For example: if a facility has a full-time administrator or other full-time or parttimestaff position filled and compensated, the facility’s owner, operator or their relative claimingcompensation for the same or similar functions are not allowed by the program.Where owners, operators, or their relatives are on salary at a facility, the program will reimbursethe facility to the extent that said individuals salaries are not excessive compared to otherindividuals who perform the same or similar functions and who are not owners, operators ortheir relatives. Owners include any individual or organization with any financial interest in thefacility operation and any member <strong>of</strong> such individual’s family including the spouse’s family.Owners also include all partners and all stockholders <strong>of</strong> organizations which have a financialinterest in the facility.<strong>514</strong>.13.27 Non-Allowable CostsNon-allowable costs are those costs which are not related to patient care or for which aseparate charge is made. This includes, but is not limited to, bad debts, charity and courtesyallowances, Medicare Part B chargeable items, personal resident property that has beenreported as lost or stolen, flowers and retirement gifts for employees. Refer to the <strong>West</strong> VirginiaMedicaid Long Term Care Users Guide to Reimbursement and MCOA for other non-allowablecosts. Other items not referred to in the Chart <strong>of</strong> Accounts may be specified in <strong>State</strong> or Federalregulations as non-allowable costs. All undocumented expenses shall be considered nonallowable.<strong>514</strong>.13.28 Travel – Out <strong>of</strong> <strong>State</strong>The cost <strong>of</strong> travel and associated expenses outside the <strong>State</strong> for conventions, meetings,trainings, assemblies, conferences or any related activities are non-allowable costs.<strong>514</strong>.13.29 Automobiles – Central OfficeAutomobiles used by central/home <strong>of</strong>fice personnel are non-allowable.<strong>514</strong>.13.30 Legal FeesLegal fees on failed appeals against the <strong>DHHR</strong> are non-allowable.<strong>514</strong>.13.31 Fines and PenaltiesIn an effort to contain costs, it is expected that providers will pay obligations on time as well astake advantage <strong>of</strong> any early payment discounts that are <strong>of</strong>fered by vendors. Costs related t<strong>of</strong>ines, penalties, late charges or any other cost increase imposed by vendors for not payingobligations in a timely manner are not allowed.
