family owes as a result ofthe lump sum receipt:The PHA will calculate prospectively if the family reported the payment within 10business days and retroactively to date of receipt if the receipt was not reported withinthat time frame.Prospective Calculation MethodologyIf the payment is reported on a timely basis, the calculation will be done prospectivelyand will result in an interim adjustment calculated as follows:At the next annual recertification, the PHA will apply the percentage balance to the lumpsum and add it to the rest of the annual income.At the PHA’s option, the PHA may enter into a Payment Agreement with the family.The amount owned by the family is a collectible debt even if the family becomesunassisted.Attorney FeesThe family’s attorney fee may be deducted from the lump sum payments whencomputing annual income if the attorney’s efforts have recovered lump sumcompensation, and the recovery paid to the family does not include an additional amountin full satisfaction of the attorney fees.© Copyright 2008 Nan McKay & Associates, Inc.
