(03/2012) Page 32(b) In cases where an employee's private affairs have occasioned a court appearance, such leave toattend a court shall be without pay.(c) An employee in receipt of his/her regular earnings while serving at court shall remit to theEmployer all monies paid to him/her by the court, except travelling <strong>and</strong> meal allowances notreimbursed by the Employer.(d) In the event an accused employee is jailed pending a court appearance, such leave of absenceshall be without pay.(e) For all the above leaves, the employee shall advise his/her supervisor as soon as he/she is awarethat such leave is required.20.6 Leave for Writing ExaminationsLeave of absence with pay shall be granted to allow employees time to write examinations for coursesapproved by the Employer. <strong>Employees</strong> shall advise the Employer of the time <strong>and</strong> place of theexamination when they are made aware of the time <strong>and</strong> place.20.7 Leave for Taking Courses(a) An employee shall be granted leave with pay to take courses at the request of the Employer asagreed between the parties in accordance with Article 12.13 - Performance <strong>and</strong> ClassificationAppraisal, or by mutual agreement between the Employer <strong>and</strong> employee. The Employer shall bear thefull cost of the course including tuition fees, entrance or registration fees, laboratory fees <strong>and</strong> courserequiredbooks, necessary travelling <strong>and</strong> subsistence expenses, <strong>and</strong> other legitimate expenses whereapplicable. Fees are to be paid by the Employer when due.(b) A regular employee may be granted leave without pay, or leave with partial pay, to take coursesin which the employee wishes to enrol.20.8 General LeaveNotwithst<strong>and</strong>ing any provision for leave in this Agreement, the Employer may grant a leave of absencewithout pay to an employee requesting leave for an emergency or other unusual circumstances. A leave ofabsence may also be granted for any other reason in which case approval shall not be unreasonablywithheld. All requests <strong>and</strong> approvals for leave shall be in writing. Upon request, the Employer will givereasons orally for withholding approval.20.9 Leave For Medical/Dental CareWhere it is not possible to schedule medical <strong>and</strong>/or dental appointments outside regularly scheduled workinghours, reasonable time off, not to exceed two (2) hours, for medical <strong>and</strong> dental appointments for employees orfor dependent children shall be permitted to a maximum of seven <strong>and</strong> one-half (7½) hours per year.Where employees have exceeded the seven <strong>and</strong> one-half (7½) hour maximum, they shall have the optionof using time from sick leave pursuant to Article 19.3 or, where requested, the Employer shall grant leavewithout pay.20.10 Maximum Leave EntitlementLeaves taken under Articles 20.2 <strong>and</strong> 20.3 shall not exceed a total of forty-five (45) hours per calendaryear, unless additional special leave is approved by the Employer.ARTICLE 21 - MATERNITY, ADOPTION AND PARENTAL LEAVE21.1 Maternity Leave(a) An employee is entitled to maternity leave of up to fifteen (15) weeks without pay for the birth ofher child.
