(03/2012) Page 34(b) Notwithst<strong>and</strong>ing (a) above, should an employee be deemed to have resigned in accordance withClause 21.5, the Employer will recover monies paid pursuant to this clause, on a pro rata basis.21.5 Deemed Resignation(a) An employee shall be deemed to have resigned on the date upon which leave pursuant toClauses 21.1, 21.2, or 21.3 commenced unless they advised the Employer of their intent to return towork one month prior to the expiration of the leave taken pursuant to Article 21, Maternity <strong>and</strong> ParentalLeave, or if they do not return to work after having given such advice.(b) <strong>Employees</strong> who decide to resign following maternity/parental/adoption leave are requested tosubmit a letter of resignation at least one (1) month prior to the expected return to work date.21.6 Entitlements Upon Return to Work(a) An employee who returns to work after the expiration of maternity or parental leaves shall retainthe seniority the employee had accumulated prior to commencing the leave <strong>and</strong> shall be credited withseniority for the period of time covered by the leave.(b) On return from maternity or parental leaves, an employee shall be placed in the employee'sformer position or in a position of equal rank <strong>and</strong> basic pay.(c) Vacation entitlements <strong>and</strong> vacation pay shall continue to accrue while an employee is on leavepursuant to Clause 21.1 <strong>and</strong> its waiting period providing the employee returns to work for a period ofnot less than six months.Vacation earned pursuant to this clause may be carried over to the following year.(d) <strong>Employees</strong> who are unable to complete the return to work period in (c) as a result of proceedingon maternity or parental leave shall be credited with their earned vacation entitlements <strong>and</strong> vacation payproviding the employee returns to work for a period of not less than six months following the expirationof the subsequent maternity or parental leave.21.7 Sick Leave CreditsIllness arising due to pregnancy during employment maybe charged to normal sick leave credits.22.1 Statutory ComplianceARTICLE 22 - OCCUPATIONAL HEALTH AND SAFETYThe Union <strong>and</strong> the Employer agree that regulations made pursuant to the Workers Compensation Act, theFactories' Act or any other statute of the Province of British Columbia pertaining to the workingenvironment, shall be fully complied with. First aid kits shall be supplied in accordance with this article.22.2 Joint Occupational Health <strong>and</strong> Safety CommitteeThe parties agree that the intent of this Agreement is to ensure that all employees shall have the maximumpossible access to the Occupational Health <strong>and</strong> Safety Committee structure. Local occupational health <strong>and</strong>safety committees will be established <strong>and</strong> operated as outlined below:(a) The Committee will be composed of not more than six (6) members, two (2) of whom shall beemployees appointed by the Union <strong>and</strong> two (2) of whom shall be representatives appointed by theEmployer. Up to two (2) additional members may be appointed by the Committee.(b) The committees will function in accordance with the Industrial Health <strong>and</strong> Safety Regulations,<strong>and</strong> will participate in developing a program to reduce risk of occupational injury <strong>and</strong> illness.
