Arrangements for securing the residents’ medical records and;Actions to be taken to locate a missing resident.The nursing facility’s governing body or designee must ensure that staff rehearses anddocument, at least annually, actions to be taken in the event <strong>of</strong> a missing resident.<strong>514</strong>.4.9 Resident RightsThe NF’s governing body or designee must:Establish a policy statement setting forth the rights <strong>of</strong> residents prohibiting themistreatment, neglect, misappropriation <strong>of</strong> resident property or abuse <strong>of</strong> resident;Post the written resident rights policy for staff, resident, families or representatives andall interested parties to view; andProvide policies and procedures and ensure that each resident admitted to the facility isfully informed <strong>of</strong> his/her rights and responsibilities as a resident in the facility.<strong>514</strong>.4.10 Hospital Transfer AgreementEach nursing facility’s governing body or designee must show documentation <strong>of</strong> a writtentransfer agreement that must be in effect with one or more hospitals approved for participationunder the Medicare and Medicaid programs in accordance with 42 CFR 483.75 (n). Theagreement must include information necessary to provide quality care and continuation <strong>of</strong>services by either the hospital or the nursing facility.The hospital transfer must include information regarding the resident and must include a copy <strong>of</strong>the Advanced Directives and the most current evaluations including a list <strong>of</strong> current medicationsand most recent PASRR Level II evaluation, if applicable.<strong>514</strong>.4.11 <strong>Services</strong> Provided by Outside SourcesIf a nursing facility does not provide a required service to meet the needs <strong>of</strong> one or moreresidents, the governing body or designee may enter into a written agreement / contract with anoutside service, program, or resource to provide this service which is to be paid by the facilityunder the all-inclusive rate. The administrator or designee is responsible and accountable forassuring that outside sources meet the standards for quality <strong>of</strong> services and the timeliness <strong>of</strong>providing those services.The administrator or designee must assure that the vendor and their staff is able to meet allmandatory educational, licensing, certification and criminal investigation background checkrequirements for the specific area <strong>of</strong> service(s) furnished and follow the policies and procedure<strong>of</strong> the nursing facility.Department <strong>of</strong> Health and Human Resources <strong>Chapter</strong> <strong>514</strong>: <strong>Nursing</strong> <strong>Facility</strong> <strong>Services</strong> Page 23January 1, 2013DISCLAIMER: This manual does not address all the complexities <strong>of</strong> Medicaid policies and procedures,and must be supplemented with all <strong>State</strong> and Federal Laws and Regulations.
