Upon receipt <strong>of</strong> a written request by the resident or his/her representative, theadministrator or designee will provide within two working days copies <strong>of</strong> all records requested ata cost not to exceed the community standard for photocopies.The resident has the right to receive adequate, appropriate health care and appropriateprotection and support services with reasonable accommodation <strong>of</strong> individual need andpreference including, but not limited to selection <strong>of</strong> personal physician. The resident or his/herrepresentative has the right to be fully informed in a language that he/she can understand <strong>of</strong>his/her total health status. The resident or his/her representative has the right to refusetreatment, and to refuse to participate in experimental research.The resident or his/her representative has the right to be present and participate in theformulation <strong>of</strong> a care plan as well as be consulted in advance about any changes in treatment orcare. Self-medication by a resident must be allowed if individual capabilities are assessed anddocumented by pr<strong>of</strong>essional staff.Outside <strong>of</strong> the formal plan <strong>of</strong> care, the resident has the right to plan personal daily activities andparticipate in activities both inside and outside the facility.Residents who are entitled to Medicaid benefits or become eligible for Medicaid benefits mustbe informed in writing <strong>of</strong> the items and services under the <strong>State</strong> Plan for which the resident maynot be charged as well as the items for which the resident may be charged and the amount <strong>of</strong>the charges including an explanation <strong>of</strong> the resource amount. This information must also beprovided to the resident annually during the resident’s stay in the nursing facility.A resident <strong>of</strong> a nursing facility must be provided a room as homelike as possible according toindividual tastes, desires and medical necessities. Personal furnishings including furniture mustbe allowed depending on space. A private storage space within the personal room for clothingand possessions must be provided. The administrator or designee must take reasonableprecautions to protect and treat personal possessions with respect, as well as investigateincidents <strong>of</strong> loss, damage or misappropriation <strong>of</strong> property.The facility must provide a written description <strong>of</strong> legal rights including:The manner <strong>of</strong> protection <strong>of</strong> personal funds;The names, addresses, and telephone numbers <strong>of</strong> all pertinent <strong>State</strong> advocacy groups;A statement that the resident may file a complaint with the <strong>State</strong> survey and certificationagency concerning resident abuse, neglect, and/or misappropriation <strong>of</strong> funds or property inthe facility;The name, specialty and way <strong>of</strong> contacting the physician responsible for the care <strong>of</strong> theresident; andThe procedures for applying for and using Medicare and Medicaid benefits as a resident <strong>of</strong>a nursing facility.Department <strong>of</strong> Health and Human Resources <strong>Chapter</strong> <strong>514</strong>: <strong>Nursing</strong> <strong>Facility</strong> <strong>Services</strong> Page 41January 1, 2013DISCLAIMER: This manual does not address all the complexities <strong>of</strong> Medicaid policies and procedures,and must be supplemented with all <strong>State</strong> and Federal Laws and Regulations.
