16permit bus is not put back on the route within 30 days after theaccident/breakdown, the permit shall be liable to be cancelled and shall be allottedafresh after following the due procedure.15. Performance, permit conditions and responsibility of the privateoperator.- The private operator shall ensure at all time that the permit is beingoperated strictly in terms of the provisions of the Motor Vehicles Act, 1988, CentralMotor Vehicles Rules, 1989, and the Haryana Motor Vehicle Rules, 1993, asamended from time to time, and instructions/ directions/orders issued by theCentral/State Government/State Transport Authority/Regional Transport Authority/Secretary, Regional Transport Authority from time to time. He shall ensure that thepermit is operated strictly in accordance with the terms and conditions enumeratedin this policy.16. Notice for withdrawal of bus.- A private operator before hesurrenders a permit shall give a minimum thirty days notice in writing for finalwithdrawal of the bus from operations. A surrendered permit shall be cancelledforthwith. State Transport Authority may, at any time, in accordance with theprocedure laid down in the policy, allot a permit on account of any vacancy arisingon a route.17. Eligibility criteria.- The following shall be the eligibility criteria,(i)the applicant should be a domicile of the State of Haryana;(ii) The applicant shall be 10 th pass under the 10+2 system forgeneral category and 8 th pass for applicant belonging toScheduled Castes.(iii) the applicant shall be more than 18 years and less than 40years in case of general category and shall be more than 18years and less than 45 years in case of candidates belonging toScheduled Castes, Backward Classes, Widows or legallyseparated women.(iv)(v)the applicant shall be unemployed; and shall not be employedin State Government, Central Govt., Public Central Undertakingor organized Sector/ limited company. Affidavit in this regardshall be submitted by the applicant duly attested.the applicant (in case of individual applicant) or at least one ofthe members of the Transport Cooperative Society, should holda valid driving license to drive a heavy transport vehicle whichshould have been issued at least 6 months prior to the date ofnotification of the policy and the license should be valid on thedate of allotment of permit.
17(vi)If any of the information given by the applicant found to beincorrect, his permit will be cancelled and he shall beprosecuted as per law.If the number of applicants fulfilling the eligibility criteriaincluding driving license of heavy transport vehicle are morethan the route permits available for allotment, in that case,allotment shall be made through an open draw of lots followinga transparent procedure from amongst such eligible applicants.However, if sufficient number of the applicants fulfill thecondition of having a HTV licence eligibility, then the applicants who holda Light Transport Vehicle driving license and have applied for a HTVlicence at the time of application and he obtains a HTV licencewithin one year of allotment and he fulfill all other eligibilityconditions. The L.T.V. license should have been issued at least 2 yearsprior to the date of Notification and should be valid on the date ofNotification. If however such an applicant who is allotted a permit underthis scheme fails to obtain an HTV licence within 1 year of the allotment,his permit shall be cancelled:. Provided that in case of registered transport co-operativeSociety each member of the Society shall have to fulfill the eligibilitycriteria except that if only one of the members has a valid requisitedriving license to drive a heavy vehicle, the Society shall be consideredeligible.18. Reservation.- The reservation shall be as per the reservation policyof the State Government. The Government of the State may reserve certainpercentage of the Stage Carriage permits for the Scheduled Caste, BackwardClass, Ex-Serviceman and other categories.The aim of the reservation is to provide adequate opportunities to all thesections of the Society both to contribute to the transport sector as well as tobenefit from the economic opportunities offered by the sector.19. Applicability.-(i)(ii)(iii)(iv)The policy shall be applicable on intra district routes only.However in order to provide connectivity to a market yard,mandi, hospital, school or college etc. the route may extend tothe neighbouring district.The holders of the route permit under the policy shall have toply Stage Carriage Vehicles having seating capacity of 52persons in case of full body buses and up to seating capacity of32 persons in case of mini buses.No inter State route shall be granted to the private operator inthis policy except the permission to use corridor not more than10 Kms. in a neighbouring State.The applicant shall apply on the application form prescribed bythe Department which can be purchased from STC office oroffice of the Secretary RTA of the concerned district.
